Court proceedings and other relief. If such escalation fails to resolve the issue, it shall be settled by arbitration administered by final and binding arbitration initiated and conducted according to the Rules of Arbitration of the International Chamber of Commerce (the “Arbitration Rules”), and judgment upon the award rendered by the arbitrators may be entered in any court having jurisdiction thereof. The arbitration shall be conducted in Vancouver, Canada. Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction to protect its Intellectual Property Rights.
