Common use of Court Witness Leave Clause in Contracts

Court Witness Leave. A regularly scheduled full or part-time nurse required 17 by the Employer or subpoenaed to serve as a witness as related to Employer 18 employment will be excused with pay from any regularly scheduled duty 19 whose hours conflict with the hours he or she must actually spend in 20 connection with the witness service, provided the nurse deposits any witness 21 fees received with Human Resources. Per Diem nurses may receive such 22 compensation only when scheduled to work in advance, in writing. The nurse 23 must report to work if the witness service ends prior to the conclusion of the 24 nurse’s scheduled shift. This provision shall not apply to Association- 25 originated subpoenas, Association-related cases, arbitrations, or similar 26 proceedings.
