COVID-19 Acknowledgement. Provider acknowledges the Coronavirus (COVID- 19) pandemic is a worldwide risk to human health. COVID-19 is highly contagious and can spread easily and exponentially. While persons of all ages are at risk of contracting COVID- 19, persons with compromised immune systems and older persons may be at particular risk. With full awareness and to the fullest extent allowable by law, Provider, for itself, its drivers and employees, hereby forever releases, waives, discharges, holds harmless and covenants not to sue DISTRICT, its governing board, officers, agents, employees, successors, assigns, independent contractors and/or volunteers from any and all liability claims, demands, actions or causes of action whatsoever directly or indirectly arising out of or related to any loss, damage or injury, including death, that may be sustained by Provider, and its drivers and employees, related to COVID-19 while performing transportation services under the Agreement for the DISTRICT.

I understand that by agreeing to attend classes, partake of any services or activities, or otherwise come onto campus or any property leased or owned by Xxxxx University, I assume all risks attendant thereto, including the risk of contracting COVID-19. I acknowledge Xxxxx University has the ability to pivot to a FlexLearning or fully remote model at any time, should the University deem necessary as outlined in the university catalogue xxxxx://xxxxx.xxxxxxxxxxxxxx.xxx/2021-2022/Undergraduate-Catalog/Coronavirus-Disease-2019-COVID-19-Acknowledgement-and-Pledge.

The customer acknowledges and agrees that the delivery and installation dates specified are an estimate only based on the best available information at time of ordering and that the current global crisis as a result of COVID-19 may result in delays in delivery of goods. Thermo Xxxxxx is not liable for any loss or damage sustained by the customer or any person due to delay in delivery or installation.

By signing/electronically confirming this COVID‐19 Amendment, the Resident represents that Resident understands, and Resident agrees to comply with, all of USC’s COVID‐19 health and safety protocols and procedures, as described in USC’s COVID‐19 training entitled “Health, Hygiene and Safety” (“COVID‐19 Training”) and USC’s COVID‐19 health and safety policies and guidelines (“COVID‐19 Policies”). Resident acknowledges and agrees that, notwithstanding any other provision in this Contract, they will not be permitted to check in to the Premises until they have completed the COVID‐19 Training and reviewed the COVID‐19 Policies, and understands that complying with the COVID‐19 Training and COVID‐19 Policies is a part of their responsibility to protect themselves, and by doing so, protect others in the community during the COVID‐19

Contractor is required to follow the BCOE’s guidance and protocols when onsite at any BCOE facility, or when providing services in-person to BCOE personnel or students.

Each Tenant represents and warrants to Landlord and to Landlord’s Agent MK Management Group, LLC that (i) it is assessing the Property at its own risk and it will use the Property and building in strict accordance with all Applicable Covid Laws, Rules and Regulations, (ii) it will comply with the Applicable Covid Laws, Rules and Regulations as they may be altered, amended or modified from time to time and any new laws, orders, rules and regulations may be promulgated from time to time and (iii) it is each Tenant’s duty to keep up to date with the changes to the Applicable Laws, Rules and Regulations.
