Delivery of Proof of Coverage. Prior to the commencement of operations, Contractor shall furnish County one or more certificates of insurance on a standard XXXXX form substantiating that each of the coverages required hereunder is in force, in form and substance satisfactory to County. Such certificates shall show the type and amount of coverage, Effective Dates and dates of expiration of policies and shall be accompanied by all required endorsements. If County requests, copies of each policy, together with all endorsements, shall also be promptly delivered to County. Contractor shall furnish renewal certificates to County to demonstrate maintenance of the required coverages throughout the Term.

No later than sixty (60) days before the commencement of operations (i.e., on or before May 1, 2009), Contractor shall furnish City one or more certificates of insurance on a standard XXXXX form substantiating that each of the coverages required hereunder are in force, in form and substance satisfactory to City. Such certificates shall show the type and amount of coverage, effective dates and dates of expiration of policies and shall be accompanied by all required endorsements. If City requests, copies of each policy, together with all endorsements, shall also be promptly delivered to City. Contractor shall furnish renewal certificates to City prior to July 1 of each year to demonstrate maintenance of the required coverages continuously throughout the Term.

Other Insurance Requirements 1785 1. In the event performance of any services is delegated to a Subcontractor, 1786 Contractor shall require such Subcontractor to provide statutory workers’ 1787 compensation insurance and employer’s liability insurance for all the 1788 Subcontractor’s employees engaged in the work. The liability insurance required 1789 by Subsection 10.02.A.2 shall cover all Subcontractors or the Subcontractor must 1790 furnish evidence of insurance provided by it meeting all of the requirements of this 1791 Section 10.02. 1792 2. Contractor shall comply with all requirements of the insurers issuing policies. The 1793 carrying of insurance shall not relieve Contractor from any obligation under this 1794 Agreement, including those imposed by Section 10.01. If any claim is made by 1795 any third person against Contractor or any Subcontractor on account of any 1796 occurrence related to this Agreement, Contractor shall promptly report the facts in 1797 writing to the insurance carrier and to the Authority. 1798 3. If Contractor fails to procure and maintain any insurance required by this 1799 Agreement, Authority may take out and maintain, at Contractor’s expense, such 1800 insurance as it may deem proper and deduct the cost thereof from any monies due 1801 Contractor. Alternatively, the Authority may treat the failure as an event of 1802 Contractor Default pursuant to Section 11.01. 1803 4. Simultaneously with the execution of this Agreement, Contractor shall furnish the SCWMA certificates of each policy of insurance required hereunder, in form and substance satisfactory to SCWMA. Such certificates shall show the type and amount of coverage, effective dates and dates of expiration of policies and shall have all required endorsements. If the SCWMA Contract Manager requests, copies of each policy, together with all endorsements, shall also be promptly delivered to SCWMA Contract Manager. Renewal certificates will be furnished periodically to SCWMA Contract Manager to demonstrate maintenance of the required coverages throughout the Term.

No later than ten (10) calendar days after 9 execution of this Agreement by both parties, CONTRACTOR shall 10 furnish CITY one or more certificates of insurance on a standard XXXXX 11 form and required endorsements substantiating that each of the coverages 12 and endorsements required hereunder are in force, in form and substance 13 satisfactory to CITY. Such certificates shall show the type and amount of 14 coverage, effective dates and dates of expiration of policies and shall be 15 accompanied by all required endorsements. If CITY requests, copies of 16 each policy, together with all endorsements, shall also be promptly 17 delivered to CITY in one complete package. CONTRACTOR shall furnish 18 renewal certificates to CITY to demonstrate maintenance of the required 19 coverages throughout the term. Each year on or before the renewal date 20 for all insurance policies required herein, CONTRACTOR shall deliver to 21 CITY a new package containing all insurance certificates with all of the 22 required endorsements and copies of all insurance policies required by this 23 Agreement.
