Delivery Timeframes. All ACH Credit Entries should be completed/authorized at least two (2) Business Days prior to theEffective Date” of the transactions. All ACH Debit Entries should be completed/authorized at least one (1) or two (2) Business Days prior to the “Effective Date” of the transactions. If the transactions are not completed/authorized by the required timeframe, the Bank cannot guarantee the transactions will be accepted by ACH processors, or be received/posted on the “Effective Date” by the recipient's financial institution. The Bank may accept these items and they will be forwarded to the ACH processor no later than the Bank’s next regularly scheduled delivery time. All ACH Credit originations represent financial obligations, thus the Bank may reject any Entry if Customer has failed to comply with its account balance obligations as set forth herein. The balance showing in the System associated with the account designated as the settlement account for the Entries must be sufficient to cover the total originations on the Delivery date as described above. If the settlement account does not have sufficient funds at that time, the Bank may, without any liability, deny, reject or process the Entries. If the entries are processed, Customer is still obligated to pay the Bank for the Entries.

Delivery Timeframes. The Contractor shall use commercially reasonable efforts to ship products ordered by the State before 5:00 p.m. local time by the next business day after acceptance of Purchase Order for all catalog items. The Contractor shall use commercially reasonable efforts to maintain an on-time delivery percentage of 99%.
Delivery Timeframes. Except for special orders, the Contractor shall use commercially reasonable best efforts to ensure that orders placed shall be dock delivered or otherwise specified and mutually agreed upon within 30 days of Purchase Order receipt. Delivery Timeframes. Open-Silicon will deliver Products in accordance with the delivery dates set forth in Customer’s Purchase Order. For partial shipments, Open-Silicon will ship the available Products unless directed by Customer to reschedule a shipment. Customer may specify a delivery destination other than its own premises (e.g., Drop Shipment) in order to facilitate delivery directly to its customers. Open-Silicon does not require that delivery be made directly to Customer. For the avoidance of doubt, Customer will be responsible for all costs relating to shipment.

Contractor will ship routine consumable items within 48 hours after receipt of order (ARO). All supplies must be delivered within 30 days ARO, unless a different delivery time is agreed to by the State Agency. Delivery Timeframes. 6.1 The Goods will be delivered by the Company to the Site nominated in the Quotation or otherwise agreed by the Company in writing. The Customer may not change the delivery address without the Company’s written consent, and additional charges may apply in the event of any changes. 6.2 The Company will not be responsible for any lost or stolen Goods in the event that they are delivered to the Site (regardless of whether the Customer or its Personnel were available to collect them). On the Company delivering the Goods to the Site as directed by the Customer, all risk in relation to storage, handling, cartage and any use of such goods shall pass to the Customer immediately following 6.3 The Company agrees to make all reasonable efforts and use its best endeavours to deliver the Goods and to otherwise perform its obligations under the Agreement on a timely basis. Any timelines for delivery of Goods given by the Company to the Customer is an estimate only and shall not be binding on the Company and subject to change without notice. The Company does not guarantee the Goods will be delivered by any delivery dates provided to the Customer. The Customer must still accept delivery of the Goods even if late and the Company will not be liable for any Loss or damage incurred by the Customer as a result of the delivery being late. 6.4 The Customer must take delivery of the Goods whenever they are tendered for delivery. In the event that the Customer is unable to take delivery of the Goods as arranged then the Company shall be entitled to charge a reasonable fee for redelivery and/or storage. Where this occurs, the Company will store the Goods at the risk of the Customer until delivery takes place again.

The Supplier will make all best endeavours to ensure rural deliveries will be delivered within 3 Working Days. 6.3.2. The Supplier will ensure that the following timeframes are met for all Simple list equipment orders: 6.3.2.1. North Island – within 3 Working Days of receipt of a completed order; 6.3.2.2. South Island – within 3 Working Days of receipt of a completed order; 6.3.2.3. Rural deliveries – within 5 Working Days of receipt of a completed order. 6.3.3. The Supplier will ensure that non-list equipment items are delivered to the specified address in the timeframes communicated to ACC in clause 5.16. If this is not possible the Supplier will notify ACC as soon as possible.
