Determination of Subcontracting. The contractor shall subcontract and determine the subcontractor in accordance with the provisions of the Special Contract. For specialized works with provisional estimates given in the priced bill of quantities or budget, the subcontractor shall be determined in accordance with Sub-Clause 10.7 [Provisional Estimate]. Where subcontracting is carried out in accordance with the contract, the contractor shall ensure that the subcontractor has the corresponding qualifications and capabilities. Subcontracting of works does not reduce or exempt the contractor's responsibilities and obligations, and the contractor and the subcontractor shall bear joint and several liability to the employer for the subcontracted works. Unless otherwise agreed in the contract, the contractor shall submit a copy of the subcontract contract to the employer and the supervisor within 7 days after the signing of the subcontract contract.
Determination of Subcontracting. The Contractor shall subcontract and determine the Subcontractor following the Special Terms of the Contract. For professional projects for which provisional valuation is given in the Priced Bill of Quantities or the Budget Document, the Subcontractor is determined pursuant to Article 10.7 (Provisional Valuation). In the case of subcontracting pursuant to the Contract, the Contractor shall ensure that the Subcontractor has the corresponding qualification and ability. The project subcontracting will not alleviate or exempt the Contractor's liability and obligation. The Contractor and the Subcontractor shall be severally and jointly liable to the Project Owner for subcontracted projects. Unless otherwise agreed in the Contract, the Contractor shall submit a counterpart of the subcontract to the Project Owner and the Supervisor within 7 days after execution of the subcontract.
Determination of Subcontracting. Professional work allowed to be subcontracted: pile foundation, foundation pit support, earthwork, steel structure and others. All subcontract of professional work should be approved by the Project Owner. Other agreement on the subcontract: the qualification of the Subcontractors should meet the requirements of national regulations on construction qualification, and be agreed by the Project Owner. In the case of subcontracting pursuant to the Contract, the Contractor shall ensure that the Subcontractor has the corresponding qualification and ability. The project subcontracting will not alleviate or exempt the Contractor's liability and obligation. The Contractor and the Subcontractor shall be severally and jointly liable to the Project Owner for subcontracted projects.
Determination of Subcontracting. The Contractor shall subcontract according to the terms of the special contract and determine the subcontractor. For a professional project that has been priced in a bxxx of quantities or a provisional estimate in a budget book, the subcontractor is determined in accordance with Section 10.7
Determination of Subcontracting. The special works that can be subcontracted are as follows. If the Contractor cannot meet the Employer's requirements for construction duration and quality due to such reasons as personnel, machines and tools, the Employer may allow the Contractor to subcontract the divisional works (e.g., curtain walls, water protection for roofs, air conditioning and greening) of the Project to the subcontractors with corresponding qualifications. However, the major works shall not be subcontracted. The Project shall not be contracted out. The Contractor shall assume the joint responsibilities for the subcontracted works.
