Disclosure Notification. In accordance with MFIPPA, this will notify the Borrower that any Personal Information that the Borrower provides to the City during the Term is being collected under the authority of the Municipal Act (Ontario).

Tenant shall immediately advise Landlord in writing of, and provide Landlord with a copy of (i) any written notices of violation or potential or alleged violation of any Hazardous Material Laws which are received by Tenant from any governmental agency concerned with Tenant’s or the Tenant Parties Environmental Activities, (ii) any and all written inquiry, investigation, enforcement, clean-up, removal or other governmental or regulatory actions instituted or threatened relating to the Land; (iii) all claims made by any third party or threatened by any governmental entity against Tenant or the Land relating to any Hazardous Materials, and (iv) any release of any Hazardous Materials on or about the Land, Buildings or Improvements which Tenant through its officers, directors, general managers and other managers of Tenant’s use upon the Land, Buildings and Improvements know of or reasonably believe may have occurred.
Disclosure Notification. If either Party becomes aware of an unauthorized disclosure of Confidential Information, they shall notify the other Party within three (3) business days. Both Parties acknowledge that a violation of their confidentiality obligations may cause severe and irreparable injury, which injury maynot be adequately compensable by monetary damages. Accordingly, in the event of a violation (or threatened or attempted violation) of a Party’s confidentiality obligations, either Party shall, in addition to any other legal and equitable rights and remedies, be entitled to seek immediate appropriate injunctive relief, or a decree of specific performance.
Disclosure Notification. 27.3.1 Each of the Finance Parties agrees to inform the Borrower about the circumstances of disclosure of the Confidential Information made pursuant to Clause 27.2.1(B)(3), except for disclosure of such information to a state authority during performance by it of its general supervisory or regulating functions.
27.3.2 The Creditors hereby inform the Borrower that the information about the Borrower and this Agreement specified in article 4 of the Credit Records Law will be sent to a relevant credit records bureau in accordance with the Credit Records Law.

Based on Discovery Education’s security risk assessments and ongoing security monitoring, Discovery Education gathers and analyzes information regarding new threats and vulnerabilities, actual data attacks, and new opportunities for managing security risks and incidents. In the event of an actual data breach, there is a comprehensive cybersecurity incident response plan in place that includes communication to relevant parties. The Service Provider's Student Data Protection Addendum is attached hereto as Exhibit A. Discovery Education shall use such student data provided in compliance with the COPPA, FERPA, CIPA and other applicable laws, regulations and statutes, and (b) the Student Data Transparency and Security Act in Colorado House Bill 16-1423 and (iii) Discovery’s Data Security Policy.
