Discount Fare Schemes. (a) If the Secretary of State 50 and/or the Regulator effects or proposes any amendment to any existing Discount Fare Scheme or any new scheme for offering through tickets, inter available tickets, staff tickets, fare discount tickets or enquiry schemes, in any such case, in relation to all or a majority of the franchise agreements awarded by the Secretary of State or franchise agreements awarded by the Secretary of State 51 for regional services under section 28 of the Act or which is otherwise intended to apply in general to passenger rail operators operating passenger rail services under contract to the Secretary of State 52 (whether or not in conjunction with operators of any other form of transport), then, if the Operator would not otherwise be required to participate in such new or amended scheme, the Awarding Authority may by notice in writing to the Operator require the Operator to participate in such scheme as so amended or effected and the Operator shall, at the request of the Awarding Authority, consent to any modification to the conditions of any of the Licences and take such other action as the Awarding Authority may reasonably request to provide for and facilitate its participation in any such scheme. (b) If the Awarding Authority requires the Operator to participate in any scheme which is amended or effected as referred to in Clause 9.6(a) then, if either the Awarding Authority or the Operator so elects within 21 days of notice requiring its participation in such scheme as referred to in Clause 9.6(a), the Contract Payments payable by or to the Awarding Authority shall, subject to the following provisions of this Clause 9.6, be adjusted by an amount equivalent, in the reasonable opinion of the Awarding Authority, to the Net Loss or Net Gain (if any) caused to or made by the Operator as a result thereof. (c) Where the No Net Loss No Net Gain Regime is to apply to an amendment to an existing Discount Fare Scheme (or other scheme referred to in Clause 9.6(a) in which the Operator is already participating or obliged to participate under this Agreement, then the No Net Loss No Net Gain Regime shall apply so that the adjustment relates to the Net Loss or Net Gain from that amendment rather than the Net Loss or Net Gain resulting from that scheme itself. (d) The Awarding Authority shall provide a reasonable opportunity to the Operator to make representations to the Awarding Authority before requiring its participation in a new or amended Scheme und...

Discount Fare Schemes. The Operator shall participate in and comply with its obligations under the terms of each Discount Fare Scheme listed in this Agreement or any other scheme designated as such pursuant to paragraph 4.2.
Discount Fare Schemes. 3.1 If the Secretary of State: (a) effects, or proposes to effect, an amendment to a Discount Fare Scheme; (b) introduces any new Discount Fare Scheme; or (c) ceases to approve a Discount Fare Scheme, for the purposes of section 28 of the Act, such amendment, intended amendment, introduction or cessation of approval shall be a Change. 3.2 The Secretary of State shall provide a reasonable opportunity to the Franchisee to make representations to him before amending, introducing or ceasing to approve a Discount Fare Scheme pursuant to paragraph 3.1. 3.3 The Franchisee shall supply to the Secretary of State, in respect of any Discount Fare Scheme referred to in paragraph 3.1, such information within such period as the Secretary of State may reasonably require for the purposes of determining the financial effect of any such amendment, intended amendment, introduction or cessation of approval.

  • COVID-19 Vaccine Passports Pursuant to Texas Health and Safety Code, Section 161.0085(c), Contractor certifies that it does not require its customers to provide any documentation certifying the customer’s COVID-19 vaccination or post-transmission recovery on entry to, to gain access to, or to receive service from the Contractor’s business. Contractor acknowledges that such a vaccine or recovery requirement would make Contractor ineligible for a state-funded contract.

  • Unbundled Copper Loops (UCL) 2.4.1 BellSouth shall make available Unbundled Copper Loops (UCLs). The UCL is a copper twisted pair Loop that is unencumbered by any intervening equipment (e.g., filters, load coils, range extenders, digital loop carrier, or repeaters) and is not intended to support any particular telecommunications service. The UCL will be offered in two types – Designed and Non-Designed.

  • Wire Unbundled DS1 Digital Loop This is a designed 4-wire Loop that is provisioned according to industry standards for DS1 or Primary Rate ISDN services and will come standard with a test point, OC, and a DLR. A DS1 Loop may be provisioned over a variety of loop transmission technologies including copper, HDSL-based technology or fiber optic transport systems. It will include a 4-Wire DS1 Network Interface at the End User’s location.

  • Unbundled Digital Loops 2.3.1 BellSouth will offer Unbundled Digital Loops (UDL). UDLs are service specific, will be designed, will be provisioned with test points (where appropriate), and will come standard with OC and a DLR. The various UDLs are intended to support a specific digital transmission scheme or service. 2.3.2 BellSouth shall make available the following UDLs, subject to restrictions set forth herein:

Such switching and tagging rules shall be developed on a non-discriminatory basis. The Parties shall comply with applicable switching and tagging rules, as amended from time to time, in obtaining clearances for work or for switching operations on equipment.

  • Shift Rotation Routine shift rotation is not an approach to staffing endorsed by the Employer. Except for emergency situations where it may be necessary to provide safe patient care, shift rotation will not be utilized without mutual consent. If such an occasion should ever occur, volunteers will be sought first. If no one volunteers, the Employer will rotate shifts on an inverse seniority basis until the staff vacancies are filled.

  • Payment Frequency As of the Cutoff Date and as shown on the books of CNHICA: (A) Receivables having an aggregate Statistical Contract Value of approximately 59.84% of the Aggregate Statistical Contract Value had annual scheduled payments, (B) Receivables having an aggregate Statistical Contract Value of approximately 2.65% of the Aggregate Statistical Contract Value had semi-annual scheduled payments, (C) Receivables having an aggregate Statistical Contract Value of approximately 0.73% of the Aggregate Statistical Contract Value had quarterly scheduled payments, (D) Receivables having an aggregate Statistical Contract Value of approximately 32.13% of the Aggregate Statistical Contract Value had monthly scheduled payments, and (E) the remainder of the Receivables had irregularly scheduled payments.

  • Loop Provisioning Involving Integrated Digital Loop Carriers 2.6.1 Where Xxxx has requested an Unbundled Loop and BellSouth uses IDLC systems to provide the local service to the End User and BellSouth has a suitable alternate facility available, BellSouth will make such alternative facilities available to Xxxx. If a suitable alternative facility is not available, then to the extent it is technically feasible, BellSouth will implement one of the following alternative arrangements for Xxxx (e.g. hairpinning): 1. Roll the circuit(s) from the IDLC to any spare copper that exists to the customer premises. 2. Roll the circuit(s) from the IDLC to an existing DLC that is not integrated. 3. If capacity exists, provide "side-door" porting through the switch. 4. If capacity exists, provide "Digital Access Cross Connect System (DACS)- door" porting (if the IDLC routes through a DACS prior to integration into the switch). 2.6.2 Arrangements 3 and 4 above require the use of a designed circuit. Therefore, non- designed Loops such as the SL1 voice grade and UCL-ND may not be ordered in these cases. 2.6.3 If no alternate facility is available, and upon request from Xxxx, and if agreed to by both Parties, BellSouth may utilize its Special Construction (SC) process to determine the additional costs required to provision facilities. Xxxx will then have the option of paying the one-time SC rates to place the Loop.

  • RE-WEIGHING PRODUCT Deliveries are subject to re- weighing at the point of destination by the Authorized User. If shrinkage occurs which exceeds that normally allowable in the trade, the Authorized User shall have the option to require delivery of the difference in quantity or to reduce the payment accordingly. Such option shall be exercised in writing by the Authorized User.
