Article V permits requests for mutual aid and assistance in the event of an “Emergency.” An “Emergency” under Article II is defined as “an event that is, or is likely to be, beyond the control of the services, personnel, equipment, and facilities of a Mutual Aid and Assistance Program Member.” This definition has two noteworthy characteristics. First, the use of the word “event,” rather than “disaster,” broadens the situations in which Members can request mutual aid and assistance. Second, an Emergency includes events that are “likely to be” beyond the control of the participating utility. By including the “is likely to be” language, participating utilities can request mutual aid and assistance before an event overwhelms their resources. This approach envisions situations where pre-event response would be necessary to protect human health and property. The Florida and Texas Agreements do not allow for pre-event assistance requests. 2. Article V permits oral and written requests for assistance; however, when made orally, the re- questing member must put the request in writing as soon as practicable. This approach balances the need to make a quick and prompt request with the need for accuracy.

(c) Where a concrete pour has been commenced prior to the commencement of a period of Inclement Weather Employees may be required to complete such concrete pour to a practical stage and for such work shall be paid at the rate of double time calculated to the next hour, and in the case of wet weather shall be provided with adequate wet weather gear. (d) If an Employee’s clothes become wet as a result of working in the rain during a concrete pour the Employee shall, unless the Employee has a change of dry working clothes available, be allowed to go home without loss of pay. (e) The provisions of clauses 32.7(c) and 32.7(d) hereof shall also apply in the case of emergency work where the Employees concerned and their delegates agree that the work is of an emergency nature and can start and/or proceed.
