Dispensation. The Consultant certifies it is not required to obtain a dispensation or waiver in compliance with the applicable laws and regulations of the Government of Puerto Rico prior to or in connection with the execution of this Agreement. The Parties agree that the proven illegality of any of the provisions of this Agreement shall not invalidate it as a whole.

Dispensation. 1. At the request of parties to another CLA, the CLA parties may grant dispensation in respect of the application of (the provisions of) this CLA, subject to conditions to be set by the CLA parties, which are included in Appendix IX of this CLA. The SNCU’s (Foundation for monitoring compli- ance with the Collective Labour Agreement for Temporary Agency Workers) confirmation of the fulfilment of the CLA (provision) for which dispensation has been requested shall be a precondi- tion for dispensation.

Dispensation. If an employer requests the CLA parties for exemption from the application of particular provisions in this CLA, these parties may decide this in collective consultation. An employer submitting a request for dispensation to the CLA parties shall send a copy of this to the employee representation. The employee representation shall also receive a copy of the decision of the CLA parties regarding the request from the employer. Dispensation may also be requested for deviation from this CLA for a group of employees at the employer. In its request for dispensation, the employer should state the nature of its proposed deviation from the provisions of the CLA. Proposed amendments to deviating arrangements due to a dispensation must be submitted to the CLA parties.

Dispensation. 10.10.1 What does this concern? ▪ A request for dispensation is a request to be exempted from the obligation to comply with one or more provisions of this collective agreement, the Collective agreement on unworkable weather conditions and/or the Collective agreement on industry-wide schemes for the construction & infrastructure sector. ▪ Annex 9 (Rules on Dispensation) sets out the rules that apply to such dispensation.
Dispensation. When the employer wishes to deviate in a negative way from the basic pension scheme, it must submit a request to the dispensation committee.
Dispensation. In special cases, the Parties may grant dispensation to an employer so as not to fall within the scope of the Collective Agreement. In case of a dispensation request, the Parties to the Agreement will in any case apply the following assessment criteria: − The reasons for requesting dispensation must be sufficiently well-founded; well-founded reasons exist when the situation in the company seeking dispensation differs from what is customary in the industry; − The employeesterms of employment must be sufficiently guaranteed; − The terms and conditions of employment proposed by the employer must not be in conflict with statutory provisions; − The employer has its own legally valid collective agreement, signed by at least one of the trade unions affiliated to the Collective Agreement for the Insurance Industry. To qualify for dispensation, all these criteria must be met as a minimum. If the employer and/or one or more subsidiaries no longer meet at least one of the above criteria, the dispensation will come to an end. The application for dispensation must be submitted to the Joint Committee, see Annex 1.6.
