Distribution of Settlement Awards. Provided this Settlement becomes Effective, the Settlement Administrator shall prepare the checks constituting the individual Settlement Awards, including any required withholdings, and shall cause those checks to be mailed to the Participating Settlement Class Members on a proportionate basis as funds are received. Plaintiff may request from the Court that the number distributions to the class be limited to 1, 2 or 3 if necessary for efficiency reasons. The checks constituting the individual Settlement Awards shall be negotiable for a period of 120 days from date of issuance, after which the checks shall become void. Distribution of Settlement Awards. Within 30 calendar days after the Effective Date, Settlement Awards shall be mailed by the Settlement Administrator to Settlement Class Members. The Settlement Administrator shall mail, by first class mail, a check to each claiming Settlement Class Member. No skip tracing or re-mailing of returned mail will be required. All checks for Settlement Awards will be valid for 120 calendar days from the date on the check. Any remaining monies from uncashed Settlement Awards may be redistributed in a second distribution to Settlement Class Members who submitted a valid and timely claim. However, if a second distribution would result in less than $5 per qualifying claimant, the remaining monies will instead be donated to the Massachusetts Bar Student Loan Bankruptcy Assistance Project as a Cy Pres Distribution pursuant to Section III(F)(7) below. Any remaining monies from uncashed settlement awards following a second distribution will be donated to the Massachusetts Bar Student Loan Bankruptcy Assistance Project as a Cy Pres Distribution. No monies out of the Fund will revert back to NSL, and no part of a Cy Pres Distribution may be used to pay any attorneys’ fees in the Massachusetts Bar Student Loan Bankruptcy Assistance Project, as agreed by the Parties
Distribution of Settlement Awards. 51. Within 7 days after this Settlement’s Effective Date, Class Counsel will provide a complete list of Claimants to Papa South’s counsel, and an accounting of the amounts of the proposed Settlement Awards to be individually paid to each Claimant in accordance with the formula set out in Paragraph 21 of this Settlement Agreement.
Distribution of Settlement Awards. After the distributions set forth in Section VI(D)(1), there shall be a process to administer the remainder of the Class Fund.   • Termination of Settlement If the Settlement is terminated as provided in the Stipulation, the Settlement is not approved, or the Effective Date of the Settlement otherwise fails to occur, this Order shall be vacated, rendered null and void, and be of no further force and effect, except as otherwise provided by the Stipulation, and this Order shall be without prejudice to the rights of Lead Plaintiff, the other Settlement Class Members, and Defendants, and the Parties shall revert to their respective positions in the Action immediately prior to the execution of the Stipulation.

  • Nonqualified Distributions If you do not meet the requirements for a qualified distribution, any earnings you withdraw from your Xxxx XXX will be included in your gross income and, if you are under age 59½, may be subject to an early distribution penalty tax. However, when you take a distribution, the amounts you contributed annually to any Xxxx XXX and any military death gratuity or Servicemembers’ Group Life Insurance (SGLI) payments that you rolled over to a Xxxx XXX, will be deemed to be removed first, followed by conversion and employer-sponsored retirement plan rollover contributions made to any Xxxx XXX on a first-in, first-out basis. Therefore, your nonqualified distributions will not be taxable to you until your withdrawals exceed the amount of your annual contributions, military death gratuity or SGLI payments and your conversions and employer-sponsored retirement plan rollovers.

  • Certification of Settlement Class Promptly after execution of the Settlement Agreement, Class Counsel will ask the Court to issue an order certifying the Settlement Class for settlement purposes only. Xxxxx agrees not to object to this request without waiver of its right to contest certification or the merits of the Lawsuit if the settlement does not receive final approval or the Effective Date (defined in paragraph 14 below) does not occur.

  • Rollovers of Exxon Xxxxxx Settlement Payments If you receive a qualified settlement payment from Exxon Xxxxxx litigation, you may roll over the amount of the settlement, up to $100,000, reduced by the amount of any qualified Exxon Xxxxxx settlement income previously contributed to a Traditional or Xxxx XXX or eligible retirement plan in prior taxable years. You will have until your tax return due date (not including extensions) for the year in which the qualified settlement income is received to make the rollover contribution.   • Qualified Settlement Fund The Administrator shall establish a settlement fund that meets the requirements of a Qualified Settlement Fund (“QSF”) under US Treasury Regulation section 468B-1.
