Distributions to Settlement Class Members. Each Settlement Class Member for whom the Class Administrator has a deliverable address (which shall be determined based on whether the Notice is returned undeliverable) shall be paid a single Settlement Award that shall be calculated based on the Classes or Subclass of which the Class Member is a part:

Distributions to Settlement Class Members. Subject to the claims process set forth in this Agreement, each Settlement Class Member is entitled to one disbursement from the Settlement Fund. The amount of the disbursement shall be based upon the chart prepared by Class Counsel and American Legal Claim Services LLC. No amount shall revert to Defendant, except as set forth in Paragraph 10(d) ("Opt-Out Requirements"). Settlement Awards shall be mailed by the Claims Administrator within twenty-eight (28) days after the Effective Date, or such time as determined by the Court. The Claims Administrator shall mail, by first class mail, a check to each eligible Settlement Class Member receiving a Settlement Award. The Claims Administrator will perform one instance of skip-tracing and re-mailing, as necessary.
Distributions to Settlement Class Members. Each Settlement Class Member for whom Defendant has a deliverable address (which shall be determined based on whether the Notice is returned undeliverable) shall be paid a Settlement Award reflecting their proportional share of the net settlement fund calculated based on the amount of the typical negotiation discount applied to the Settlement Class Members’ claim as reflected in the Class Data described in Section VII. MOE shall mail Settlement Awards within forty-five (45) days of the Effective Date. The net settlement fund shall be the amount of the settlement fund remaining after deducting payments to Plaintiffs and Class Counsel described in Section V.

Defendant, in consultation with Class Counsel and any expert, shall identify data—to the extent it exists in reasonably accessible electronic form—sufficient to calculate the total APSN Fees assessed to the Account(s) of each Participating Settlement Class Member (“Eligible Fees”). Class Counsel will then work with the Settlement Administrator, Defendant, and any expert to distribute the Net Settlement Fund and implement the Overdraft Forgiveness benefit to eligible Participating Settlement Class Members using the below methodology, or such other methodology as would have an equivalent result.

  • Notice to Settlement Class Members 5.1 The Parties agree that the following Notice Program provides reasonable notice to the Settlement Class.

Pursuant to Rule 23(e)(1)(B)(ii) of the Federal Rules of Civil Procedure, the Court preliminarily finds that the Court will likely find that the requirements of Federal Rules of Civil Procedure 23(a) and 23(b)(3) have been satisfied for settlement and judgment purposes only. As to the requirements of Rule 23(a) for settlement purposes only, (i) the Settlement Class provisionally certified herein likely exceeds 100,000 individuals, and joinder of all would be impracticable; (ii) there are questions of law and fact common to the Settlement Class; (iii) Class Representatives’ claims are typical of the claims of the Settlement Class they seek to represent for purposes of settlement; and (iv) Class Representatives are adequate representatives of the Settlement Class. As to the requirements of Rule 23(b)(3) for settlement purposes only, questions of law and fact common to the Settlement Class predominate over any questions affecting any individual Settlement Class Member, and a class action on behalf of the Settlement Class is superior to other available means of settling and disposing of this dispute.

  • The Settlement Fund 37. Releasors shall look solely to the Settlement Fund for settlement and satisfaction of all Released Claims against the DENSO Defendants and the Releasees, and shall have no other recovery against the DENSO Defendants or any other Releasee for any Released Claims.

  • Objections to Settlement 7.7.1 Only Participating Class Members may object to the class action components of the Settlement and/or this Agreement, including contesting the fairness of the Settlement, and/or amounts requested for the Class Counsel Fees Payment, Class Counsel Litigation Expenses Payment and/or Class Representative Service Payment.
