DISTRICT’s Right to Suspend. The DISTRICT may, in its discretion, suspend all or any part of the construction of the Project or the CONSULTANT’s services under this Agreement; provided, however, that if the DISTRICT shall suspend construction of the Project or CONSULTANT’s services under this Agreement for a period of sixty (60) consecutive days or more and such suspension is not caused by the CONSULTANT’s default or the acts or omissions of CONSULTANT or its CONSULTANTs, upon lifting of such suspension, the Contract Price may be adjusted to reflect actual costs and expenses incurred by CONSULTANT, if any, as a direct result of the suspension and resumption of the Project construction or CONSULTANT’s services under this Agreement.
DISTRICT’s Right to Suspend. The DISTRICT may, in its discretion, suspend all or any part of the construction of the Project or the ARCHITECT’s services under this Agreement; provided, however, that if the DISTRICT shall suspend construction of the Project or ARCHITECT’s services under this Agreement for a period of one-hundred and twenty (120) consecutive days or more and such suspension is not caused by the ARCHITECT’s default or the acts or omissions of ARCHITECT or its ARCHITECTs, upon lifting of such suspension, the Contract Price may be adjusted to reflect actual costs and expenses incurred by ARCHITECT, if any, as a direct result of the suspension and resumption of the Project construction or ARCHITECT’s services under this Agreement.
DISTRICT’s Right to Suspend. The DISTRICT may, in its discretion, suspend all services to be provided hereunder without termination of this Agreement; provided, however, that if the DISTRICT shall suspend PROVIDER’S services hereunder for a period exceeding sixty (60) consecutive days and such suspension shall not be caused by PROVIDER or the acts or omissions of PROVIDER, PROVIDER may, at his/her sole discretion, elect to terminate this Agreement for the purpose of reassigning personnel to other projects. Such termination shall be effective seven (7) calendar days following PROVIDER’S written notice of termination. In the event of such termination, notice shall be deemed given when received by DISTRICT or no later than three (3) days after the date of mailing, whichever is sooner.

The District may, in its sole discretion, suspend all or any part of the construction of the Project or the Architect’s services hereunder; provided, however, that if the District shall suspend construction of the Project or Architect’s services hereunder for a period of sixty (60) consecutive days or more and such suspension is not caused by the Architect’s default or the acts or omissions of Architect or its Design Consultants, upon rescission of such suspension, the Contract Price will be subject to adjustment to provide for actual costs and expenses incurred by Architect as a direct result of the suspension and resumption of Project construction or Architect’s services hereunder.

The District may, in its discretion, suspend all or any part of the design, bidding or construction of an Assigned Project, work under a Construction Contract or CM’s services under a Task Order provided, however, that if the District shall suspend construction of an Assigned Project, work under a Construction Contract or CM’s services under a Task Order for an Assigned Project for a period of sixty (60) consecutive days or more and such suspension is not caused by CM or the acts or omissions of CM, upon rescission of such suspension, the Contract Price for the Assigned Project will be subject to adjusted to provide for actual costs and expenses incurred by CM as a direct result of the suspension and resumption of construction of the Assigned Project or construction under a Construction Contract or CM’s services under the Task Order for an Assigned Project.
DISTRICT’s Right to Suspend. The District may, in its discretion, suspend all or any part of the design or construction of as Assigned Project or the Professional Services for an Assigned Project; provided, however, that if the District will suspend design or construction of an Assigned Project or Professional Services for an Assigned Project for a period of sixty (60) consecutive days or more and such suspension is not caused by the Consultant’s default or the acts or omissions of the Consultant, upon rescission of such suspension, the Contract Price under PAAs issued prior to the District’s directive to suspend design, construction or Professional Services will be subject to adjustment to reflect actual costs and expenses incurred by Consultant, if any, as a direct result of the suspension and resumption of design or construction of the Project or Professional Services for Assigned Projects. Except as set forth herein, the Contract Price under PAAs is not subject to adjustment for any suspension of construction authorized or directed by the District.

The District may, in its discretion, suspend all or any part of the construction of an Assigned Project, work under a Construction Contract or CM’s services under a Task Order provided, however, that if the District shall suspend construction of an Assigned Project, work under a Construction Contract or CM’s services under a Task Order for an Assigned Project for a period of sixty (60) consecutive days or more and such suspension is not caused by CM or the acts or omissions of CM, upon recession of such suspension, the Contract Price will be subject to adjusted to provide for actual costs and expenses incurred by CM as a direct result of the suspension and resumption of construction of the Assigned Project or construction under a Construction Contract or CM’s services under the Task Order for an Assigned Project.

The District may, in its discretion, suspend all or any part of the construction of an Assigned Project or the Architect’s services under a Project Assignment; provided, however, that if the District shall suspend construction of an Assigned Project or Architect’s services under a Project Assignment for a period of sixty (60) consecutive days or more and such suspension is not caused by the Architect’s default or the acts or omissions of Architect or its Sub-Consultants, upon rescission of such suspension, the Contract Price for the Assigned Project will be subject to adjustment to reflect changes in actual costs and expenses incurred by Architect, if any, as a direct result of the suspension and resumption of the Assigned Project construction or Architect’s services under a Project Assignment. If such is the case, the Architect’s submittal schedule established in the Project Assignment shall also be subject to an adjustment, if required, as a direct result of the suspension and resumption of the Architect’s services.

DISTRICT’s Right to Suspend. The District may, in its discretion, suspend all or any part of the design or construction of the Project or the Services under this Agreement by written notice to the Consultant. If the District directs suspension pursuant to the foregoing, the Consultant shall resume and complete Services as directed by the District. The Services Contract Price shall not be subject to adjustment for any suspension directed by the District hereunder, unless the period of suspension directed by the District exceeds sixty (60) consecutive days and such suspension is not caused by: (i) the Consultant’s default or the acts or omissions of Consultant or its Sub-Consultants or (ii) events beyond the reasonable control of the District. If the suspension directed by the District exceeds sixty (60) consecutive days, adjustment of the Services Contract Price shall be limited to substantiated increased costs of completing Services which are the direct result of the District’s direction to suspend.
