During Trial Period. The VILLAGE and the RESIDENT shall consider the first ninety (90) days of occupancy an adjustment or trial period for both the VILLAGE and the RESIDENT. During this period, either the VILLAGE or the RESIDENT may cancel this Agreement by giving thirty (30) days written notice to the other party. In the event of such cancellation, the VILLAGE will refund the Accommodation Fee paid, less the sum of Five Thousand Dollars ($5,000.00) which represents reasonable compensation for service charges and expenses incurred in processing the application, reviewing the suitability of the RESIDENT for placement of the RESIDENT within the VILLAGE and the cost of remarketing the Unit and less the costs of renovating the Unit to restore it to new condition. Any amounts paid by RESIDENT for special options shall not be refunded. The refund shall be paid to RESIDENT at the time and in the manner provided in Paragraphs VI.C. and VI.D.

The Parties agree that these works may be taken up and completed to the extent feasible by the Contractor, before declaration of the Appointed Date, but no claim against the Authority for delay shall survive during this period and that the undertaking of these works by the Contractor shall not count towards the Scheduled Construction Period of the project which starts counting only from the Appointed Date. No construction activity of the Project Highway shall be undertaken during the development period.

  • Transitional Period At the end of the transitional period as defined in Article 10(2) of the Directive, the contracting parties shall cease to apply the withholding/retention tax and revenue sharing provided for in this Agreement and shall apply in respect of the other contracting party the automatic exchange of information provisions in the same manner as is provided for in Chapter II of the Directive. If during the transitional period either of the contracting parties elects to apply the automatic exchange of information provisions in the same manner as is provided for in Chapter II of the Directive it shall no longer apply the withholding/retention tax and the revenue sharing provided for in Article 9 of this Agreement.

  • Term; Suspension; Termination A. This Agreement shall become effective on the date that it is approved by both parties, set forth on the first page of the Agreement, and shall continue in effect until both parties have fully performed their respective obligations under this Agreement, unless sooner terminated as provided herein.
