Eligibility for a Continuing Contract. Members of the bargaining unit shall be considered for a continuing contract if they meet the conditions stipulated in ORC Section 3319.08 for the award of a continuing contract. However, to be eligible for consideration for a continuing contract, an employee must have filed, or have applied for, a valid professional or permanent certificate and/or license with the Superintendent and made written notification to the Superintendent of his/her intention to apply for continuing contract status on or before November 1. This date is necessary to meet the evaluation requirements as set forth in Article III (B). Any member who applies for a continuing contract will be evaluated during the year of application. The Board will award any continuing contract no later than its next regular May Board meeting following this filing. Nothing herein shall require the Board to grant a continuing contract during the unexpired term of a one (1) year limited contract nor shall the Board be prohibited from such action. Pursuant to ORC Section 4117.11, the language of this subparagraph K shall supersede and take precedence over any contrary state law on continuing contract.

Eligibility for a Continuing Contract. Those teachers who qualify shall be considered for a continuing contract as prescribed by law; provided, however, to be eligible for consideration for continuing contract, a teacher must have filed a professional, permanent life certificate, license or its equivalent as prescribed by law with the local Superintendent on or before any yearly scheduled LPDC meeting date and shall be acted upon by the Board at the next month’s regularly scheduled Board meeting.

Any member receiving Worker's Compensation or disability benefits shall not be eligible to receive benefits from the Sick Leave Bank. 4. A member who is on leave of absence, suspended, or terminated from the Xxxxxxx County Board of Education shall not be eligible for Sick Leave Bank benefits. 5. The form, entitled "Request For Sick Leave Benefits" and physician's statement are required before the SLB Review Committee will consider a request for benefits. The physician's statement shall include a history of the illness, date the illness began, a diagnosis and prognosis, and any other related information. 6. Approval by the Sick Leave Bank Review Committee is required prior to the receiving of benefits. 7. Normal pregnancies, childbirth, childcare, or child adoption shall not be considered as eligible reasons for Sick Leave Bank benefits. 8. A four (4)-member Sick Leave Bank Review Committee, consisting of two (2) members appointed by the President of the Association and two (2) appointed by the Superintendent, shall have the responsibility of receiving requests, verifying the validity of requests and approval or denial of requests. Any approval of a request must have the support of at least three (3) members of the committee Sick Leave Bank Review Committee. The Sick Leave Bank Review Committee shall develop its rules of procedure and shall give wide distribution to said rules upon approval of the President of the Association and the Superintendent.

  • Termination of Contract for Cause 5.1.1 If A-E breaches any of the covenants or conditions of this CONTRACT, COUNTY shall have the right to terminate this CONTRACT upon ten (10) days written notice prior to the effective day of termination. 5.1.2 A-E shall have the opportunity to cure the alleged breach prior to termination. 5.1.3 In the event the alleged breach is not cured by A-E prior to termination, all work performed by A-E pursuant to this CONTRACT, which work has been reduced to plans or other documents, shall be made available to COUNTY.

  • Continuing Employment (a) Continuing employment means full-time or fractional-time employment that does not have a fixed end date or a contingency upon which the employment contract will come to an end. (b) All employment other than fixed-term employment and casual employment will be continuing employment.
