ELIGIBILITY FOR STATUTORY HOLIDAY PAY. (a) To be eligible for statutory holiday pay an employee must have been employed by the Employer for at least thirty (30) days. An employee who is absent on his/her scheduled work day immediately prior to and/or following the statutory holiday shall not be eligible for statutory holiday pay. (b) The eligibility requirements in paragraph (a) above will be waived by the Employer when the employee’s absence from an eligibility shift has been approved by the Employer, or when the employee fails to satisfy the eligibility requirements only because of a bona fide sickness or accident. The Employer is entitled to require a doctor’s certificate as proof of such sickness or accident, and any abuse of this provision by an employee may be cause for discipline.
