Common use of Employer Required Disability Leave Clause in Contracts

Employer Required Disability Leave. The Employer may require an employee to be examined by a licensed physician of the Employer’s choosing for the purpose of determining whether the employee is physically or mentally able to perform the substantial duties of the position. An employee found to be physically or mentally unable to perform the substantial duties by such physician shall be placed on Disability Leave as described in Paragraph B above.

Employer Required Disability Leave. The Employer may require an employee to be examined by a licensed physician of the Employer’s 's choosing for the purpose of determining whether the employee is physically or mentally able to perform the substantial duties of the his position. An employee found to be physically or mentally unable to perform the substantial duties of his position by such physician shall be placed on Disability Leave as described in Paragraph B aboveand be eligible for reinstatement for up to one (1) year from the date of separation.

An employee found to be physically or mentally unable to perform the substantial duties of his position by such physician shall be placed on Disability Leave as described in Paragraph B aboveand be eligible for reinstatement for up to two (2) years from the date of separation.

An employee found to be physically or mentally unable to perform the substantial duties essential functions by such physician shall be placed on Disability Leave as described in Paragraph B above.

The Employer may require an employee Employee to be examined by a licensed physician physician, selected by the Employee from a list of three (3) submitted by the Employer, at the Employer’s choosing for the purpose of determining whether the employee is expense. An Employee found to be unable to physically or mentally able to perform the substantial duties of the position. An employee found to be physically or mentally unable to perform the substantial duties by such physician his/her position shall be placed on Disability Leave as described in Paragraph B A above.
