EMPLOYMENT OF RETIRED TEACHERS. A. It is understood that if the Board desires to hire retired teachers, that such employees be employed under terms and conditions which differ in some respects from those established by the negotiated Agreement for teachers who have not attained retirement status with the State Teachers Retirement System. A retired teacher is a teacher who has attained service retirement status with the State Teachers Retirement System and is otherwise qualified by certification and background for public school teaching in Ohio. B. Where a teaching vacancy exists which the Board may fill by hiring a properly certified teacher who is not already employed by the Board, the board may consider and employ retirees for any such vacancy upon the recommendation of the superintendent. C. Any retire rehire teaching staff employed prior to July 1, 2017 will remain at Step 10 for the duration of their employment in the district. G. 50.07 A retiree shall not accumulate seniority in the bargaining unit unit, and has no right to of recall in the event of a reduction in force under Article VI 17 of the negotiated Negotiated Agreement, or under O.R.C. §3319.17. 50.08 The Board and the Association expressly intend that this Article supersede any differing or inconsistent terms of the Negotiated Agreement or provisions of the Ohio Revised Code which pertain to teacher employment, including but not limited to terms, provisions and statutes pertaining to teacher salary and salary schedule advancement, contract status, duration of contract, procedural requirements for contract non-renewal, evaluation requirements related to teacher contract non-renewal, reduction in force, seniority and severance pay, and regardless of whether such terms or provisions are specifically cited herein. 50.09 Any provisions of the Negotiated Agreement governing mentorship shall not apply to a retiree. This Article shall not apply to a retiree who is already employed by the Board under ORC 3319.17a teaching contract at the date on which this Agreement is effective. 50.10 The Board and retiree may agree to waive any of the restrictions or increase any of the benefits set forth in this Article on a case-by-case basis before the retiree is employed by the Board.

EMPLOYMENT OF RETIRED TEACHERS. A. It is understood that if the Board desires to hire 1. Teachers who have retired teachers, that such employees and who are or will be receiving benefits through STRS may be employed under by the Xxxxx Elm Local School District Board of Education. There shall be no expectation that any such teacher, whether formerly an employee of the Xxxxx Elm Local School District Board of Education or not, will be offered employment. The district reserves the right to offer or not to offer such employment selectively, based on the needs of the District, and no reason will be given for declining to offer such employment to anyone pursuant to this provision. 2. The salary to be paid to retired teachers reemployed after June 30, 2009, shall be based on the Bachelor’s salary schedule training column and shall be given zero (0) years of experience. Retired teachers will advance in typical fashion from step to step. To the extent that this provision shall be in conflict with Chapter 3317 of the Ohio Revised Code or any other section of the Ohio Revised Code, this sub paragraph shall supersede and replace those sections of law with which it is in conflict. 3. Teachers employed pursuant to this provision shall receive one (1) year limited contracts and shall not be eligible for continuing contracts, regardless of their years of service or license held. 4. Each one year contract shall automatically expire upon the completion of the year and it shall not be necessary for the District to take formal action to not reemploy the employee pursuant to 3319.11, Ohio Revised Code, in order to terminate the employment relationship. The employment relationship shall end upon the expiration of the contract in the same manner as a supplemental contract. 5. Returning retirees are not entitled to any severance benefits or retirement incentive benefits. 6. In the event of a reduction in force, a teacher employed pursuant to this provision will not be considered to have any seniority over any other teacher although a teacher employed pursuant to this provision will be a member of the bargaining unit. 7. Teachers employed pursuant to this provision, upon initial employment shall start with a zero sick leave accumulation balance but shall earn sick leave at the same rate as other members of the bargaining unit. 8. Specifically, the parties agree that: 1. The Board is under no obligation to employ any retired teacher and the parties hereto explicitly agree that there is no expectation of continued employment or re- employment when a teacher retires from those established by the negotiated Agreement for District.
