ENTITIES BOUND & ADMINISTRATION OF AGREEMENT. ‌ This Agreement shall be binding on all participating Unions and their affiliates, the Construction Manager (in its capacity as such) and all Contractors of all tiers performing Program Work, as defined in Article 3. The Contractors shall include in any subcontract that they let for performance during the term of this Agreement a requirement that their subcontractors, of all tiers, become signatory and bound by this Agreement with respect to that subcontracted work falling within the scope of Article 3 and all Contractors (including subcontractors) performing Program Work shall be required to sign a “Letter of Assent” in the form annexed hereto as Exhibit “A”. This Agreement shall be administered by the Agency or a Construction Manager or such other designee as may be named by the Agency or Construction Manager, on behalf of all Contractors.

ENTITIES BOUND & ADMINISTRATION OF AGREEMENT. This Agreement shall bind CA, Owner, the Council, all Signatory Unions and the Contractor(s) and all its subcontractors performing construction work at the Project, including site preparation work, which comprises Covered Work as defined in Article III. Further, the Contractors shall require, in all subcontracts pertaining to Covered Work, that the subcontractor of all tiers also become a signatory to, and be bound by, this Agreement by signing a "Letter of Assent" in the form annexed hereto as Exhibit "A". This Agreement shall be administered by CA, for the benefit of the Owner. This Agreement shall also be binding upon any contractor subsequently engaged by any surety pursuant to the terms of any applicable performance bond to complete any portion of the Covered Work as a result of the default, termination or other failure or inability of the original contractor to complete the Covered Work.
