Equipment Cost. Each Party will obtain and maintain, at its own expense, its own operating system necessary for timely, complete, accurate and secure data transmission pursuant to this Agreement. Except as described in Schedule A, each Party will pay its own costs related to data transmission under this Agreement, including, without limitation, charges for the Party’s own operating system equipment, software and services, maintaining an electronic mailbox, connection time, terminals, connections, telephones, modems and applicable minimum use charges. Each Party will be responsible for its own expenses incurred for translating, formatting and sending or receiving communications over the electronic network to any electronic mailbox of the other Party.

Equipment Cost. Costs for equipment, other than office furniture and related equipment, used in the provision of Services or otherwise provided will include all operating expenses, applicable overheads, maintenance, depreciation, return on investment and taxes, income taxes, sales or otherwise. Transportation and vehicle costs used in providing Services will be determined based on relative total hours or miles of use or on a vehicle loading applied to labor costs, as appropriate, and will include repairs, maintenance, fuel, depreciation, return on investment and, where appropriate, rental expense. In all cases, return on investment shall be calculated using a return on net assets at a rate equal to the prevailing pre-tax weighted cost of capital (economic cost of capital) authorized by the Commission(s) having jurisdiction over the retail rates of the Regulated Party that provided a Service for which a cost is being determined hereunder.

Equipment Cost. The “Equipment Cost” for any item of Equipment is the sum of (a) the equipment purchase price specified in the invoice now or hereafter issued by the Vendor in relation to the Equipment, plus (b) all insurance, installation, cabling, maintenance, software and related expenses to the extent paid or financed by Lessor in its discretion (collectively, “Soft Costs”) and as may be reflected in Annex A hereto. The aggregate Equipment Cost for all Equipment under this Schedule is $2,326,484.10.

Equipment Cost. The cost of all items of Equipment described on Exhibit A shall not exceed $ of which the Equipment Cost (herein so called) of $ is financed hereunder, and shall be disbursed in such amounts applicable to this Equipment Schedule as are reflected in Attachment A to the Lease, provided that the Equipment has been delivered to the location specified on Exhibit A hereto.
