EQUIPMENT FURNISHED BY OPERATOR a. Use of equipment owned by Operator at the lower of (1) rates commensurate with costs of ownership and operation. Such rates shall include costs of maintenance, repairs, other operating expense, insurance, taxes, and depreciation, or (2) commercial rates prevailing in the geographic area of the Company Facilities as published in Petroleum Motor Transport Association rate schedules.

EQUIPMENT FURNISHED BY OPERATOR a. Use of equipment owned by Operator at rates commensurate with costs of ownership and operation. Such rates shall include costs of maintenance, repairs, other operating expense, insurance, taxes, depreciation, and interest on unrecovered investment at the prime rate charged by the Citibank N.A. of New York, New York on ninety day loans to substantial and responsible commercial borrowers, or the maximum rate charged by law, whichever is less. In lieu of rates based on costs of ownership and operation of equipment, Operator may elect to use average commercial rates prevailing in the immediate area of Company facilities.
EQUIPMENT FURNISHED BY OPERATOR. A. Operator shall charge the Account for use of Operator-owned equipment, including, but not limited to, cars, trucks, cranes or "cherry pickers", laboratory instruments, machine, electrical and/or meter shop tools or instruments, and fire fighting equipment 47 and training facilities, as may be used for the benefit of the Facility from time to time, at rates commensurate with Operator's actual costs of ownership and operation, not to exceed the average commercial rates currently prevailing in the immediate area of the Facility. Such rates may include labor, maintenance, repairs, other operating expense, insurance, taxes, depreciation and interest on gross investment (less accumulated depreciation) not to exceed the prime rate charged by Wells Fargo Bank, San Francisco per annum and an elxxxxx of the estimated cost to dismantle and abandon the equipment.

Landlord will furnish the water for common areas and with electricity for lighting and the operation of the elevator. It will be the responsibility of Tenant to maintain the leased premises. Landlord will not be liable for damages, nor will Tenant's obligation to pay Rent be abated, for Landlord's failure to furnish or for delay in the furnishing any of the foregoing services, if the failure or delay is caused by accident or conditions beyond the reasonable control of Landlord. The temporary failure to furnish any of the services will not be construed as an eviction of Tenant and will not relieve Tenant from the duty of observing and performing any of the provisions of this Lease so long as Landlord proceeds with reasonable diligence to correct any the failure.
