Escalation to Senior Management. In the event the JCC cannot reach an agreement regarding a decision within the JCC’s responsibilities within fifteen (15) days after it has met and attempted to reach such consensus, then either Party may, by written Escalation Notice to the other Party, have such matter referred for resolution to the Senior Executives. The Senior Executives shall use good faith efforts to resolve any matter referred to them as soon as practicable.
Escalation to Senior Management. In the event the HireRight Vendor Manager and the TransWorks Program Manager are not able to resolve a Controversy pursuant to Article 23.01, each Party shall designate a senior management representative with authority to settle the Controversy. The disputing Party shall give the other Party written notice of the Controversy. Within ten (10) days after receipt of such notice, the receiving Party shall submit to the other a written response. The notice and response shall include (i) a statement of each Party's position and a summary of the evidence and arguments supporting its position, and (ii) the name and title of each Party's designated representative. The designated representatives shall meet (via telephone, video conferencing, or other mutually acceptable means) at a mutually acceptable time and place within fifteen (15) calendar days of the date of the disputing Party's notice and thereafter as often as they reasonably deem necessary to exchange relevant information and to attempt to resolve the Controversy.
Escalation to Senior Management. Each Party hereby agrees that it will first attempt in good faith to resolve any dispute arising out of or relating to this Agreement promptly by negotiations. If after discussing the matter in good faith and attempting to find a mutually satisfactory resolution to the issue, the Parties are unable to resolve such dispute, the matter will be referred to a representative from each Party with the authority to resolve the dispute for resolution. If, after such efforts, the Parties are unable to resolve such dispute within [***] of such matter being referred to such representatives, the Parties agree to at least one professionally mediated session at a location and with a mediator to be agreed upon by the Parties. If such dispute is unable to be resolved by good faith negotiation and mediation within [***] of such date that the dispute was referred to the representatives, the Parties agree to submit the dispute to binding arbitration pursuant to Section 12.2.

If after discussing the matter in good faith and attempting to find a mutually satisfactory resolution to the issue, the Parties are unable to resolve such dispute, the matter will be referred to a senior representative from each Party with the authority to resolve the dispute for resolution. If, after such efforts, the Parties are unable to resolve such dispute within thirty (30) days of such matter being referred to such representatives, the Parties will refer such dispute to resolution pursuant to Section 9.2 below.

Each Party hereby agrees that it will first attempt in good faith to resolve any dispute arising out of or relating to this Agreement promptly by negotiations by representatives from each Party with the authority to resolve the dispute. If the Parties are unable to resolve such dispute within sixty (60) days of such matter being raised by a Party to the other Party, the Parties agree to participate in at least one professionally mediated session at a location and with a mediator to be agreed upon by the Parties. If such dispute is unable to be resolved within sixty (60) days of being referred to mediation, either Party may submit the dispute to binding arbitration pursuant to Section 11.2.
Escalation to Senior Management. If the executives are unable to resolve the dispute, then the chief executive officers or equivalents of each entity will each meet in person to discuss and attempt to resolve the dispute.
