ESTIMATED COST OF PROJECT. A. The estimated cost of construction for the Improvement covered by this Agreement, exclusive of the cost of right-of-way or easement acquisition, is SEVEN HUNDRED THOUSAND and 00/100 DOLLARS ($700,000.00). B. The cost of making the Improvement shall include: (1) Labor and material used in making the Improvement; and (2) Such other expenses which are necessary in making the Improvement, exclusive of the cost of acquiring real property and any improvement thereon for the location of the Improvement. These expenses include but are not limited to design, project administration, construction inspection, material testing and utility relocations. C. The Parties anticipate receipt of CARS Funding of THREE HUNDRED FIFTY THOUSAND and 00/100 DOLLARS ($350,000.00) to help pay a portion of the cost of the Improvement. D. The remaining cost of making the said Improvement shall be distributed between the Parties as follows: (1) COUNTY shall pay 50% of the local share of said Improvement (estimated to be $175,000.00). (2) OVERLAND PARK shall pay 50% of the local share of said Improvement (estimated to be $175,000.00). (3) Each Party shall acquire and pay all costs associated with the right-of-way or easement acquisition for that portion of the project located within its respective boundary. The cost of making the said Improvement shall be distributed between the Parties as follows: (1) LEAWOOD shall pay 20% of the local share of said Improvement (estimated to be $107,342.00). (2) OVERLAND PARK shall pay 80% of the local share of said Improvement (estimated to be $429,368.00). (3) Each Party shall acquire and pay all costs associated with the right-of-way or easement acquisition for that portion of the project located within its respective boundary. Additionally, each Party shall pay the cost of financing and/or bonding its share of the project cost.

The Parties anticipate receipt of Surface Transportation Program (“STP”) funding of THREE MILLION FIVE HUNDRED THOUSAND DOLLARS ($3,500,000) to help pay a portion of the cost of the Improvement. The Parties also anticipate receipt of County Assisted Road Systems (“CARS”) funding of ONE MILLION FIVE HUNDRED THOUSAND DOLLARS ($1,500,000) to help pay a portion of the cost of the Improvement. D. The Cities will distribute the remaining costs of construction estimated at FIVE MILLION NINETY THOUSAND NINE HUNDRED DOLLARS ($5,090,900) plus the cost of design estimated at SEVEN HUNDRED FIFTY THOUSAND DOLLARS ($750,000), hereinafter the “Local Share.” (1) OVERLAND PARK shall pay 42% of the Local Share of said construction (estimated to be TWO MILLION FOUR HUNDRED FIFTY THREE THOUSAND ONE HUNDRED SEVENTY EIGHT DOLLARS ($2,453,178)). (2) OLATHE shall pay 58% of the Local Share (estimated to be THREE MILLION THREE HUNDRED EIGHTY SEVEN THOUSAND SEVEN HUNDRED TWENTY TWO DOLLARS ($3,387,722)). (3) Each City shall acquire and pay all costs associated with the right-of-way or easement acquisition for that portion of the project located within its respective boundary. Additionally, each City shall pay the cost of financing and/or bonding its share of the project cost.

The final actual cost of making the said Improvement shall be distributed between the Parties as follows: (1) OVERLAND PARK shall pay 50% of the local share of said Improvement (estimated to be SIXTY-SEVEN THOUSAND SIX HUNDRED TWENTY-SIX AND 00/100 DOLLARS ($67,626.00)). This amount includes all of the cost to replace bad curb and sidewalk, mill and overlay, and re-stripe Xxxxxxx Road between 75th Street and 79th Street. (2) SHAWNEE shall pay 50% of the local share of said Improvement (estimated to be SIXTY-SEVEN THOUSAND SIX HUNDRED TWENTY-SIX AND 00/100 DOLLARS ($67,626.00)). This amount includes all of the cost to replace bad curb and sidewalk, mill and overlay, and re-stripe Xxxxxxx Road between 75th Street and 79th Street. (3) Each Party shall acquire and pay all costs associated with the right-of-way or easement acquisition for that portion of the project located within its respective boundary. The Cities anticipate receipt of Federal Transportation Funding of Two Million, Eight Hundred Thousand and 00/100 Dollars ($2,800,000.00) to help pay a portion of the cost of the Improvement. D. The Cities anticipate receipt of County Assistance Road System funding of One Million, Five Hundred Thousand and 00/100 Dollars ($1,500,000.00) to help pay a portion of the cost of the Improvement. E. The remaining cost of making the said Improvement (the “Local Share”) shall be distributed between the Cities as follows: (1) MISSION shall pay 100% of the Local Share of said Improvement. (2) OVERLAND PARK shall pay 0% of the Local Share of said Improvement. (3) MISSION shall acquire and pay all costs associated with the right-of-way or easement acquisition for the project. Additionally, MISSION shall pay the cost of financing and/or bonding the project cost.

The local share of the cost of making the public improvement, as described hereinabove, shall be distributed within each CITY as follows: (1) The CITY OF MERRIAM, KANSAS shall pay 90.5% of the local share of said public improvement (estimated to be $659,300.00). (2) The CITY OF OVERLAND PARK, KANSAS shall pay 9.5% of the local share of said public improvement (estimated to be $69,200.00).
