EVALUATION PERIOD AFTER PROMOTION OR TRANSFER. A bargaining unit employee who is placed into another bargaining unit position through this post and bid process shall have his performance evaluated for up to thirty (30) days. If at any time within such 30-day period the Hospital determines that the employee is failing to perform satisfactorily, the Hospital may return the employee to his/her former position or some other mutually-agreeable position, provided such positions are available, without loss of seniority.

EVALUATION PERIOD AFTER PROMOTION OR TRANSFER. Employees who are promoted to a new position or who transfer to another position through the bidding process shall have orientation as necessary, and such Employees shall have up to ninety (90) calendar days of evaluation of their performance. If, at any time within the ninety (90) calendar days period, the Employee fails to perform satisfactorily in the Employer’s sole discretion, such Employee shall be returned to his/her former position, if available, including shift, assignment, and scheduled hours without loss of seniority. If his/her former position is not available, the employee will be placed into a comparable position defined as a position in the same classification, unit/department, and shift if such position is available. If such comparable position is not available, the employee shall be able to bid for subsequent job vacancies in accordance with Section D, above.

If at any time within the evaluation period the Hospital determines the employee has failed to perform satisfactorily, the Hospital may return the employee to his/her former position and rate of pay without loss of seniority. If the employee finds the position undesirable during the evaluation period, he/she may return to his/her former position, if vacant and rate of pay without loss of seniority. Nothing in this Section shall preclude the Hospital from disciplining or discharging a transferred or promoted employee during the evaluation period consistent with this Agreement’s Article 7, Discipline and Discharge.
