JOB POSTINGS AND TRANSFERS. 11.01 All permanent vacancies, openings and/or new positions within the bargaining unit shall be posted for a period of not less than seven (7) days. Interested employees shall respond by signing the posting.
11.02 In filling permanent vacancies, openings and/or new positions within the Bargaining Unit, the Employer shall consider the following factors in determining if an employee is to be awarded the posted job:
(a) The skill, ability and performance of the employee; and
(b) The specific needs of the programme, including the needs of the programme’s participants. If two (2) or more employees who have the required qualifications are relatively equal with respect to the factors in clause (a) and (b) without training, then date of hire will serve as the tie-breaker.
11.03 The successful applicant shall be placed on trial in the new position for a period of up to sixty (60) days worked. Such trial shall become permanent after the trial period unless:
(a) the employee feels that she is not suitable for the position, and wishes to return to her former position; or
(b) the Employer feels that the employee is not suitable for the position, and requires that she return to her former position. In the exercise of this power, the Employer's discretion shall not be exercised in a discriminatory, unfair or arbitrary manner.
11.04 If none of the bargaining unit members who have applied for the position are qualified, then it is management’s decision to determine as to how the position is filled.
11.05 The Employer is not obligated to accept the application of an employee who, within six (6) months of the posting, has been the successful candidate for another Bargaining Unit position.
11.06 Nothing in this Article limits the Employer’s right to assign or transfer employees to different job assignments within a classification. Such transfers will take into account seniority as well as participant and programme needs.
11.07 An employee who is temporarily assigned by the Employer to a position outside of his or her classification or to a different grade level within his or her classification for which the regular rate is less than the rate the employee is receiving, shall retain his or her regular rate for the balance of the assignment. If such assignment is to a job with a higher rate, the employee shall receive the higher rate of pay beginning with the start of the next shift for the balance of the assignment.

JOB POSTINGS AND TRANSFERS. In the event that this shift pattern is introduced into a department, all jobs created as a result of new technology, shall be posted. Any employee currently working in the department who does not post to, or is unsuccessful on a posting to this new shift pattern, shall have their rate of pay maintained while working and for as long as they do not post into another job at a higher rate, for the duration of the collective agreement, which expires on April 30, 2011. Such employee(s) shall also be afforded increases in accordance with the current collective agreement. Employees holding a posted position which will now work an alternative shift will have the choice of retaining their posted position and transferring to the alternate shift or electing to exercise their seniority. If Maintenance trades are required to work the alternate shift pattern, the jobs shall be posted. Maintenance employees working the alternative shift, supporting the Chocolate Department, will continue to be used throughout other areas of the plant, as required. In the event that employees are absent from work, due to vacation, they may be eligible to bid for postings that arise during their absence provided that they return and are available within two (2) weeks of the posting coming down. The onus is on the employee to contact Human Resources to determine what postings, if any, have been made.
JOB POSTINGS AND TRANSFERS. 1. Vacancies within the bargaining unit shall be filled by the promotion on the basis of the employees’ qualifications for the job, with seniority being the governing factor where qualifications are equal. To qualify for promotion, employees must possess suitable qualifications for the senior job. In doubtful cases, the Company is willing to discuss the matter with the Chairperson or Chief Xxxxxxx. All promotions shall be on probationary basis until the promoted employees has demonstrated his ability to perform the new job satisfactorily to a maximum of four (4) weeks or such longer time as maybe mutually agreed upon between the Company and the Union.
2. Except by agreement with the Chairperson or Chief Xxxxxxx, the Company will publish the vacancy of those jobs, the rate of which is equivalent to or greater than a Sorter Operator job by posting notice of it on all notice boards used for such purpose. Employees applying within two working days from the time of posting will receive consideration for the vacancy on the basis of their qualifications and seniority and subject to the conditions set out in the first two paragraphs of this section. Employees selected to fill such positions temporarily shall receive equal consideration with such applicants. Unsuccessful bidders will be advised of the Company’s decision and the reasons, within seven (7) calendar days of the decision.
3. The Company may temporarily assign employees at any time to fill vacancies arising from sickness, vacation, accident, approved leave of absence or where additional workers are required to handle work volume. A temporary vacancy will not exceed sixty (60) calendar days. If such an assignment is to a higher rate, the employee shall receive the higher rate if assigned for one (1) hour or more within a shift. 4. When an employee voluntarily requests a transfer to a lower rated job on account of his health or because he is unable to perform his job, he shall be paid the wage rate of the job to which he is transferred.
5. When an employee is transferred from work where the job rate is higher, his rate shall not be reduced for a period of twelve (12) weeks including lay-off after which the lower job rate shall apply.
JOB POSTINGS AND TRANSFERS. 20.01 (a) When the Employer requires an employee to substitute on a higher rate job covered by this agreement (not including RPN’s assigned to RN duties) for at least one-half of their regularly scheduled shift, they shall be paid, in addition to their regular salary, an amount equal to the difference between the job rate of their position and the job rate for the new position for the period worked.

14.01 (a) Promotions and successful postings to positions of a permanent nature will be based on the abilities and qualifications of an employee to satisfactorily perform the normal requirements of the position. As among employees whose abilities and qualifications are relatively equal, seniority shall govern. Notices of promotions and available positions shall be sent to all employees within the bargaining unit via the Board email posted on the Board’s Intranet and at all schools on the bulletin board for a period of five (5) working days. Employees wishing to apply for positions shall do so by submitting their application via email. The posting will list the position title, the location, the shift requirement and the starting date when possible. Employees will be allowed one successful job posting within the same job classification in the twelve (12) month period. The duration of the twelve (12) month period shall begin as of the date when the employee is advised of the appointment unless the start date is identified as a specific date in which case the twelve (12) month period will start as of the date identified on the posting. New employees who accept permanent positions shall remain in those positions for a twelve (12) month period from the date of starting in that position. NOTE: For Employees who have successfully posted or have been placed into a split positions the twelve (12) month shall not apply in the event of a posting for a full time positions at one location.

14.04 The Employer agrees to post courtesy job postings for newly-created permanent positions which are not covered by this Agreement prior to advertising outside the Employer. The Union agrees that the selection of the successful applicant shall be at the sole discretion of the Employer and is not subject to this Agreement or to arbitration.
