EXCAVATION, GRADING AND PREPARATION OF THE PROPERTY FOR DEVELOPMENT. The City hereby grants to Applicant the right, prior to obtaining City approval of a final plan, Final Plat, or final engineering drawings for a Development Phase, to undertake demolition of structures pursuant to City issued permits, excavation, preliminary grading work, filling and soil stockpiling (subject to applicable City ordinances) on each of the respective Development Phases in preparation for the development of a particular Development Phase, as the case may be, provided that the City Engineer has first reviewed and approved a grading plan and soil erosion and sedimentation control plan, which approval shall not be unreasonably withheld. Notwithstanding the above, no soil stockpiling shall be permitted within 500 feet of any existing residential property or structure., within 50‟ of a floodplain or wetlands, or anywhere on Zoning Parcel D. Unless another form of security is approved by the City Engineer, a letter of credit shall be required of Applicant as a condition precedent to the commencement of grading, soil erosion and sedimentation control in the amount of 110% of the estimated cost determined by Applicant‟s Engineer and approved by the City Engineer for such grading and erosion control work.

EXCAVATION, GRADING AND PREPARATION OF THE PROPERTY FOR DEVELOPMENT. Developer shall have the right, prior to obtaining approval of final engineering drawings and prior to approval of a Final P.U.D. Plat or Final Subdivision Plat, to undertake demolition of structures, excavation, preliminary grading work, filling, and soil stockpiling on Parcel A in preparation for the development of Parcel A upon submittal of a grading plan and a soil erosion and sedimentation control plan to the City, which plans shall be satisfactory to the City Engineer. Such work shall be undertaken at Developer=s sole risk and without injury to the Owner. No letter of credit, bond, or other security shall be required from Developer as a condition precedent to the commencement of such work.
