MODEL HOMES. (a) The Purchaser acknowledges that he has purchased the Dwelling on the basis of plans appended to this Agreement and not from a model, vignette or sales office samples. The Purchaser acknowledges that the model homes, if any, may have items installed for decor purposes, such as, but not limited to, upgraded flooring materials, ceramic tile, hardwood, carpet, paint, kitchen cabinets, countertops, lighting and fixtures, driveways, walkways, railings and pickets, skylights, entry doors, interior doors, paneling, wallpaper, window treatment, drapes, curtains, plumbing supplies, intercom systems, alarm systems, appliances, landscaping, underground sprinkler systems, underground lighting, decks and finished basements. The Purchaser acknowledges and agrees that these decor items will not be included in the Purchase Price and that the contract will consist of only those items listed on Schedule "A".
(b) Notwithstanding anything herein written, if at the time that this Agreement is executed, the dwelling constructed on the Real Property has already been substantially completed, the Purchaser shall purchase the Real Property in an "as built" condition rather than in accordance with any other representations herein contained.
(c) Furthermore, in the event that the Dwelling has been used as a model or show home, the Purchaser acknowledges that the subject premises has been used extensively as a "Model" of "Show" home, and as such, has been subjected to the normal wear and tear associated with that purpose. Unless otherwise specifically agreed in writing, no refinishing shall be done by the Vendor on the subject premises and the Purchaser agrees to accept the dwelling on closing on an "as-is" basis. For the purposes of clarity only, and without restricting the generality of the foregoing, the Purchaser hereby waives any claim in respect of scratched floors, counters or plumbing fixtures; or, sun-faded paint and stain colours.
MODEL HOMES. Model homes may be constructed within the Project as part of and during the installation of the subdivision infrastructure. A total of five (5) model homes are permitted as part of the development.
MODEL HOMES. The City agrees to allow the Owner and/or any Secondary Developer the ability to permit and construct model homes without utilities (i.e., dry models) and to relocate the models as necessary within each subdivision; and the ability to permit and construct temporary sales and construction offices with temporary utilities, in accordance with applicable Zoning Regulations.

MODEL HOMES. The Subject Property may include up to five (5) model homes, which must adhere to any and all applicable standards herein, the Land Use Plan, and substantially similar to the elevations which accompany the PD development standards and the approved Land Use Plan.
MODEL HOMES. The Town agrees to allow the construction of not more than 3 model homes in Phase I of development and not more than 10% per Phase of development thereafter, in accordance with the requirements pertaining to model home construction contained in the Development Manual.
MODEL HOMES. Subject to the provisions of Chapters 4.4 (“Sign Regulations”) and 4.5 (“Supplemental Use Regulations”) of the Zoning Code, Applicant shall also have the right, after the Corporate Authorities‟ approval of a Final Plat for a residential Zoning Parcel, and subject to issuance of building permits in accordance with the requirements of Article XIII, to construct model homes and, at Applicant‟s discretion, to utilize the model homes as sales offices in locations as from time to time determined by Applicant. All dwelling units, including model homes, are hereby “grandfathered” from required compliance with building code amendments which are duly adopted by the City following issuance of a building permit.

The Purchaser acknowledges that the model homes, if any, may have items installed for decor purposes, such as, but not limited to, up-graded flooring materials, ceramic tile, hardwood, carpet, paint, kitchen cabinets, lighting and fixtures, driveways, walkways, railings and pickets, skylights, entry doors, interior doors, paneling, wallpaper, window treatment, drapes, curtains, plumbing supplies, intercom systems, alarm systems, landscaping, underground sprinkler systems, underground lighting, decks and finished basements. The Purchaser acknowledges and agrees that these decor items will not be included in the Purchase Price and that the contract will consist of only those items listed on Schedule "A".
MODEL HOMES. The Chief Building Official may issue model home building permits provided that the Owner has entered into a model home development agreement with the Township.
MODEL HOMES. No person may occupy a building or structure for which a building permit is issued on either a temporary or permanent basis until an occupancy permit is issued. Notwithstanding the foregoing, Developer may construct no more than two (2) model homes on the Phase I Property, but only under the following conditions:
a. Developer shall have completed and obtained the City Engineer’s acceptance of the Mass Grading of the entire Development Property;
b. Developer shall have completed and obtained the City Engineer’s acceptance of finish grading on the model home lots and detailed site plans for each such model home lot. This site plan shall at least include detailed information regarding house elevation, site grading, and compatibility with all requirements of this Development Agreement, including appropriate setbacks;
c. There exists safe and adequate access to and from the model home lots, including, but not limited to, sufficient access for emergency response vehicles; and
d. No occupancy permit shall be issued for a model home until Developer pays all fees and completes all other Development Work as required by this Agreement.
