EXISTING PROGRAMS. (a) The Band agrees with Canada that the execution of this Agreement shall not entitle the Band to any funding per capita in addition to the existing program funding from the Department for the development of infrastructure or capital expenditure for any improvement to Reserve and/or Entitlement Reserve Lands, provided that the Band shall be entitled to apply on a per capita basis for existing or any future program funds.
(b) The Band agrees with Canada that any application for additional program funding for the development of infrastructure or capital expenditure shall be made separate and apart from any submission for Entitlement Reserve creation.
(c) The parties agree that nothing in this Agreement is intended, nor shall it be construed in any way, to represent the payment or allocation to the Band by Canada or Saskatchewan of any existing or future program funding otherwise available to the Band.
EXISTING PROGRAMS. EXISTING PROGRAMS. Any existing [***] compounds (excluding any [***]) [***], whether [***] or including or using [***], shall [***]; and any such [***] shall be [***]. For clarity, Roche shall retain rights to such compounds and products whether or not it chooses to develop such products and shall retain rights to such compounds and products upon termination or expiration of this Agreement.
EXISTING PROGRAMS. The Greensky MasterCard Program—Greensky offers retailers and distributors a line of credit to purchase inventory at market using the Greensky MasterCard Program. The Xxxxxxxx Xxxxx Program The Home Depot Program—Greensky offers customers of The Home Depot a co-branded MasterCard card program to allow such customers to use their loan proceeds from Greensky to purchase materials and services at Home Depot using the co-branded MasterCard card The Greensky Home Improvement Program—Greensky offers customers a co-branded MasterCard card program to allow such customers to use their loan proceeds from Greensky to purchase home improvement materials from various retailers using the co-branded MasterCard card. THIS AMENDMENT TO AMENDED AND RESTATED CO-BRANDED MASTERCARD CARD PROGRAM AGREEMENT (this “Amendment”), effective as of December 30, 2013, is made by and between Greensky Trade Credit, LLC, a Georgia limited liability company (“Greensky”), and Comdata Inc., a Delaware corporation and successor in interest to Comdata Network, Inc., a Maryland corporation (“Comdata”).
EXISTING PROGRAMS. In conducting all of its activities described in sections 7.1 (“Research Program”), the Oversight Body shall make best use of existing research institutions and programs.
EXISTING PROGRAMS. In the case of an Existing Program that falls within the scope of clause 6 of the Framework Agreement, the Parties agree that the program shall not be eligible for Contributions under this Implementation Agreement after March 31, 2006, unless it is compliant with clause 5.2 of the Framework Agreement at that time.
EXISTING PROGRAMS. Voyager shall conduct each Existing Program pursuant to the applicable Existing Program Development Plan. The JSC shall, prior to the end of each Calendar Year prior to the applicable Transition Date, review the Existing Program Development Plans and determine whether to update such plans, including to prepare a detailed budget for the subsequent Calendar Year. A Party may also develop and submit to the JSC from time to time proposed substantive amendments to the AADC Program Development Plan or the FA Program Development Plan. The JSC shall review such proposed amendments and may approve such proposed amendments or any other proposed amendments that the JSC may consider from time to time in its discretion and, upon any such approval by the JSC, the AADC Program Development Plan or FA Program Development Plan, as applicable, shall be amended accordingly.
EXISTING PROGRAMS. Certain existing programs, i.e., the DSS (Storage Switch) program and other software created by and/or through SPSoft consulting services of Pune, India, or otherwise created by or for Debtor, including Mythos, together with other associated intellectual property and the source code, including instructions and/or statements written in eye-readable form in programmer’s language and capable of being compiled into object code and an object code, being a computer code that a computer can understand (all of the above being referred to herein as the “Existing Software”); and
EXISTING PROGRAMS. Except to the extent the Plea Agreement or Consent Decree requires otherwise, Respondents shall continue to implement all programs and systems described in Respondents' December 31,2012 and January 14,2013 submissions to the EPA, attached hereto as Attachments 4 and 5 and incorporated by reference. Specifically, Respondents shall:
a. Continue with the scheduled revision of the Transocean EMS in April2013.
b. Maintain the 24-hour hotline through the The Network, Inc or another third-party compliance hotline provider with similar capabilities.
c. Maintain in operation the Transocean Code oflntegrity.
d. Continue the "Share Concerns ... Promote Integrity" campaign promoting the aforementioned hotline and Code of Integrity.
EXISTING PROGRAMS. Genentech understands and acknowledges that as of the Effective Date, Xxxxxx has conducted internal research and discovery efforts with respect to transcription factors that are other than the initial Designated TFs, and in the mapping of such transcription factors has identified molecules (some of which are other transcription factors) as Critical Node Components of the TRNs for such other transcription factors, all as and to the extent set forth in Exhibit 5.2.6 (each such molecule, an “Unrestricted Critical Node Component”). Accordingly, notwithstanding the foregoing provisions of Section 5.2 (Exclusivity), Kronos, itself or with or through an Affiliate or Third Party, shall have the right to conduct (a) research and discovery activities with respect to any such Unrestricted Critical Node, even if it is also identified as a Critical Node Component or Downstream Target of a Designated TRN, including (i) the mapping of the TRN for any Unrestricted Critical Node that is a transcription factor and (ii) the screening of any such Unrestricted Critical Node, and (b) activities otherwise designed to identify or optimize, develop or commercialize molecules that bind or modulate such Unrestricted Critical Node, provided that such molecule is not also intended to modulate any Designated TF (including by disrupting or facilitating a protein-protein interaction between the Designated TF and such Unrestricted Critical Node), or its associated Designated TRN Components, during the period in which any exclusivity with respect to such Designated TRN Component exists pursuant to Section 5.2.1 or 5.2.2. For clarity, should an Unrestricted Critical Node be identified as the Target of a Discovery Hit, the Target exclusivity set forth in Section 5.2.4 (Hit Program – Target) would not apply to such Unrestricted Critical Node.
