Expedited Grievance Procedure. 1. The Association may process a grievance via the expedited grievance procedure outlined as follows if mutually agreeable to both parties. a. The grievance shall be submitted in writing to the Superintendent or his/her designee. Within ten (10) days after submission, the b. If the Association is not satisfied with the Superintendent's ruling regarding the grievance, the Association may file with the Chairman of the Board within seven (7) days following receipt of the Superintendent's ruling a request for a hearing before the Board. The Board shall set a hearing within fifteen (15) days following receipt of the request of hearing. The Board shall provide the Association with a written ruling on the grievance within five (5) days following the hearing. Should the Association not be satisfied with the Board's ruling, the Association may submit the grievance to arbitration before an impartial American Arbitration Association (AAA) arbitrator according to its rules for final resolution of the grievance. c. Both parties agree to be bound by the decision of the arbitrator. 2. The fees and expenses of the arbitrator shall be shared equally by the parties.
