External Process. Level 2 (a) If either party (being HPS or employee(s)), having formally sought resolution through an external conference, is not satisfied that the matter is being dealt with as expeditiously as possible, or is not satisfied with the outcome, then, either party may refer this matter to FWC (or it’s replacement) for conciliation or arbitration. (b) Provided that all the above Steps have been exhausted, the Parties may refer the matter to FWC to: • Resolve the dispute as FWC considers appropriate (including by mediation, conciliation, expressing an opinion or making a recommendation); and • If FWC is unable to resolve the dispute at the first stage, FWC may then: • Arbitrate the dispute; and • Make a determination that is binding on the Parties, subject to any appeal. (c) During any proceedings before FWC under this Clause (including conciliation), either Party may choose to be represented by a legal practitioner. (d) Where FWC issues a decision in writing under this Clause, it shall be binding on the Parties and persons bound by this Agreement in accordance with its terms. While the Parties are trying to resolve the dispute using the procedures in this term: (a) An employee must continue to perform his or her work as directed by their Supervisor, subject to the relevant provisions of the Work Health and Safety Act 2010; and (b) An employee must comply with a direction given by the employer to perform other available work at the same workplace, unless: (i) The work is not safe; (ii) Applicable occupational health and safety legislation would not permit the work to be performed; (iii) The work is not appropriate for the employee to perform; or (iv) There are other reasonable grounds for the employee to refuse to comply with the direction.

  • Informal Process The Informal Process provides an Employee with the opportunity to resolve his or her concern by using the open door process, with the assistance of a FC member, within 30 calendar days of the date the Employee became aware of the issue. While an Employee may speak with anyone in the open door process regarding a concern or problem, the Employee is encouraged to take this concern up with his immediate supervisor or may request the assistance of the Employee Advocate or a FC member to facilitate resolution of the issue.

  • Processes Any employer, employee, trade union or employer’s association may at any point in time apply for an exemption from any of the provisions of this Collective Agreement. The applicant is required to complete and submit in writing with the relevant office of the Council, a fully and properly completed prescribed application for exemption form, accompanied by all relevant supporting documentation.

  • Approval Process Tenant shall notify Landlord whether it approves of the submitted working drawings within three business days after Landlord’s submission thereof. If Tenant disapproves of such working drawings, then Tenant shall notify Landlord thereof specifying in reasonable detail the reasons for such disapproval, in which case Landlord shall, within five business days after such notice, revise such working drawings in accordance with Tenant’s objections and submit the revised working drawings to Tenant for its review and approval. Tenant shall notify Landlord in writing whether it approves of the resubmitted working drawings within one business day after its receipt thereof. This process shall be repeated until the working drawings have been finally approved by Landlord and Tenant. If Tenant fails to notify Landlord that it disapproves of the initial working drawings within three business days (or, in the case of resubmitted working drawings, within one business day) after the submission thereof, then Tenant shall be deemed to have approved the working drawings in question. Any delay caused by Tenant’s unreasonable withholding of its consent or delay in giving its written approval as to such working drawings shall constitute a Tenant Delay Day (defined below). If the working drawings are not fully approved (or deemed approved) by both Landlord and Tenant by the 15th business day after the delivery of the initial draft thereof to Tenant, then each day after such time period that such working drawings are not fully approved (or deemed approved) by both Landlord and Tenant shall constitute a Tenant Delay Day.
