Common use of Fair Practice Clause in Contracts

Fair Practice. A. The terms and conditions of this contract shall remain in effect for the duration of this contract, and can be amended only by mutual written consent of both parties. B. The provisions of this contract shall supersede any and all rules, regulations, or practices of the Board that are contrary to or inconsistent with the terms recorded herein. Any individual contract between the Board and a teacher shall be consistent with the terms and conditions of this contract. If any individual contract made subsequent to this agreement contains any language inconsistent with this agreement, the language of this agreement shall prevail. C. The provisions of this contract shall be applied equally to all teachers employed by the Board without discrimination as to age, gender, marital status, race, color, creed, religion, national origin, political affiliation or union membership and its associated activities. D. The provisions of this agreement shall be applied in a manner which is not arbitrary, capricious, or unlawfully discriminatory.
