FEDERAL SUBCONTRACTING REQUIREMENTS. If Service Provider awards a subcontract under this contract, Service Provider, if applicable, shall use the following alternative steps: A. Using the services of the Small Business Administration and the Minority Business Development Agency of the United States Department of Commerce, as appropriate; and B. Requiring the subcontractor, if it awards subcontracts, to take the affirmative steps set forth in paragraph A. If applicable, Service Provider agrees to complete and submit to the City a Minority Business Enterprise/Woman Business Enterprise (MBE/WBE) Utilization Report (Standard Form 334) within 30 days after the end of each fiscal quarter until the end of the contract.

FEDERAL SUBCONTRACTING REQUIREMENTS a. The provisions of the following laws, Executive Orders, and any rules and regulations issued thereunder, are incorporated herein be reference as part of this Agreement. b. Executive Order 11625, as amended, relating to utilization of minority business enterprises in the performance of government contracts and subcontracts; c. Executive Order 12138, as amended, relating to utilization of women-owned businesses in the performance of government contracts and subcontracts; and d. Section 211 of Public Law 95-507, as amended, relating to utilization of small business concerns and small disadvantaged business concerns in the performance of government contracts and subcontracts.
FEDERAL SUBCONTRACTING REQUIREMENTS. (a) The provisions of the following laws, Executive Orders, and any rules and regulations issued thereunder, are incorporated herein by reference as part of this Agreement; (b) Executive Order 1162, as amended, relating to utilization of minority business enterprises in the performance of government contracts and subcontracts; (c) Executive Order 12138, as amended, relating to utilization of women-owned businesses in the performance of government contracts and subcontracts; and (d) Section 211 of Public Law 9-07, as amended, relating to utilization of small business concerns and small disadvantaged business concerns in the performance of government contracts and subcontracts. (e) The parties agree to fully comply with such provisions and any amendments thereof. In addition, all subcontracts and agreements the parties enter into to accomplish the work under the terms of this Agreement shall obligate such subcontractors to comply with such provisions.
FEDERAL SUBCONTRACTING REQUIREMENTS. (i) The provisions of the following Laws, Executive Orders, and any rules and regulations issued thereunder, are incorporated herein by reference as part of this Agreement: • Provisions of the Utilization of Small Business Concerns clause set forth at Section 52.219-8 of the Federal Acquisition Regulations, Title 48 of the Code of Federal Regulations, and • Provisions of the Small Business Subcontracting Plan clause set forth at Section 52.219-9 of the Federal Acquisition Regulations, Title 48 of the Code of Federal Regulations. (ii) Contractor agrees to use commercially reasonable efforts to comply with such provisions and any amendments thereof. In addition, all eligible Subcontracts that Contractor enters into to accomplish the Work under the terms of this Agreement shall obligate such Subcontractors to use commercially reasonable efforts to comply with such provisions. (iii) Compliance with the above provisions involve the development of a subcontracting plan, as prescribed in 19.704 of the Federal Acquisition Regulations, herein incorporated by reference. Westinghouse shall not be required to prepare a project specific Subcontracting Plan (as defined in FAR 52.219-9) for this Agreement. Westinghouse shall use its company-wide Subcontracting Plan, as approved by the appropriate US Government Authority. Stone & Xxxxxxx shall prepare a project specific Supplier Diversity Subcontracting Plan incorporating SBA small business size standards requirements. Stone & Xxxxxxx’x Subcontracting Plan shall be limited to a statement of the total dollars available for subcontracting under the plan, a description of the principal types of supplies and services to be subcontracted for under the plan and an outline of the efforts to be taken to award work to small business concerns, veteran-owned small business concerns, service-disabled veteran-owned small business concerns, HUBZone small business concerns, small disadvantaged business concerns, or women-owned small business concerns. Contractor shall, upon a prior written request by Owner, provide a written report to Owner that sets forth the total dollar amount paid to any Subcontractor in the categories listed above. Stone & Xxxxxxx will report such information to Owner, substantially in the format and on the frequency required by Owner as defined in Exhibit DD or a copy of the annual report which details such information that Xxxx submits to the U.S. Government.
