Protection of the fiber optic cable systems is of extreme importance since any break could disrupt service to users resulting in business interruption and loss of revenue and profits. Political Body shall telephone the Railroad during normal business hours (7:00 a.m. to 9:00 p.m. Central Time, Monday through Friday, except holidays) at 0-000-000-0000 (also a 24-hour, 7-day number for emergency calls) to determine if fiber optic cable is buried anywhere on the Railroad's premises to be used by the Political Body. If it is, Political Body will telephone the telecommunications company(ies) involved, arrange for a cable locator, and make arrangements for relocation or other protection of the fiber optic cable prior to beginning any work on the Railroad's premises.

By entering into this Master License, Licensee grants to the City a license to use four strands of any fiber-optic cable that Licensee owns at each licensed SFPUC Pole. Licensee will designate and xxxx four strands of fiber in any conduit feeding the License Area for municipal use, effective upon installation of fiber-optic cable on each License Area. Licensee agrees that upon the expiration or termination of this Master License, Licensee will grant to the City by quitclaim or xxxx of sale title to any fiber strands owned by Licensee that the City uses or desires to use at no expense to Licensee..
Fiber Optic Cables. (1) Fiber optic cables shall be buried a minimum of 42" below the ground line. The District Administrator/Engineer or his/her designee may approve a lesser depth caused by placement problems such as solid rock or other barriers.
(2) The cable shall have a metallic location tape placed above the cable.
(3) Above ground markings shall be located at 500' intervals.

In the event that Licensee’s Equipment on the License Area includes any fiber-optic cables, Licensee shall, as partial consideration paid to the City for this Master License, grant the City a license to use twelve (12) strands in any fiber-optic cable that Licensee owns at each licensed Pole. Such license shall be automatically effective upon Licensee’s installation of any fiber-optic cables on the License Area, and Licensee shall designate and mark the twelve (12) fiber strands in any conduit that serves the License Area for the City’s use at the time it installs such fiber-optic cables. Licensee further agrees that, at the time this Master Agreement expires or terminates, Licensee shall transfer to the City title and ownership of any fiber strands that the City uses or desires to use by quitclaim or bill for sale at no cost to City.
Fiber Optic Cables. The City understands that Licensee’s Equipment on the License Area may include fiber-optic cables and associated conduits. By entering into this Master License, Xxxxxxxx agrees that if it proposes the installation of conduits in a License Area, then Licensee shall have an obligation to engage in good faith negotiations that would result in the installation of conduit for the exclusive use of the City for municipal use. Nothing in this agreement would require Licensee or the City to reach agreement on the terms of such installation.
