The position may be filled through a prior posting or existing competition within the three (3) month period. (h) The Employer may offer permanent part-time work of less than a 0.4 FTE to qualified Nurses on the unit, provided the new position is of the same classification as the Nurse’s current position, without posting in order of seniority first to permanent part-time Nurses then casual Nurses.

Filling Vacancies. a. All permanent positions to be filled in the Bargaining Unit shall be advertised internally, in accordance with the Merit Promotion Plan (FSH 6109.12, Chapter 20), prior to filling from any other appropriate source except for— (1) Lateral reassignments. (2) Career-ladder promotions. (3) Voluntary demotions, per Articles 32 and 42. (4) Demotions for disciplinary, performance reasons, or reductions in force. (5) Conversions of Student Career Employment Program appointments. The listing may be done concurrently with outreach for the job opening, including while the job is still occupied. If the determination of their qualification subsequently changes, the employee will be notified in writing of the change within 3 days. Notification will include who the employee should respond to if requesting a review. Within 3 days of receipt, employee may offer permanent partrequest a review. Upon such request, Manage- ment will perform an independent review of the qualification determination and provide a written explanation within 14 days. f. For positions that are not entry-time work level or filled through the Merit Promotion Plan, Management will provide the Union representative at the appropriate level, upon request, notification of less than a 0.4 FTE to qualified Nurses on the unitselectee, provided position, grade, location, and under what authority the new position is filled. g. The Union may review all documents pertaining to the filling of a vacancy and for a position that had advertisement completed and then was withdrawn and, upon request, receive copies of documents in accordance with the same classification Privacy Act. h. Preference shall be given to the applicant having the most seniority in the same classification where the vacancy occurs, a less senior or outside applicant may be awarded the position if the applicant is more qualified in the necessary skills. When no bargaining unit member applies for a vacancy, and the administration chooses not to expand the number of bargaining unit employees, the administration shall make a reasonable effort to fill the vacancy with the least senior qualified member in the affected classification. The parties agree that laid off bargaining unit members shall be called back under the provisions of Article VII, Section C to temporarily fill a vacancy until the vacancy has been filled under the provisions of this Article. All bargaining unit member applicants for a vacancy shall be notified in writing of the outcome of the selection process within five (5) days of the filling of the position. The person selected for the position will be granted up to twenty (20) work days for a trial period in the new position. During the trial period he/classification titleshe shall be paid at the rate for the job to which he/she is assigned. If an employee fails to perform satisfactorily in the position for which he/she has bid or decides he/she does not wish to continue, he/she shall be returned to his/her former position, within the same twenty (20) day period. During the period from the time the vacancy develops until the time the vacancy is filled, the Hospital may transfer, assign, or use temporary employees as necessary to cover the Nurse’s current open position. In selecting staff for temporary positions, without posting in order the Hospital shall transfer, assign, or use qualified Registered Nurses with the least seniority. The Hospitals will not use Traveler or Agency nurses who are employees of seniority first to permanent part-time Nurses then casual NursesHCA or any of its subsidiaries for more than ninety (90) days.

Filling Vacancies. The Employer supports the practice of promoting from within when practical. It also believes that employees have the primary responsibility for their own career development. To qualify for a promotion, transfer or reclassification an employee must have completed six (a6) Subject months of continuous service in their current job classification and be satisfactory in job performance, job evaluations and a disciplinary actions that are no longer in force and effect. To assist in this process whenever the Employer determines that a job vacancy exists, a notice of such vacancy shall be posted in an appropriate location for a period of six (6) work days. This does not eliminate the Employer from advertising externally during these six (6) days. During such posting period, any employee wishing to apply for the vacant position shall do so by submitting a written application to the displacementEmployer. The Employer shall not be obligated to consider any applications submitted after the posting period or which do not meet the minimum qualifications for the job. The Employer shall reserve the right to hire the most qualified candidate for any vacant position. Filling Vacancies. Filling Vacancies. A. All vacancies shall be filled or the position shall be eliminated. A temporary vacancy shall be filled no more than twenty (a20) Subject calendar days after it becomes vacant unless an extension is granted by PSA. Such a request for extension shall not be unreasonably denied. A permanent vacancy shall be filled on a permanent basis within a reasonable period of time after it becomes vacant. However, this provision shall not preclude the possibility of filling a permanent vacancy with a temporary Employee for a reasonable period of time. Saturdays, Sundays and paid holidays shall not be counted as days. During a reduction in force (RIF), all permanent vacancies shall be posted immediately but not filled until the thirty-first (31st) day. These awarded vacancies shall not commence until the first day after the completion of the RIF. B. Temporary and permanent vacancies shall be filled through transfer in the following order: 1. Bargaining unit members that are permanent employees on layoff or notified of layoff, shall be recalled to fill vacancies as provided in Section 9.7. 2. Bargaining unit members on leaves of absence, as provided in Section 13.3 and who apply, shall be appointed to fill vacancies. If more than one bargaining unit member on leave applies for a single vacancy and their qualifications are substantially equal, the most senior shall receive the position. This paragraph (8.4 B.2) does not apply to: a. bargaining unit members with the right to return to the displacementposition held immediately prior to their leave of absence, lay off and b. to the situation of a bargaining unit member applying for a vacancy in order to return from his/her leave prior to the established termination date of his/her leave. 3. When the percentage of minority or female Employees in Headquarters or a UniServ Zone is less than the percentage of minorities or females in the relevant national labor force (by ethnic group or sex), and recall provisions if a bargaining unit member(s) who is in the underutilized group makes application, and if said transfer is from Headquarters or UniServ Zone where the percentage of this Agreementunderutilization is less than the percentage of underutilization in Headquarters or UniServ Zone where the vacancy exists, in determining the successful candidate when filling most senior qualified bargaining unit member from the most underutilized group shall receive the position. In the case of a Permanent UniServ Director position, Permanent Seniority the most senior of those persons shall be given special consideration, and the determining factor where position shall be awarded if approved by the coordinating council. Relative underutilization shall be based upon a percentage of the goal achieved. 4. If one or more bargaining unit member(s) applies for a vacancy in a position other than UniServ Director and one bargaining unit member is most qualified of all applicants or has qualifications substantially equal to all outside applicants, he/she shall receive the position. If more than one bargaining unit member applies for a position other than UniServ Director and two or more candidates are relatively have qualifications substantially equal in skillsto all outside applicants, ability and qualifications to perform the required duties of most senior bargaining unit member shall receive the position. (f) Positions will be awarded to the successful candidate as soon as is reasonably possible following the closing date for the job posting. (g) In the event that a vacancy arises in the same position/classification title, within the same work area(s) and/or service within case of a three (3) month period of the closing date of the competition, the Employer is not required to post the vacancy. The position may be filled through a prior posting or existing competition within the three (3) month period. (h) The Employer may offer permanent part-time work of less than a 0.4 FTE to qualified Nurses on the unit, provided the new position is of the same classification as the Nurse’s current UniServ Director position, without posting shall be given special consideration in order of most seniority first to permanent part-time Nurses then casual Nursesand shall receive the position upon approval by the coordinating council. Seniority for each person for determining the order above shall be the seniority he/she holds in the respective bargaining unit above. A person who fills a vacancy by this provision shall be treated as any other new hire into the bargaining unit.
