Filling Vacancies. When a vacancy is created in the bargaining unit, the Employer agrees to provide notice by e-mail to all bargaining unit employees at least fourteen (14) calendar days prior to filling the vacancy. Filling Vacancies. When a vacancy is created A. Annual Initial Bid Meeting: Prior to the beginning of each school year all run/routes shall be open for bidding. Prior to the conclusion of each school year each Employee shall be notified of the August bid meeting date. On the day prior to the scheduled bid meeting date, all runs/routes shall be available for viewing at the transportation office by the Employees. On the bid meeting day, each Employee shall select, in the bargaining unitorder of seniority, with the Employer agrees greatest seniority having the first opportunity to provide notice by e-mail to all bargaining unit employees at least fourteen bid their assignment for the ensuing year. Employees shall not select runs that are scheduled on a daily basis, which exceed eight (14) calendar days prior to filling 8) hours per day without the vacancy. Such notice will include permission of the following as applicable: a) classification, b) division, and c) locationSupervisor. The Department least senior driver(s) shall not bid on only a secondary run or an elementary run if it causes the District to hire another driver. Employees shall be limited to thirty (30) minutes for their selection of the vacancy. In making a selection, the Employer will take into consideration ability, job requirements, operational efficiency and senioritytheir run/route. If the Employee does not make his/her selection within the allotted time allowed, then the Supervisor will assign their run/route for the year. Those present at the bid meeting shall be paid Seven Dollars and 65/100 ($7.65) for their participation in the bid process. This pay for participation in the bid meeting shall be increased by the same percent as Wage Schedule A.
B. Filling vacancies during the school year.
1. Employees who are granted a short term leave of absence of up to thirty (30) work days shall have their runs/routes filled by the most senior employee’s transfer request is denieddriver available without a run/route in that time slot. If an unusual circumstance occurs, the reason(s) for such denial timeline may be extended. The parties must mutually agree to extend the timeline. This will not require the run/route to be bid. If the timeline is not extended by mutual Agreement, the run/route will be provided in writing bid after the 30th work day of the leave of absence.
2. If an Employee has a previously scheduled appointment, this shall not interrupt his/her right to continue on the same run/route. Once awarded a temporary run/route, that driver will not be eligible to fill another until he/she has completed that temporary run/route. After completing the first temporary run/route, the driver may bump a lower seniority driver from another temporary run/route if that temporary assignment will have at least ten (10) work days remaining.
3. When a regularly scheduled run/route becomes vacant, a newly established run/route is created during the school year, or a driver is granted a long term leave of absence of over thirty (30) work days, a bid meeting will be held to fill the vacancies, subject to the affected employee(s) upon request. Any employee conditions below.
a. Employees will be given at least five work days notice of a bid meeting to fill the vacancy and any subsequent vacancies which may arise at the bid meeting.
b. The Association Representative or designee may bid for a driver who is selected for transfer unable to attend due to illness, emergency, or other extenuating circumstances. The absent Employee shall have provide a written proxy form to the Director of Transportation and Association Representative listing the Employee’s three choices. If none of his/her three choices are available, the Employee will stay at his/her current position.
c. Attendance at the bid meeting is voluntary and as such, no compensation will be issued.
d. Drivers will not be able to bid on a temporary vacancy unless the reassignment would constitute a change in time of at least ten (10) minutes per day, unless approved by the Transportation Director.
e. Runs/routes will be awarded to the most senior regular driver that bids on the run/route.
f. All changes in runs/routes will be implemented as soon as possible, but no later than three (3) work days in which to decline after the offerbid meeting.
B. In the event g. Drivers awarded a temporary run/route will not be eligible to fill another until they have completed that the vacancy is not filled by transfer of an employee in the same classification as the vacancyrun/route. Filling Vacancies. When 1. An employee seeking a vacancy is created transfer to a vacant position shall apply for the position to the Human Resources Department. A list of such applicants shall be forwarded to the Worksite Administrator for consideration. The Board shall endeavor to fill vacancies with qualified applicants currently employed by the Board. Before new personnel are hired for vacant positions, employees with the greatest seniority who have requested transfer to such positions shall be given foremost consideration provided such employees have equal or better ability to satisfactorily perform the work in question as determined by the Worksite Administrator. Filling Vacancies. (c) After an employee has been chosen to fill a bulletined job Company shall, within five (5) work days post a notice of same on all appropriate bulletin boards and furnish a copy to the District 142 General Chairman, showing the name of the successful bidder and his classification seniority date.
(d) If the successful bidder for a bulletined job is located at some station other than the station where the bulletined job is to be filled, the Company will transfer the employee to the new location at subsistence rates in accordance with the provisions set forth in paragraph (e) of Article 7 VII and will furnish transportation for him and his dependents living with him. All other expenses incident to a transfer resulting from bidding in a job bulletined as “permanent” shall be borne by the employee unless the job fails to continue for at least six (6) months, in which to decline case a moving expense allowance in accordance with the offerprovisions of paragraph (e) of Article 8 VIII will be allowed.
B. (e) A successful bidder shall hold the bulletined job for a period of thirty (30) days actually worked in the new job on a trial basis in order to demonstrate his ability to perform the work required by the job. During such period of thirty (30) days actually worked, if the employee is unable to demonstrate his ability to perform the work required by the job, or if he finds the job to be not as represented in the bulletin, he may return to his previous assignment, but he shall not, for a period of nine (9) months after said failure, be permitted to bid for a vacancy in the same or higher classification in the same type of work in which he was previously unable to demonstrate ability.
(f) During the interim required to bulletin a vacancy, the Company may select the most senior qualified employee to fill the vacancy temporarily, and such employee shall receive his regular rate or the rate of the new job, whichever is higher.
(g) In the case of vacancies in classifications above Cargo Agent and Station Agent not expected to exceed thirty (30) days, the Company may select the senior qualified employee to fill such vacancies on a temporary basis without bulletining the job, however, cut back employees from such classifications will have preference in accordance with their seniority in filling such vacancies. At the end of thirty (30) days, the vacancy will be bulletined, and if the employee who has worked temporarily on the job is the successful bidder for the job after bulletining, then his seniority shall accrue from the date of such temporary assignment.
(h) An employee under this Agreement assigned to a temporary job under paragraphs (f) and (g) of this Article shall, upon discontinuance of such temporary job, be returned to his former job and status.
(i) Shift vacancies will not be bulletined; however, the company will assign the senior employee desiring such vacancies.
(j) The Company will post supervisory positions within North America and give first consideration to those applicants in the department. In the event that the vacancy is not filled by transfer of an employee Company determines that there are no suitable applicants, the Company may then recruit elsewhere in the same classification as the vacancy, the Employer will review and consider interested bargaining unit employees within the DepartmentCompany or externally.
C. In the event that the vacancy is not filled by transfer within the Department, the Employer shall consider interested employees in other classifications who possess the necessary training and ability to perform the job along with other applicants. Should the vacancy be filled by an employee in a different job classification with a higher rate of pay, and that employee’s salary exceeds the maximum pay for the assigned job class, the salary of the (k) No employee will be redgiven a permanent transfer against his wishes. Filling Vacancies. When a vacancy is created A. Annual Initial Bid Meeting: Prior to the beginning of each school year all run/routes shall be open for bidding. Prior to the conclusion of each school year each Employee shall be notified of the August bid meeting date. On the day prior to the scheduled bid meeting date, all runs/routes shall be available for viewing at the transportation office by the Employees. Filling Vacancies. When A. Vacancies/new positions shall remain posted for a period of five (5) work days, with a copy of same emailed to any member on lay-off. During the summer months, the district shall email all postings to all bargaining unit members that are not a part of the summer work force. If the position is not filled within a reasonable time the position shall be reposted. Filling Vacancies. When a A. A vacancy is defined as a bargaining unit position which the administration intends to fill which is either newly created in or which is vacant because of death, retirement, resignation, termination, non-renewal, or where a position has become open following a transfer or transfers.

Whenever a member of the employee bargaining unit bids on a job as posted in accordance with Article 7.05, that individual will be adjusted to either the minimum notified of the classification disposition of the bid within ten (10) days of the date that the member has been interviewed or considered for the position.
G. The Board will not delay the posting of positions created by transfers.
X. The Superintendent will provide the Association President with the names of bargaining unit members who bid on a particular position or positions and did not receive such position or positions.
I. Members of the bargaining unit assigned to fill a posted vacancy will not be involuntarily transferred for a period of one (1) school year, except to recall teachers from the Reduction in Force (RIF) list or to prevent a RIF, if it is the only position for which the employee promotes or by the current step percentage, whichever intended RIF bargaining unit member is greatercertified/licensed.
D. In the event the vacancy is not filled by a current employee, the employee shall commence employment at the minimum of the appropriate salary schedule. However, if the parties agree that extenuating circumstances exist, new hires may be granted a rate in excess of the minimum established by the salary schedules. Filling Vacancies. 1. A “vacancy” is a permanent opening created by the termination, transfer, promotion or retirement of an incumbent bargaining unit employee which the County intends to fill or which is created when the County determines its operational needs require additional bargaining unit employees. Whenever a vacancy occurs, and the County elects, in its discretion, to fill the vacancy through the competitive process, the County will advertise the specific position and the Department will inform bargaining unit employees through email notification. The Union at the same time will be notified of the vacancy in writing. Any employee covered by this Agreement may apply for any vacancy, as defined in this Section 5.1.F. The Department may, at its discretion, fill vacancies for General Clerk I/II or Administrative Aide I/II by requesting a list of eligibles from an open and continuous register maintained by the County, without being required to create a new register to fill these positions. However, the County will notify all bargaining unit members by email of the opening of any open and continuous register from which the County may fill bargaining unit positions, and inform the members that a bargaining unit position may be filled from that register without further opportunity for the members to apply for that position. Members will be so notified when the announcement opens, but in no event less than ten (10) days before the announcement closes.
2. When a bargaining unit member applies for a vacancy through the normal competitive process and is created in determined to be qualified for the position, the name of the qualified bargaining unit employee will be placed on the list of eligibles sent to the Fire/EMS Department for its consideration. The Fire/EMS Department will ensure that any bargaining unit member on any list of eligibles will be granted an interview for the position vacancy. The interview panel shall include the Union President or his /her designee and shall not be a voting member.
3. The County, at all times, shall have the right to:
a. determine which candidates meet the standards and qualifications set forth for any position/vacancy.
b. advertise/communicate position vacancy announcements simultaneously to all available sources, including employees within the bargaining unit, the Employer agrees County employee population, and to provide notice by e-mail the public at large.
c. to all interview candidates for vacant positions from any applicant pool in a single unified process or from any bargaining unit/County employee applicants first as the County determines appropriate under the circumstances.
4. If a bargaining unit employees at least fourteen (14) calendar days prior to filling the vacancy. Such notice will include the following as applicable: a) classification, b) division, employee meets all standards and c) location. The Department of Public Safety vacancies will be posted via the Department’s website.
A. The Employer will review those requests on file from any employee qualifications set forth in the same classification as the vacancy who position, has indicated an interest in the specific assignment, shift or location of the vacancy. In making a selection, the Employer will take into consideration ability, job requirements, operational efficiency and seniority. If the senior employee’s transfer request is denied, the reason(sno disciplinary action(s) for such denial will be provided in writing to the affected employee(s) upon request. Any employee who is selected for transfer shall have three (3) work days in which to decline the offer.
B. In the event that the vacancy is not filled by transfer of an employee in the same classification as the vacancy, the Employer will review and consider interested bargaining unit employees within the Department.
C. In the event that the vacancy is not filled by transfer within the Department, the Employer shall consider interested employees in other classifications who possess the necessary training and ability to perform the job along with other applicants. Should the vacancy be filled by an employee in a different job classification with a higher rate of pay, and that employee’s salary exceeds the maximum pay for the assigned job class, the salary of the employee will be red-circled for a period not to exceed two (2) years. Should the vacancy be filled by an employee in a different job classification with a rate of pay that is lower than the current classification, i.e. a promotion, the salary of the employee will be adjusted to either the minimum of the classification to which the employee promotes or by the current step percentage, whichever is greater.
D. In the event the vacancy is not filled by a current employee, the employee shall commence employment at the minimum of the appropriate salary schedule. However, if the parties agree that extenuating circumstances exist, new hires may be granted a rate in excess of the minimum established by the salary schedules. A written record of the justification for the advanced rate will be retained in the employee’s personnel filefile and is rated at least satisfactory in performance, the bargaining unit employee shall be selected for the position. A bargaining unit employee who has disciplinary action(s) in the employee’s personnel file shall still be eligible for promotion although, not subject to the preference described herein.
5. Anything in this Agreement to the contrary notwithstanding, for the purpose of this preference provision, the term “all standards and qualifications” include minimal qualifications and requirements set forth in the position as well as all preferred, additional qualifications as determined by the County for the position, both objective and subjective.
6. If more than one bargaining unit employee meets the requirements set forth in 4 above, the County shall not be obligated to select the senior employee, but may make the selection which best suites the need of the County in the discretion of the County.
7. When the Department temporarily, via an acting position, places a bargaining unit employee into a vacancy (“vacancy” has the same meaning as defined in Section 5.1.F.1 of this Agreement), the Department shall adhere to the following procedures:
a. The position shall be announced by Department wide email. Instructions and qualifications for applying for transfer to the Acting Position shall be included in the announcement.
b. The application period shall be open for a minimum of seven (7) days.
c. The Department shall allow members of the bargaining unit to apply for the Acting Position and shall interview all qualified applicants for the position.
d. The interview panel shall include the Union President or his /her designee, who shall not be a voting member.
e. The Department retains the sole discretion to make the decision regarding which employee shall be selected for the acting position. Nothing in this section affects the Department’s and/or County’s ability to choose which employee, if any, will ultimately be promoted to that position. The fact that an employee is granted an acting position does not create an entitlement to promotion to that position.
f. The parties agree that the Department will not be prohibited from immediately filling this position pending the process outlined in this Section (5.1.F.7).

B. f. Drivers awarded a temporary run/route will not be eligible to fill another until they have completed that run/route. Upon return from a leave, the returning Employee shall assume his/her previously bid run/route unless there has been a seniority adjustment. All other Employees shall return to their prior run/route.
g. An Employee who is on a leave of absence exceeding ninety (90) work days at the beginning of the school year, shall first bid his/her run/route, then Section B of this Article shall be implemented.
h. Employees who are on an unpaid leave at the conclusion of a school year and wish to participate in the bid meeting at the start of the next school year must provide Human Resources with written notice that they are cleared to perform all duties, without restriction, as of severn (7) calendar days prior to the first student day of school from the Department of Transportation (DOT) doctor, or personal physician if DOT clearance is not required prior to Bid day. Extensions may be granted if mutually agreed upon between both parties. A description of the run/routes, approximate mileage, and approximate completion time will be provided at the bid meeting.
4. Whenever a driver accepts a temporary run/route due to a regular driver’s leave of absence of over ninety (90) days, the driver who accepts the temporary run/route must stay on that run/route for the duration of the temporary run/route. This individual may not bid on another temporary run/route until their current tempoprary run/route expires. If she/he goes on medical or emergency leave during the placement, she/he would resume that placement upon her/his return.
5. In the event that a vacancy occurs during the school year, the vacancy is not filled by transfer of an employee in the same classification as the vacancy, the Employer will review and consider interested bargaining unit employees within the Department.
C. In the event that the vacancy is not filled by transfer within the Department, the Employer shall consider interested employees in other classifications who possess the necessary training and ability to perform the job along with other applicants.
