Filling Vacant Positions. ‌ 11.1 The Medical Center shall post vacant positions for seven (7) days (exclusive of Saturdays, Sundays and holidays) before the position is permanently filled. During this period, an employee desiring to be considered for a vacant position shall file a written request with the Human Resources Division. An employee shall have the option of returning to his/her former position with no loss of seniority, provided the employee makes the request to return to the former position within thirty (30) days of the transfer. 11.3 The Medical Center shall send a copy of all job postings, including the date of the posting, job requirements, job descriptions, the job posting number, and a list of all employees who applied for the job to the Union on a monthly basis. 11.4 An employee who accepts a promotion into a non-bargaining unit position (management position) will have the right to return to their prior position within a period of ninety (90) days at the option of the employee. During the ninety (90) day period, the employee shall continue to accrue all benefits and seniority. If the employee does not return to the bargaining unit by the end of the ninety (90) days, they will lose their seniority as it applies under the collective bargaining agreement. 11.5 When If an employee successfully bids opening is created on a medical/surgical unit as the result of an LPN on a medical/surgical unit leaving the Medical Center or transferring to another unit or position, said employee cannot bid again for the open position shall be posted as an LPN position. If the Medical Center is unable to fill this position with an LPN, the Medical Center may post the job under a six (6) month period, unless the bid is for a position within the employee's current department or different job classification. 11.6 The Medical Center job postings will reflect the exact weekend and/or holiday work requirement(s).

Filling Vacant Positions. (a) If the Company elects to fill a vacant position at any location that does not have relief shift employees or relief shift employees are not available, other than by reassignment on the watch or the utilization of adjacent watch personnel, the following sequence shall be utilized: 11.1 The Medical Center shall post vacant positions for seven (1) Call in the shift employee who is on his/her "long change" and has signed the voluntary sign-up list, if applicable, (the operator who will be called is the operator who has the most days off on his non-workdays). (2) Call in the shift employee who is on his/her "long change" (the operator who will be called is the operator who has the most days off on his non- workdays). (3) Call in the shift employee on his/her non-workdays who has signed the voluntary sign-up list, if applicable, and is scheduled to return to work on the same shift that is vacant.
