Common use of FMLA/NJFLA Clause in Contracts

FMLA/NJFLA. a. In the case of any leave because of (1) the birth and care of the employee's child, or (2) the placement of a child with the employee for adoption or xxxxxx care, or (3) in order to care for the spouse (including Civil Union Partner), child or parent of the employee if the spouse, child or parent has a serious health condition, said employee may use, to the extent that it exists, accrued paid leave, such as personal days, prior to or following the following the utilization of leave under the Federal Family and Medical Leave Act under/or the New Jersey Family Leave Act.
