FOOD LABELING. The WVDA is hereby designated as the lead agency with regard to all food product labeling in West Virginia. The WVDA will work with the Food & Drug Administration (FDA), U. S. Department of Agriculture (USDA), U. S. Department of Labor and other federal and state agencies to assure truth in food product labeling. The WVDA will, within its resources, review labels from those food manufacturers who are based in West Virginia for their compliance to both Federal and State standards. This review will encompass the Nutrition Labeling and Education Act (NLEA) and the Fair Packaging and Labeling Act (FPLA) as well as other State and Federal Laws. The BPH agrees to assist the WVDA by collecting labels as part of their FDA Food Manufacturer contract inspections. These labels should be mailed to the WVDA Regulatory & Environmental Affairs Division for review. The results of these reviews will be provided to the BPH by the WVDA. The WVDA will conduct periodic training sessions regarding the labeling of food products. These sessions will assist in training field personnel in finding potentially violative labels for collection and review.

  • Prescription Drug Plan Effective July 1, 2011, retail and mail order prescription drug copays for bargaining unit employees shall be as follows: Type of Drug Prescriptions for 1-45 Days (1 copay) Prescriptions for 46-90 Days (2 copays) Generic drug $10 $20 Preferred brand name drug $25 $50 Non-preferred brand name drug $40 $80 Effective July 1, 2011, for each plan year the Prescription Drug annual out-of- pocket copay maximum shall be $1,000 for individual coverage and $1,500 for employee and spouse, employee and child, or employee and family coverage.
