Common use of Form of Compensation/Banking Excess Hours Clause in Contracts

Form of Compensation/Banking Excess Hours. Compensation for overtime shall be paid except where, upon request of the Employee, overtime will be granted in the form of time off in lieu of overtime hours worked. (a) Where an Employee works hours in excess of his regularly scheduled hours of work, the Employee may bank the excess hours, along with any hours banked under Article 19.04 (work on a holiday). (b) Employees may request time off with pay from the banked hours and may, subject to operational efficiency, be granted time off with pay drawn from his/her banked hours. (c) When a Full-Time Employee is regularly scheduled for only 72 hours or less in a pay period, the Employee may draw a block of 12 hours from his banked hours, subject to the following qualifications: (i) if the Employee has less than 12 hours banked, the Employee may withdraw the remaining hours in his/her bank (but cannot create a negative balance); and (ii) withdrawal of banked hours cannot result in an Employee receiving more pay than if he/she had worked 84 hours in the pay period. (iii) Banked hours remaining in the bank as of the end of the first full pay period in November and May in any year shall be paid out on the first pay in December and June. Bank payout in December will be automatic and mandatory. Bank payout in June will be processed for all Employees unless the Payroll Manager or designated representative is notified in writing by April 30th to hold hours in bank until December. (d) In all cases, banked hours will be paid out at the rate they were earned with the hours first banked to be paid out first (first in, first out). (e) It is understood that the determination of whether operational efficiency permits time off to be granted shall be at the sole and absolute discretion of the Employer (and during the life of this Collective Agreement shall not be the subject of a grievance). As a means of resolving chronic on-going difficulties in granting time off at a particular site, the issue may be referred to the Joint Committee on Labour Relations. (i) Attempts to fill shifts and grant time off for Employees using banked time will be made, however, shifts will not be filled at the premium rate to grant banked time off for Employees. Priority will be given to vacation shifts prior to banked time shifts. (ii) For the LifeFlight program only, the Employer will not post shifts, due to part-time staff not regularly being at the site and will perform all call-ins via telephone or Company e-mail.
