FREEDOM OF INFORMATION AND ENVIRONMENTAL INFORMATION REGULATIONS. 26.1 The Partners agree that they will each cooperate with each other to enable any Partner receiving a request for information under the 2000 Act or the 2004 Regulations to respond to a request promptly and within the statutory timescales. This cooperation shall include but not be limited to finding, retrieving and supplying information held, directing requests to other Partners as appropriate and responding to any requests by the Partner receiving a request for comments or other assistance.
26.2 Any and all agreements between the Partners as to confidentiality shall be subject to their duties under the 2000 Act and 2004 Regulations. No Partner shall be in breach of Clause 26 if it makes disclosures of information in accordance with the 2000 Act and/or 2004 Regulations.

26.2 Any and all agreements between the Partners as to confidentiality shall be subject to their duties under the FOIA and the EIR. No Partner shall be in breach of Clause 26 if it makes disclosure of information in accordance with the FOIA and/or the EIR.
FREEDOM OF INFORMATION AND ENVIRONMENTAL INFORMATION REGULATIONS. F4.1 The Contractor acknowledges that the Council is subject to the requirements of the FOIA and the EIR. The Contractor shall:
(a) provide all necessary assistance and cooperation as reasonably requested by the Council to enable the Council to comply with its obligations under the FOIA and EIR;
(b) transfer to the Council all Requests for Information relating to this Contract that it receives as soon as practicable and in any event within two (2) Working Days of receipt;
(c) provide the Council with a copy of all Information belonging to the Council requested in the Request for Information which is in its possession or control in the form that the Council requires within five (5) Working Days (or such other period as the Council may reasonably specify) of the Council's request for such Information; and
(d) not respond directly to a Request for Information without Approval.
F4.2 The Contractor acknowledges that the Council may be required under the FOIA and EIR to disclose information (including Confidential Information) without consulting or obtaining consent from the Contractor. The Council shall take reasonable steps to notify the Contractor of a Request for Information (in accordance with the Secretary of State's section 45 Code of Practice on the Discharge of the Functions of Public Authorities under Part 1 of the FOIA) to the extent that it is permissible and reasonably practical for it to do so but (notwithstanding any other provision in this Contract) the Council shall be responsible for determining in its absolute discretion whether any information is exempt from disclosure in accordance with the FOIA and/or the EIR.

30.2 Each Party acknowledges that the other Party is subject to the requirements of the 2000 Act and each Party shall assist and co-operate with the other, at their own expense, to enable the other Party to comply with its information disclosure obligations.
30.3 Where a Party receives a request for information specifically in relation to a function of the other Party, it shall direct the request for information to the other Party as soon as practicable after receipt and in any event within two Working Days of receiving the request for information.
30.4 Where the request relates to functions of both Parties, the Party receiving the request will share the request with the other Party as soon as practicable after receipt and in any event, within two Working D ays and that Party will assist and co-operate with the other as is necessary for it to respond to the request within the time for compliance. If either Party determines that information must be disclosed it shall notify the other Party of that decision at least two Working Days before disclosure. Each Party shall be responsible for determining at its absolute discretion whether the relevant information is exempt from disclosure or is to be disclosed in response to a request for information.
30.5 Any and all agreements between the Parties as to confidentiality shall be subject to their duties under the 2000 Act and 2004 Regulations. No Party shall be in breach of Clause 29 or any other confidentiality clauses or agreements if it makes disclosures of information in accordance with the 2000 Act and/or 2004 Regulations.
FREEDOM OF INFORMATION AND ENVIRONMENTAL INFORMATION REGULATIONS. Where a Controller is a public authority, the Parties acknowledge that such a Controller is subject to the Freedom of Information Act 2000 (FOIA) and the Environmental Information Regulations 2004 (EIR). A Controller as set out in clause 11.1 will be statutorily required, subject to any applicable exemptions, to disclose information about the Data Processing Activities provided under this Agreement or the Agreement itself in response to a specific request under FOIA or EIR. In which case: A Processor shall provide its instructing Controller with all reasonable assistance and co-operation to enable the Controller to comply with its obligations under FOIA or EIR; and A Controller as set out in clause 11.1 Controller shall consult any Party it reasonably considers relevant or who may have a legitimate interest in respect of any commercial, confidential or other issues in relation to the Agreement relevant to the issue of whether the information is exempt from disclosure or not; however the final decision about disclosure of information or application of exemptions shall rest solely with the Controller which has received the request.

26.3 Upon termination of this Agreement for any reason whatsoever this Clause 26 shall continue to survive.
FREEDOM OF INFORMATION AND ENVIRONMENTAL INFORMATION REGULATIONS. The Consultant shall assist the Council at no additional cost to meet any reasonable requests for information in relation to this Contract which are made to the Council in connection with the Freedom of Information Xxx 0000 and the Environmental Information Regulations 2004 or any statutory modification or re-enactment thereof or any related guidelines or codes of practice.
FREEDOM OF INFORMATION AND ENVIRONMENTAL INFORMATION REGULATIONS. 11.1 The Authority is subject to the Freedom of Information Act 2000 and the Environmental Information Regulations 2004 and as such may be required to disclose information (including commercially sensitive information) without consulting or obtaining consent from the Supplier. The Authority shall be responsible for determining in its absolute discretion how to respond to such a request, including whether any commercially sensitive information and/or other information is exempt from disclosure.
11.2 The Supplier shall provide all necessary assistance and cooperation as reasonably requested by the Authority to enable the Authority to comply with its obligations and transfer all requests for information relating to this agreement as soon as practicable and in any event within 2 working days of receipt. The Supplier shall provide the Authority with a copy of all information belonging to the Authority requested in the request for information which is in its control in the form that the Authority requires within 5 working days.
FREEDOM OF INFORMATION AND ENVIRONMENTAL INFORMATION REGULATIONS. 11.1 The Parties acknowledge that each is subject to the requirements of the FOIA and the EIRs and each shall reasonably assist and co-operate with the other to enable that other Party to comply with its obligations under the FOIA and the EIRs. This shall include complying with any timescales set by the relevant Party for providing information and/or assistance and providing all such information and/or assistance as the relevant Party shall request to enable that Party to comply with its obligations under the FOIA and the EIRs.
11.2 Where a Party receives a Request for Information in relation to information which it is holding on behalf of the other Party in relation to the Deployed Services, it shall:
(a) transfer the request for information to the other Party as soon as practicable after receipt and in any event within two (2) Business Days of receiving a Request for Information;
(b) provide the other Party with a copy of all information in its possession or power in the form that the other Party requires within ten (10) Business Days (or such longer period as the relevant Party may specify) of the Party requesting that information; and
(c) provide all necessary assistance as is reasonably requested by the other Party to enable that other Party to respond to a Request for Information within the time for compliance set out in the FOIA or the EIR.
11.3 Each Party shall be responsible for determining at its absolute discretion whether the information belonging to them:
(a) Is exempt from disclosure in accordance with the provisions of the FOIA or the EIR; or
(b) Is to be disclosed in response to a request for information.
11.4 In no event shall either party respond directly to a request for information relating to information belonging to the other unless expressly authorised to do so in writing.
