Government Furnished Equipment. In the course of their employment with the Company, employees at South Fort Polk are furnished and work with U.S. Government and/or Company furnished tools, equipment, property and materials. Each employee is required to take reasonable care and exercise safekeeping of the tools, equipment, property and materials they work with and to promptly notify the Company of any damage to or defects in such equipment, property and materials.

Government Furnished Equipment. Schedule 4.22 incorporates the most recent schedule delivered to the U.S. Government or any non-U.S. Government which identifies by description or inventory number certain equipment and fixtures loaned, bailed or otherwise furnished to or held by the Business by or on behalf of the United States or any foreign country. To the Knowledge of Sellers, such schedule was accurate and complete on its date and, if dated as of the Closing Date, would contain only those additions and omit only those deletions of equipment and fixtures that have occurred in the ordinary course of business, except for such inaccuracies that could not reasonably be expected to have a material adverse effect on the Business.
Government Furnished Equipment. The Marine Corps shall provide the Host School with Government- furnished equipment needed to administer the MCJROTC curriculum (i.e., flags, guidons, etc.). The amount and type of equipment provided is subject to the applicable tables of allowance in the MCJROTC Supply Manual based on the number of cadets enrolled in each program.

Government Furnished Equipment. Section 4.8(l) of the Company Disclosure Schedule identifies by description or inventory number and contract all property, equipment, fixtures and software loaned, bailed or otherwise furnished to or held by the Company or any of its Subsidiaries (or furnished to subcontractors on its behalf) by or on behalf of the Government as of the date stated therein (said property, equipment, fixtures and software are herein referred to as the “GFE”). The Company and each of its Subsidiaries has certified to the U.S. Government in a timely manner, to the extent required by applicable Law, that all GFE is in good working order, reasonable wear and tear excepted, and otherwise meets the requirements of the applicable contract and all applicable Laws. The Company and its Subsidiaries is in compliance with and has complied in all material respects with all requirements under applicable Laws and the terms of the applicable Government Contract(s) concerning the management of the GFE, including all requirements for the inventorying, reporting, proper care and maintenance of such GFE, as well as all requirements pertaining to the use and/or rental (whether permitting or prohibiting such use and/or rental, as the case may be) of such GFE. There are not outstanding loss, damage or destruction reports that have been or should have been submitted to any Governmental Entity in respect of any GFE.
Government Furnished Equipment. ‌ 35.1 Government Furnished Equipment shall remain the property of the AUTHORITY and shall be used in the performance of this Agreement and for no other purposes without the prior written approval of the AUTHORITY. 35.2 All Government Furnished Equipment shall be deemed to be in good condition when received by or on behalf of the CONTRACTOR unless the CONTRACTOR notifies the AUTHORITY to the contrary within five (5) Working Days of receipt. 35.3 The CONTRACTOR undertakes the safe custody of and due return of all Government Furnished Equipment and acknowledges that it is subject to the duties of a bailee under common law in respect of all Government Furnished Equipment and the CONTRACTOR shall be responsible for all loss of or damage (including any deterioration in the state and condition other than fair wear and tear resulting from normal and proper use in the performance of this Agreement which is not contributed to by lack of due maintenance and repair) (where such maintenance and repair is the CONTRACTOR’s responsibility) to Government Furnished Equipment whilst in its possession unless such loss and damage is due to the negligence of the AUTHORITY, its staff or employees or a contractor engaged by the Authority. 35.4 Neither the CONTRACTOR, nor any CONTRACTOR Personnel, nor any other person, shall have a lien on any Government Furnished Equipment for any sum due to the CONTRACTOR, CONTRACTOR Personnel or other person and the CONTRACTOR shall take all steps necessary to ensure that the title of the AUTHORITY is brought to the notice of all Subcontractors and third parties. 35.5 The AUTHORITY warrants that it has all necessary rights in the Government Furnished Equipment to allow the CONTRACTOR (and its Subcontractors) a right to use the Government Furnished Equipment. 35.6 On or immediately prior to the Commencement Date (or such other date as may be agreed between the Parties), the AUTHORITY shall make available to the CONTRACTOR the Government Furnished Equipment that the CONTRACTOR has notified and agreed with the AUTHORITY is necessary to be provided by the AUTHORITY for the CONTRACTOR to perform the Services.
