PROPERTY AND MATERIALS. USER may be permitted by CONTRACTOR to furnish equipment, tooling, test apparatus, or materials necessary to assist in the performance of its experiment(s) at the USER Facility. Such items shall remain the property of USER. Unless the Parties otherwise agree, all such property furnished by USER or equipment and test apparatus provided by USER will be removed by USER within sixty (60) days of termination or expiration of this Agreement or will be disposed of as directed by USER at User’s expense. Any equipment that becomes integrated into the facility shall be the property of the Government. USER acknowledges that any material supplied by USER may be damaged, consumed or lost. Materials (including residues and/or other contaminated material) remaining after performance of the work or analysis will be removed in their then condition by USER at USER's expense. USER will return facilities and equipment utilized in their original condition except for normal wear and tear. CONTRACTOR shall have no responsibility for USER's property in CONTRACTOR's possession other than loss or damage caused by willful misconduct or gross negligence of CONTRACTOR or its employees. Personal property produced or acquired during the course of this Agreement shall be disposed of as directed by the owner at the owner’s expense.

USER will return facilities and equipment utilized in their original condition except for normal wear and tear. CONTRACTOR shall have no responsibility for USER's property in CONTRACTOR's possession other than loss or damage caused by willful misconduct or gross negligence of CONTRACTOR or its employees. PROPERTY AND MATERIALS. A. If USER needs to furnish equipment, tooling, test apparatus, or assist in performance of sequencing tasks at the JGI, the Agreement or Appendix will be amended accordingly.
B. The Parties understand that under the Work, materials may be exchanged, including without limitation, biological materials that can be replicated or reproduced, such as plasmids, deoxyribonucleic acid molecules, ribonucleic acid molecules, living organisms of any sort and their progeny, including viruses, prokaryote and eukaryote cells, etc. While every effort at JGI will be made to properly handle the materials, USER acknowledges that any material supplied by USER or to the USER may be damaged, consumed or lost. USER materials (including biological materials, vectors, nucleotide constructs, residues and/or other contaminated material) remaining at JGI after performance of the Work or analysis will be removed in their then condition and handled in accordance with the Work.
C. USER asserts that it has either title or sufficient legal rights if USER provides material and information to the JGI and its vendors, suppliers or providers of biological materials, in accordance with the Work and this User Agreement. USER shall inform CONTRACTOR if USER knows of any infringing action or misappropriation of third party intellectual property rights in the materials or sequences under the Work.

PROPERTY AND MATERIALS. The agrees that it is the ’s responsibility and not the responsibility of the Owner to safeguard the property and materials that the or any of the ’s “ Associates” use or have in their possession while performing under this Agreement. Further, the agrees to hold the Owner harmless for any loss of such property and materials used by any such persons pursuant to the ’s performance under this Agreement which is in their possession, except if caused by the Owner’s gross negligence or intentional misconduct.
PROPERTY AND MATERIALS. The transmission of property or materials to InnerWorkings or ServiceMaster; of or use by InnerWorkings of ServiceMaster Confidential Information, or visa versa, including but not limited to Intellectual Property and Trade Secrets shall not be construed to grant InnerWorkings or ServiceMaster a license or right of any type under any patents, copyrights, know-how, or trademarks owned or controlled by ServiceMaster or InnerWorkings other than as contemplated within a particular Work Order. Any and all property and materials (including but not limited to documentation, ServiceMaster’s Confidential Information, InnerWorkings’ Confidential Information, off-the-shelf software, tools, computers, supplies and equipment) transmitted from ServiceMaster to InnerWorkings, or visa versa, or accessed or used by InnerWorkings or ServiceMaster shall remain the property of ServiceMaster or InnerWorkings and shall be returned to ServiceMaster or InnerWorkings immediately upon the sooner of either’s request or the termination or expiration of any applicable Work Order, and InnerWorkings and ServiceMaster agree not to reproduce said materials without the written consent of the other. ServiceMaster shall retain all ownership rights and title to all ServiceMaster Data, and InnerWorkings shall retain all ownership rights and title to all InnerWorkings data, code, and all other elements of QQ24.

Such items shall be identified on the Utilization form prior to the commencement of the Project. Such items remain the property of the User. Unless the Parties otherwise agree, all such property furnished by User or equipment and test apparatus provided by User will be removed by User within sixty (60) days of termination or expiration of the Project or will be disposed of as directed by User at User’s expense. User acknowledges that any material supplied by User may be damaged, consumed or lost. Material (including residues and/or contaminated material) remaining after the performance of the Project will be removed by User at User’s expense. User will return the facilities and equipment utilized in their original condition except for normal wear and tear. Equipment Site shall have no responsibility for User’s property in Equipment Site’s possession other than loss or damage caused by willful misconduct or gross negligence of the Equipment Site or its employees.
PROPERTY AND MATERIALS. The Film/Production Company agrees that it is the Film/Production Company's responsibility and not the responsibility of the City to safeguard the property and materials used or in the possession of the Film/Production Company or any one associated with the Film/Production Company while on public property. Further, the Film/Production Company agrees to hold the City harmless for any loss of such property and materials, except if caused by the City's gross negligence or intentional misconduct.
PROPERTY AND MATERIALS. For clarity, the term “Property” shall include, without limitation, all interior and exterior areas, utilities, buildings or other structures of the Property, real and personal property, displays and signs located in, on and/or about the Property and Owner’s name, logo, trademark(s), trade- names, service mark(s) and slogan(s), as depicted on, in, and/or about the Property. All physical embodiments of filming, photographing and recording of the Property (including, without limitation, all depictions thereof) shall hereafter be known as the "Materials".
PROPERTY AND MATERIALS a. It is the responsibility of all learners to take care of school property.
b. Learners who wilfully or negligently cause damage to School property will be required to make good the damage incurred by paying for the repair or replacement thereof.
c. Any breakage of, or damage to, school property must be reported immediately to a staff member.
d. Learners may not bring toys to school unless specifically requested to do so by the educator.
e. Any sums of money and /or valuables must be handed to a staff member for safe-keeping at the beginning of the day and not left in desks or bags. Cell phones, ipads etc must not be bought to school without prior permission from a staff member, and only then for educational purposes. The school accepts no responsibility for learner’s private property, including the loss by theft or for damages howsoever incurred.
f. Any unclaimed items found must be promptly handed to a staff member.
g. Riding of bicycles in the school grounds is strictly forbidden unless prior written permission is obtained to use the school infrastructure by the Principal.
