Common use of Hardware Maintenance Clause in Contracts

Hardware Maintenance. Where applicable, fees hardware maintenance are charged annually and payable at the time of Services activation and each annual anniversary thereafter. Such maintenance Services, unless terminated by the Customer in writing at least sixty (60) days prior to the annual anniversary of the Service Term, shall be automatically renewed on an annual basis until expiration of the Service Term for the associated Services. Where hardware maintenance Services are provided by the hardware manufacturer or another third party, certain additional terms and conditions may apply. Optical Wavelength Services include a series of SLAs that validate the reliability of the Rogers Core Network, and personnel, in delivering the Optical Wavelength Services. The Service Availability (Access and Core), MTTR, Latency, Bandwidth, and Packet Loss SLAs are available to the Customer as part of the basic Optical Wavelength Services offering.
