Failing to do so may result in disciplinary action. 24.06 The Employer will use its best efforts to make all affected direct care employees aware of residents who have serious infectious diseases. The nature of the disease need not be disclosed. Employees who are not direct care employees will be made aware of special procedures required of them to deal with these circumstances. 24.04 (b) Union staff or Union Health and Safety advisors or consultants shall be provided access to the workplace, with the approval of the Administrator if required to attend Health and Safety Committee meetings, or for inspecting, investigating or monitoring the workplace.
(c) Union members of the Health and Safety Committee shall be entitled to time off from work with no loss of seniority or earnings to attend seminars sponsored by government agencies or the Union for instruction and upgrading on Health and Safety matters. Such time off shall be at the discretion of the Administrator and shall not be the subject matter of a grievance.
(d) The Joint Health and Safety Committee and the representa- tives representatives thereof shall have reasonable access to the annual summary of data from The the Workers' Compensation Board relating to the number of work accident accidents, fatalities, the number of lost workday cases, the number of lost workdays, the number of non-fatal cases that required medical aid without lost workdays, the incidence of occupational injuries, and such other data, as The the Workers' Compensation Board may decide to disclose.

Health and Safety Committee. 24.01 (a) The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the homeemployer, in order to prevent injury and illness.
24.02 A joint management and employees close cooperation with the bargaining unit, will establish a health and safety committee which will have the following powers:
(i) It shall receive, consider and expeditiously dispose of complaints relating to the safety and health of the employees represented by the committee.
(ii) It shall maintain records pertaining to the disposition of complaints relating to the safety and health of employees represented by the committee.
(iii) It shall co-operate with any occupational health service established to serve the workplace.
(iv) It may establish and promote safety and health programs for the education of employees represented by the committee.
(v) It shall, within reason, participate in inquiries and investigations pertaining to occupational safety and health including such consultations as may be necessary with persons who are professionally or technically qualified to advise the committee on such matters.
(vi) It may develop, establish and maintain programs, measures and procedures related to the safety and health of employees.
(vii) It shall monitor on a regular basis programs, measures and procedures related to the safety and health of employees.
(viii) It shall ensure that adequate records are kept on work accidents and health hazards and shall monitor data relating to such accidents, injuries and hazards on a regular basis.
(ix) It shall co-operate with Safety Officers.
(x) It may request from the employer such information as the committee considers necessary to identify existing or potential hazards with respect to materials, processes and equipment in the workplace.
(xi) It shall have full access to all reports prepared by the employer or the union or at the employer's or union's request, relating to the safety and health of the employees represented by the committee, but shall not have access to the medical records of any person except with the consent of that person.
(b) Meetings will be held at least once each quarter. Special meetings required on an urgent basis shall be constituted with representation held at the call of at least half the chairperson or the union representative. The absence of either will not prevent the holding of an emergency meeting.
(c) The committee will establish procedures for the conduct of its meetings as it considers advisable.
(d) Minutes of each committee meeting shall be distributed in both official languages to all committee members and posted on designated bulletin boards.
(e) A secretary will be selected by employees from the bargaining unit committee but need not be a member of the committee. The secretary's duties will include the keeping of minutes, records and the preparation of employees an agenda.
(f) The committee shall have the authority to create sub-committees where needed. The subcommittees may include advisors who are not represented by the union, which shall identify potential dangers, recommended means of improving the health and safety programs and obtaining information from the Employer or other persons respecting the identification of hazards and standards elsewhere. The committee shall normally meet at least once a month. Scheduled time spent in such meetings is to be considered time worked. Minutes shall be taken of all meetings and copies shall be sent to the Employer and to the Unionmembers.

(c) Union members of the Health and Safety Committee shall be entitled to time off from work with no loss of seniority or earnings to attend seminars sponsored by government agencies or the Union for instruction and upgrading on Health and Safety matters. Such time off shall be at the discretion of the Administrator and shall not be the subject matter of a grievance.

Health and Safety Committee. 24.01 The Employer will establish a Health and Safety Committee which will have the Union agree that they mutually desire to maintain standards following powers: shall receive, consider and expeditiously dispose of complaints relatingto the safety and health of the employees represented by the Committee; shall maintain records pertaining to the disposition of complaints relating to the safety and health of the employees represented by the Committee; shall cooperate with any occupational health service established to serve the workplace; may establish and promote safety and health programs for the education of the employees represented by the Committee; shall, within reason, participate in inquiries and investigations pertaining to occupational safety and health including such consultations as may be necessary with persons who are professionally or technically qualified to advise the Committee on such matters; may develop, establish and maintain programs, measures and procedures for the protection or improvement of the safety and health of employees; shall monitor on a regular basis programs, measures and procedures related to the safety and health of employees; shall ensure that adequate records are kept on work accidents, injuries and health hazards and shall monitor data relating to such accidents, injuries and hazards on a regular basis; shall cooperate with the Safety Officers; may request from the Employer such information as the Committee considers necessary to identify existing or potential hazards with respect to materials, processes or equipment in the homeworkplace; shall have full access to ail reports prepared by the Employer or Union or at the Employer’s or Union’s request, in order relating to prevent injury the safety and illness.
24.02 A joint management and health of the employees health and safety committee represented by the Committee, but shall not have access to the medical records of any person except with the consent of that person. The Protective Services Group shall have two members on this Committee. Meetings may be held at least once each quarter. Special meetings required on an urgent basis shall be constituted with representation held at the call of either co-chairperson, should both be present at least half by employees that meeting. The absence of one of the co-chairpersons will not prevent the holding of an emergency meeting. The Committee will establish procedures for the conduct of its meetings as it considers advisable. Minutes of each committee meeting shall be distributed in both official languages to all committee members and posted on designated bulletin boards. The Committee shall have two (2) co-chairpersons of equal standing chosen from the bargaining unit members of the Committee, one being an employee representative selected by the employee representatives in the Committee and the other being a managerial representative selected by the managerial representatives on the Committee. The chairmanship shall alternate quarterly or as agreed by the Committee. A secretary will be selected by the Committee but need not be a member of employees the Committee. The secretary’s duties will include the keeping of minutes, records and the preparationof agendas. The Committee shall have the authority to create sub-committees where needed. The sub-committees may include advisors who are not represented by Committee members. Matters referred to the union, which shall identify potential dangers, recommended means of improving the health Health and safety programs and obtaining information from the Employer or other persons respecting the identification of hazards and standards elsewhere. The committee shall normally meet at least once a month. Scheduled time spent in such meetings is to be considered time worked. Minutes Safety Committee shall be taken of all meetings dealt with in an expeditious and copies shall be sent to the Employer and to the Union.
24.03 Two representatives of the joint health and safety committee, one from management and one from the employees on a rotating basis designated by the employees, shall make monthly inspections of the work place and equipment and shall report to the health and safety committee the results of their inspectionappropriate manner. In the event of accident or injury, such representatives shall be notified immediately and shall investigate and report as soon as possible to that a complaint is not resolved by the committee and to the Employer on the nature and causes of the accident or injury. Furthermore, such representatives must be notified of the inspection of a government inspector and shall have the right to accompany him on his inspections. Scheduled time spent in all such activities shall be considered as time worked.
24.04 The Joint Health and Safety Committee and the representa- tives thereof shall have reasonable access to the annual summary of data from The Workers' Compensation Board relating to the number of work accident fatalitiesCommittee, the number of lost workday cases, the number of lost workdays, the number of non-fatal cases may file a grievance that required medical aid without lost workdays, the incidence of occupational injuries, and such other data, as The Workers' Compensation Board may decide to disclose.
24.05 The Union agrees to endeavour to obtain the full co- operation of its membership would be expeditiously processed in the observation of all safety rules and practices. Employees on the premises are required to respond to the Retirement Residence fire alarm by proceeding directly to their appointed post. Failing to do so may result in disciplinary action.

10.06.04 A member of the Committee shall be entitled to such time away from his work as is necessary to attend meetings or to carry out any other functions as a member of the committee, and any time spent in such meetings is by the member while carrying out any of his functions as a member of the Committee shall, for the purpose of calculating wages owing to him, be considered time worked. 24.05 The Employer shall:
(a) Inform employees of any situation relating to their work which may endanger their health and safety, as soon as the Employer learns of the said situation.
(b) Provide training and supervision so that employees have the skills and knowledge necessary to safely perform the work assigned to them.
(c) Ensure that the applicable measures and procedures prescribed in the Health and Safety Act are carried out in the workplace.
24.06 Any representative appointed or selected in accordance with 26.02 shall serve for a term of one (1) calendar year from the date of the appointment which may be renewed for further periods of one (1) year or a shorter period of time if the Union agrees feels the worker representative is not performing well in order to endeavour make the Committee more effective. Reasonable time off for such representatives to attend meetings of the Occupational Health and Safety Committee in accordance with the foregoing shall be granted and any representative attending such meetings shall not lose regular earnings as a result of such attendance.
24.07 Each member will be paid for up to one (1) hour preparation time at the regular hourly rate if needed prior to the meeting of the Committee.
24.08 Both the Union and Management agree to endeavor to obtain the full co- operation cooperation of its membership and staff in the observation observations of all safety rules Health and practices. Employees Safety Rules and Regulations.
24.09 The parties agree to the principle that Committee co-chairs should alternate chairing meetings on the premises are required to respond Committee whenever possible.
24.10 Workplace inspections will be carried out monthly by one (1) worker and one employer member selected from the body of the committee. If possible the worker member participating in the inspection should be certified and their report shall be presented to the Retirement Residence fire alarm Committee at the first Committee meeting after a full or partial inspection of the workplace has been completed. Such workplace inspections must be carried out by proceeding directly to their appointed post. Failing the certified members representing both sides unless such members are unable to do so may result in disciplinary actionwhich case by another Committee member selected by the corresponding co-chair or certified member.
24.06 24.11 An inspection of the entire workplace will be carried out monthly, such inspection to take place during regular working hours.
24.12 The agenda for a meeting of the Joint Occupational Health and Safety Committee will be set up by the Committee co-chairs and distributed two (2) weeks prior to a meeting.
24.13 The Employer shall provide the Joint Health and Safety Committee with all accident reports and other health and safety records in their possession, including records, reports and data provided to and by the Workplace Safety and Insurance Board and other Government Departments and Agencies. The Supervisor of the department to be inspected will be given one (1) days notice prior to the commencement of the inspection of that department.
24.14 The standards established under Health and Safety legislation and regulations shall constitute minimum acceptable practices.
24.15 The Union and the Employer shall cooperate in promoting an occupational environment which will provide a reasonable protection from risks to employees’ health and safety.
(a) Upon the mutual agreement of the Employer and the Union, health and safety specialists may be invited to attend and advise the Joint Health and Safety Committee meetings.
(b) A worker member of the Committee, selected to be trained to be a certified member by or under the auspices of the Workplace Health and Safety Agency (Xxxx 208) shall be paid by the Employer for time spent in such certification at the Employee’s regular rate of pay provided such worker member is not paid by the Agency or any other body for such time.
(c) In order to promote occupational health and safety to employees, the Employer acknowledges the right of the Union to establish a Worker’s Health and Safety Committee and appoint a Health and Safety Representative in each department. The Union will notify the Employer in writing of the names of each Department Representative. Such Department Representative shall report only to the Joint Health and Safety Committee and shall have no direct dealings with the Employer.
24.17 An employee who is injured during working hours and is required to leave for treatment and is sent home as a result of such injury, shall receive payment for the remainder of the shift at his/her regular hourly rate of pay without deductions from sick leave, unless a doctor states that the employee is fit for further work on that shift. Transportation on the day of the accident to the nearest physician or hospital, for an employee requiring medical care as a result of an accident, shall be at the expense of the Employer.
24.18 The Union and the Employer agree and the Union will support the Employer in the following endeavors with respect to violence and harassment in the workplace.
(a) Violence – The Employer realizing its responsibility to establish and maintain a safe workplace for its employees, will not tolerate any act(s) of violence including threatening with a weapon or other object causing one to be afraid, upset, whether physically harmed or not.
(b) Harassment – Shall be defined as any unwelcomed action by any person, male or female, whether verbal or physical on a single or repeated basis, which humiliates insults or degrades. The Employer will use neither tolerate nor condone behavior that is likely to undermine the dignity and self-esteem of one individual or allow the creation of an intimidating, hostile or offensive environment for its best efforts to make all affected direct care employees aware employees. Harassment may be racial, including unwanted comments, racist statements, slurs and jokes over a period of residents who have serious infectious diseases. The time including racist graffiti and literature, or sexual, meaning any unwanted attention of a sexual nature such as remarks about appearance or personal life, offensive written or visual action by graffiti or degrading pictures, contact of the disease need not be disclosed. Employees who are not direct care employees will be made aware of special procedures required of them to deal with these circumstances. Employees who are not direct care employees will be made aware of special procedures required of them to deal with these circumstances. 25.07 The parties agree that if incidents involving aggressive patient action occur, such action will be recorded and reviewed at the Occupational Health and Safety Committee.

24.05 The Union agrees to endeavour to obtain the full co- co-operation of its membership in the observation of all safety rules and practices. Employees on the premises are required ARTICLE JO B CLASSIFICATION AND RATES: Attached hereto and forming part of this Agreement is Schedule "A" relating to respond Job Classification and minimum and maximum rates of pay for all employees, subject to the Retirement Residence fire alarm by proceeding directly to their appointed postprovisions of this Agreement. Failing to do so may result in disciplinary action.
24.06 The Employer A job classification will use its best efforts to make all affected direct care employees aware not be changed for the purpose of residents who have serious infectious diseases. The nature evading payment of the disease need not minimum rates herein set out, but in the event of necessity and after consultation with the Union, the right is reserved to the Employer to create new classifications or to abolish or otherwise vary present classifications and to fix rates accordingly. If there are new classifications created, old classifications varied or abolished, involving the fixing of rates, the same shall be disclosed. Employees who are not direct care employees will be made aware of special procedures required of them subject to deal with these circumstances. (iii) ensure that the applicable measures and procedures prescribed in the Occupational Health and Safety Act are carried out in the workplace.
30.08 A worker shall,
(a) work in compliance with the provisions of the Occupational Health and Safety Act and the regulations;
(b) use or wear the equipment, protective devices or clothing that the worker's employer requires to be used or worn;
(c) report to his or her employer or supervisor the absence of or defect in any equipment or protective device of which the worker is aware and which may endanger himself, herself or another worker; and
(d) report to his or her employer or supervisor any contravention of the Occupational Health and Safety Act or the regulations or the existence of any hazard of which he or she knows.

24.06 The Employer will use its best efforts to make all affected direct care employees aware of residents who have serious infectious diseases. The nature of the disease need not be disclosed. Employees who are not direct care employees will be made aware of special procedures required of them to deal with these circumstances. The parties agree that all employees are aware of the requirement to practice universal precautions in all circumstances.

Health and Safety Committee. 24.01 37:01 The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the home, in order to prevent injury and illness.
24.02 37:02 A joint management and employees health and safety committee shall be constituted with representation of at least half by employees from the various bargaining unit and of employees who are not represented by the union, units which shall identify potential dangers, recommended recommend means of improving the health and safety programs and obtaining information from the Employer or other persons respecting the identification of hazards and standards elsewhere. The committee shall normally meet at least once a month. Scheduled time spent in such meetings is to be considered time worked. Minutes shall be taken of all meetings and copies shall be sent to the Employer and to the Union. There shall be two (2) representatives on the Committee from the Unifor bargaining unit, one of whom shall be certified.
24.03 Two representatives of 37:03 There shall be two co-chairs for the joint health and safety committee, ; one from management selected by the employees by the various bargaining units and one from the employees on a rotating basis designated selected by the employees, shall make monthly management. Monthly inspections of the work place and equipment shall be carried out in accordance with the Occupational Health and shall report Safety Act RSO 1990 and results reported to the health Health and safety committee the results of their inspectionSafety Committee. In the event of accident or injury, such representatives shall be notified immediately and shall investigate and report as soon as possible to the committee and to the Employer on the nature and causes of the accident or injury. Furthermore, such representatives representative must be notified of the inspection of a government inspector and shall have the right to accompany him on his inspections. Scheduled time spent in all such activities shall be considered as time worked.
24.04 37:04 Each year on April 28 at 11:00 a.m. one minute of silence may be observed in memory of workers killed or injured on the job. The Joint Health Union and Safety Committee and the representa- tives thereof Employer agree resident safety shall have reasonable access to the annual summary of data from The Workers' Compensation Board relating to the number of work accident fatalities, the number of lost workday cases, the number of lost workdays, the number of non-fatal cases that required medical aid without lost workdays, the incidence of occupational injuries, and such other data, as The Workers' Compensation Board may decide to disclosenot be affected.
24.05 37:05 The Union agrees to endeavour to obtain Employer recognizes the full co- operation of its membership in the observation safety concerns of all safety rules staff and practicesshall provide all employees whose work requires them to wear protective equipment with the necessary equipment and protective clothing. Employees This committee may make recommendations on such equipment (e.g. gloves, long sleeved gowns, masks, goggles). These shall be maintained and replaced, where necessary, at the premises Employer’s expense. Reasonable steps within the control of the requirement Employer will follow to practice universal precautions address the legitimate health and safety concerns in all circumstancesthat forum. The parties further agree that suitable subjects at the Joint Labour Management Committee will include aggressive residents.

24.02 A joint management (b) Recognizing its responsibilities under the applicable legislation, the Hospital agrees to accept as a member of its Accident Prevention Health and employees health and safety committee shall be constituted with representation of Safety Committee at least half one representative selected or appointed by employees the Union from the amongst bargaining unit and of employees who are not represented by the union, which employees.

24.04 The Joint Accident Prevention - Health and Safety Committee in accordance with the foregoing shall be granted and time so spent attending such meetings shall be granted and deemed to be work time for which the representa- tives thereof representative(s) shall have reasonable access to be paid by the annual summary of data from The Workers' Compensation Board relating to the number of work accident fatalities, the number of lost workday cases, the number of lost workdays, the number of non-fatal cases that required medical aid without lost workdays, the incidence of occupational injuries, and such other data, Hospital at his regular or premium rate as The Workers' Compensation Board may decide to disclosebe applicable.
24.05 (g) The Union agrees to endeavour to obtain the full co- co-operation of its membership in the observation of all safety rules and practices.
(h) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee's physician, the pregnancy may be at risk. Employees on If such a transfer is not feasible, the premises pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred to in Article 12.06.
(i) Where the Hospital identifies high risk areas where employees are required exposed to respond Hepatitis B, the Hospital will provide, at no cost to the Retirement Residence fire alarm by proceeding directly to their appointed post. Failing to do so may result in disciplinary actionemployees, a Hepatitis B vaccine.
