HOLIDAYS AND SUNDAYS. A. The Employer agrees that the following days shall be holidays. When a holiday falls on a Sunday, the following Mon­ day shall be observed. New Year’s Day Labor Day Easter Monday Thanksgiving Day Memorial Day Christmas Day Independence Day 1. Work may be performed on any o f the hereinabove men­ tioned holidays, however, work as such shall be compensated for at the rate of double the employee’s regular straight time rate of pay, which shall be over and above the full time pay as provided. B. It is further agreed that the work week during which a holiday occurs, in accordance with this Agreement, shall be considered a four (4) day week consisting of thirty-two (32) straight time hours, for which the employee shall be paid forty (40) hours’ pay if they qualify under Section 8-C. All time worked over thirty-two (32) hours during said holiday week shall be compensated for at the overtime rate of time and one- half ( i ) except that an employee may work forty (40) hours at straight time in addition to his or her holiday pay, provided it is mutually agreed upon between Employer and employee. a. All part time employees, upon completion of sixty (60) days but less than one (1) year of continuous service with the Employer, shall be paid four (4) hours’ holi­ day pay at straight time hourly rate, provided one of the holidays listed in Paragraph A above falls on a day he or she would normally be scheduled to work. b. All part time employees with one (1) or more years of continuous service, regardless of whether they are normally scheduled to work on the day on which the holiday falls, shall receive holiday pay for four (4) hours. c. In either case the employee shall: (1) Work his or her scheduled work day before and af­ ter such holiday, Sunday excepted; and (2) Work at least one (1) day during the said holiday week. A. Full time employees with one or more years of continu­ ous service shall be granted vacations as follows: d. Work schedules shall not be changed for the purpose of avoiding holiday pay. C. No employee shall receive pay for any holidays not worked unless such employee has reported for work on his or her regular work day next preceding and next following said holiday. Employees shall be deemed to have reported for work if absence on the day before or the day after said holiday is due to express permission from or action of the Employer, or death in the immediate family, and also in case of certified illness, but in any event, employees off one (1) full week before a holi­ day and one (1) full week after a holiday would not be en­ titled to holiday pay, unless otherwise provided for in this Agreement. D. If any work is performed on Sunday, it shall be paid for at double time over and above the full time pay already pro­ vided. E. Sunday work shall be assigned on the basis of seniority within the store. In the event the Employer cannot schedule the necessary number of employees on voluntary basis then the employees in reverse order of seniority shall be obligated to work.

(3) In either case case, in order to receive holiday pay the employee shallmust: (1a) Work his or her the scheduled work day before and af­ ter after such holiday, Sunday excepted; and (2b) Work at least one (1) day during the said holiday week. Sunday work shall be assigned on the a rotating basis of by seniority within the storestore by job classification. In the event the Employer cannot schedule the necessary number of employees on a voluntary basis basis, then the employees in reverse order of seniority shall be obligated to work. Section 7. In the Meat Department, Sunday and/or Holiday work in each store shall be rotated among qualified employees within the classification required by the Employer to perform the work. The work heretofore performed by part time employees shall be first offered to full time employees. The work so offered shall not be deemed to fall within the daily hourly guarantee of this contract. If full time employees refuse the work it may then be offered to part time em­ ployees. If scheduled employees refuse such work then the least senior employee within the classification will be required to do the work.

A shift worker who is rostered off duty on any of the holidays specified in subclause (i) of this Clause, shall be over and above entitled to in respect of such holiday, payment of an additional day's pay for the full time pay as provided. B. It is further agreed that the work week during period in which a such holiday occurs, or by mutual agreement, an additional day’s leave may be added to the employees period of annual leave. v. The term "rostered off duty" in accordance with this Agreement, shall be considered a four subclause (4iv.) day week consisting of thirty-two (32) straight time hours, for which refers to days where the employee shall be paid forty (40) hours’ pay if they qualify under Section 8-C. E. Employees may use personal days for absence due to illness not otherwise compensated for under this Agreement. F. Such holidays shall be paid on the basis of five (5) hours pay for part time and eight (8) hours pay for full time. 12.6 Work schedules shall not be changed for the purpose of avoiding holiday pay. C. 12.7 No employee shall receive pay for any holidays not worked unless such employee has reported for work on his or her regular work day next preceding and next following said holiday. It is further agreed that the work week during which a holiday occurs, paid for hours worked in accordance with this Agreement, shall be considered a four (4) day week consisting excess of thirty-two (32) straight hours in a holiday week if a full-time hours, for which employee notifies the employee shall store manager of the desire to be paid forty (40) hours’ pay if they qualify under Section 8-C. All time worked over scheduled only thirty-two (32) hours during said hours. C-l. Sunday and holiday week work shall be compensated for at the overtime rate of time and one- half ( i ) except that an employee may work forty (40) hours at straight time in addition to his or her regular five (5) day workweek. Sunday and holiday paywork will be offered on a rotating basis from a volunteer list of full-time and part-time employees on an equal basis who have the experience and ability to perform the work. If no volunteers are available to do the work, provided it is mutually agreed upon between Employer and employeeemployees will be assigned to work by inverse seniority. a. All part D. If the store is closed on Veterans Day, the holiday will be celebrated on the day the store is closed. If the store is open for business on Veterans Day, the employee will work such day, if scheduled and have another day off in such week. In such case where the store is open, full-time employees, upon completion of sixty (60) days but less than one (1) year of continuous service em­ ployees who qualify for holiday pay in accordance with the Employerprovisions of Article X “C” shall receive eight (8) hours straight-time pay in addition to pay for the hours worked. However, if a veteran desires Veterans Day as his holiday to participate in Veterans Day activity, the Employer will schedule him off that day. E. Part-time employees who have completed six (6) months of employment from date of hire or last date of re­ hire and who have worked their scheduled hours the week prior to the week in which any one of the holidays occur, shall be paid entitled to holiday pay which shall be computed on a pro-rata basis using the four (4) hours’ holi­ day pay at straight time hourly rate, provided one of the holidays listed in Paragraph A above falls on a day he or she would normally be scheduled preceding weeks to work. b. All part time employees with one (1) or more years of continuous service, regardless of whether they are normally scheduled to work on the day on which the holiday falls, shall receive holiday pay for four (4) determine their average hours. c.
