HOLIDAYS AND SUNDAYS. A. The Employer agrees that the following days shall be holidays. When a holiday falls on a Sunday, the following Mon­ day shall be observed. New Year’s Day Labor Day Easter Monday Thanksgiving Day Memorial Day Christmas Day Independence Day 1. Work may be performed on any o f the hereinabove men­ tioned holidays, however, work as such shall be compensated for at the rate of double the employee’s regular straight time rate of pay, which shall be over and above the full time pay as provided. B. It is further agreed that the work week during which a holiday occurs, in accordance with this Agreement, shall be considered a four (4) day week consisting of thirty-two (32) straight time hours, for which the employee shall be paid forty (40) hours’ pay if they qualify under Section 8-C. All time worked over thirty-two (32) hours during said holiday week shall be compensated for at the overtime rate of time and one- half ( i ) except that an employee may work forty (40) hours at straight time in addition to his or her holiday pay, provided it is mutually agreed upon between Employer and employee. a. All part time employees, upon completion of sixty (60) days but less than one (1) year of continuous service with the Employer, shall be paid four (4) hours’ holi­ day pay at straight time hourly rate, provided one of the holidays listed in Paragraph A above falls on a day he or she would normally be scheduled to work. b. All part time employees with one (1) or more years of continuous service, regardless of whether they are normally scheduled to work on the day on which the holiday falls, shall receive holiday pay for four (4) hours. c. In either case the employee shall: (1) Work his or her scheduled work day before and af­ ter such holiday, Sunday excepted; and (2) Work at least one (1) day during the said holiday week. A. Full time employees with one or more years of continu­ ous service shall be granted vacations as follows: d. Work schedules shall not be changed for the purpose of avoiding holiday pay. C. No employee shall receive pay for any holidays not worked unless such employee has reported for work on his or her regular work day next preceding and next following said holiday. Employees shall be deemed to have reported for work if absence on the day before or the day after said holiday is due to express permission from or action of the Employer, or death in the immediate family, and also in case of certified illness, but in any event, employees off one (1) full week before a holi­ day and one (1) full week after a holiday would not be en­ titled to holiday pay, unless otherwise provided for in this Agreement. D. If any work is performed on Sunday, it shall be paid for at double time over and above the full time pay already pro­ vided. E. Sunday work shall be assigned on the basis of seniority within the store. In the event the Employer cannot schedule the necessary number of employees on voluntary basis then the employees in reverse order of seniority shall be obligated to work.

If an employee is required to work on any o f the hereinabove men­ tioned holidaysa holiday, however, work as such compensation shall be compensated for at the rate of double time and one-half (IV2) the employee’s regular straight time rate of pay, which shall be over and above in addition to the full time holiday pay as provided. B. It is further agreed that the Section 2. (2) All part time employees with one (1) or more years of continuous service, regardless of whether they are normally scheduled service shall be entitled to work holiday pay based on the number of hours regularly worked by the employee on that day if the holi­ day falls on which the holiday falls, shall receive a regularly scheduled work day; or holiday pay for of four (4) hourshours if the holiday falls on a non-scheduled day at straight time. c. (3) In either case case, in order to receive holiday pay the employee shallmust: (1a) Work his or her the scheduled work day before and af­ ter after such holiday, Sunday excepted; and (2b) Work at least one (1) day during the said holiday week. Section 5. Hours and/or days which qualify for Sunday or holiday premium pay shall not be included in computing weekly overtime. There shall be no pyramiding of overtime and/or premium pay. Hours worked on Sundays or holidays shall be in addition to the normally scheduled work week. Section 6. Sunday work shall be assigned on the a rotating basis of by seniority within the storestore by job classification. In the event the Employer cannot schedule the necessary number of employees on a voluntary basis basis, then the employees in reverse order of seniority shall be obligated to work. Section 7. In the Meat Department, Sunday and/or Holiday work in each store shall be rotated among qualified employees within the classification required by the Employer to perform the work. The work heretofore performed by part time employees shall be first offered to full time employees. The work so offered shall not be deemed to fall within the daily hourly guarantee of this contract. If full time employees refuse the work it may then be offered to part time em­ ployees. If scheduled employees refuse such work then the least senior employee within the classification will be required to do the work.

HOLIDAYS AND SUNDAYS. A. The Employer agrees that i. Employees shall be entitled to the following day or days shall be holidaysobserved in lieu thereof as holidays without loss of pay: New Year’s Day, Australia Day, Good Friday, Easter Saturday, Easter Monday, Anzac Day, Queens Birthday, Labour Day, Christmas Day, Boxing Day, and the Union Picnic Day. ii. When a Employees required to work on any such holiday falls on a Sunday, the following Mon­ or picnic day shall be observed. New Year’s Day Labor Day Easter Monday Thanksgiving Day Memorial Day Christmas Day Independence Day 1. Work may be performed on any o f the hereinabove men­ tioned holidays, however, work as such shall be compensated for paid at the rate of double time and one half for all time worked on that day, with the employee’s regular straight time exception of Christmas day, Good Friday and Easter Monday, which will be paid at triple time. Employees required to work on Sunday shall be paid at the rate of paydouble time for all time worked. iii. Any employee who is absent without leave or without reasonable excuse on the working day preceding or the working day succeeding a public holiday including Union Picnic Day, which shall not be entitled to payment of such holiday. iv. A shift worker who is rostered off duty on any of the holidays specified in subclause (i) of this Clause, shall be over and above entitled to in respect of such holiday, payment of an additional day's pay for the full time pay as provided. B. It is further agreed that the work week during period in which a such holiday occurs, or by mutual agreement, an additional day’s leave may be added to the employees period of annual leave. v. The term "rostered off duty" in accordance with this Agreement, shall be considered a four subclause (4iv.) day week consisting of thirty-two (32) straight time hours, for which refers to days where the employee shall be paid forty (40) hours’ pay if they qualify under Section 8-C. All time worked over thirty-two (32) hours during said holiday week shall be compensated for at the overtime rate of time and one- half ( i ) except that an employee may work forty (40) hours at straight time in addition to his or her holiday pay, provided it is mutually agreed upon between Employer and employee. a. All normal rostered off as part time employees, upon completion of sixty (60) days but less than one (1) year of continuous service with the Employer, shall be paid four (4) hours’ holi­ day pay at straight time hourly rate, provided one of the holidays listed in Paragraph A above falls on a day he or she would normally be scheduled to work. b. All part time employees with one (1) or more years of continuous service, regardless of whether they are normally scheduled normal rotating shift roster. It does not apply if the Company decides not to work on that day. Where the day Company decides not to work on which the holiday falls, shall receive holiday pay for four (4) hours. c. In either case the employee shall: (1) Work his or her scheduled work day before and af­ ter such any public holiday, Sunday excepted; and (2) Work at least one (1) day during the said holiday week. B. 12.2 It is further agreed that the work week during which a holiday holi­ day occurs, in accordance with this Agreement, shall be considered a four (4) day week consisting of thirty-two (32) straight time hours, for which the employee shall be paid forty (40) hours’ hours pay if they qualify under Section 8-C. Article 12.8. All time worked over thirty-two (32) hours during said holiday week shall be compensated for at the overtime rate of time and one- one-half ( i ) except that an employee (IV2). All employees may work forty (40) hours at straight time in addition to his or her holiday pay, provided it is mutually agreed upon between Employer and employee. Part time employees may work five (5) days in a holiday week by mutual agreement. a. 12.3 All part time employees, upon completion of sixty six (606) days months but less than one (1) year of continuous service with the Employer, shall be paid four (4) hours’ entitled to holiday pay as set forth in this paragraph wheri s»',i holi­ day pay at straight time hourly rate, provided one of the holidays listed in Paragraph A above falls on a day he or she would normally be their scheduled to workwork day, based on the number o f hours regularly worked by such employee on that day. b. 12.4 All part time employees with one (1) or more years of continuous service, regardless of whether they are normally scheduled con­ tinuous service shall be entitled to work holiday pay based on the number of hours regularly worked by the employee on that day on which if the holiday falls, shall receive falls on a regularly scheduled work day; or holiday pay for of four (4) hourshours at straight time if the holiday falls on a non-scheduled day. c. In either case the employee shall: (1) Work his or her scheduled work day before and af­ ter such holiday, Sunday excepted; and (2) Work at least A. Employees shall receive one (1) personal day during the said holiday weekoff with pay for each six (6) months of service up to a maximum of two (2) days per anniversary year. A. Full time employees with one or more years B. Personal days may be used for the purpose of continu­ ous service mini-vacations. Employees shall be granted vacations as follows:entitled to such days at a time of their choice sub­ ject to store seniority preference in the event of conflict of employee choice. d. C. The Employee shall notify the Store Manager at least two (2) weeks in advance of his intention to take a personal day off and the employee shall receive such day off or a mutually agreed upon day off. In the event of a conflict of employee choice, seniority shall prevail. D. An employee who separates or is separated from the Employer’s service, voluntarily or involuntarily (including but not limited to separa­ tion occasioned by voluntary or involuntary termination of the Employer’ s business), except when such employee is duly discharged for dishonesty, shall on separation, be paid for unused personal days on a pro-rata basis. E. Employees may use personal days for absence due to illness not otherwise compensated for under this Agreement. F. Such holidays shall be paid on the basis of five (5) hours pay for part time and eight (8) hours pay for full time. 12.6 Work schedules shall not be changed for the purpose of avoiding holiday pay. C. 12.7 No employee shall receive pay for any holidays not worked unless such employee has reported for work on his or her regular work day next preceding and next following said holiday. Employees Employee shall be deemed to have reported for work if absence absent on the day before or the day after said holiday is due to express permission from or action of the Employer, or death in the immediate family, family and also in case of certified illness, but in any event, employees off one (1) full week before a holi­ day holiday and one (1) full week after a holiday would not be en­ titled entitled to holiday pay, unless otherwise provided for in this Agreement. Pro­ vided, however, that in all events the employee must work at least one (1) day during the week in which the holiday falls in order to qualify for holiday pay. D. If any work is performed on Sunday, it 12.8 Hours and/or days which qualify for Sunday or holiday premium pay shall not be included in computing weekly overtime. There shall be paid for at double time over and above no pyramiding of overtime and/or premium pay. Hours worked on Sundays or holidays shall be in addition to the full time pay already pro­ vidednormally scheduled work week. E. 12.9 In the Grocery Department, Sunday and holiday work shall be assigned on the a rotating basis of by seniority within classification and ability to do the storework considered. In the event the Employer cannot schedule the necessary number of employees on a voluntary basis basis, then the employees in reverse order of seniority shall be obligated to work. Sunday and holiday rotation shall be done from separate lists. 12.10 In the Meat Department, Sunday and/or holiday work in each store shall be rotated among qualified employees within the classification required by the Employer to perform the work. The work heretofore performed by part time employees shall be first offered to full time employees. The work so offered shall not be deemed to fall within the daily hourly guarantee of this contract. If full time employees refuse the work it may then be offered to part time employees. If scheduled employees refuse such work then the least senior employee within the classification will be required to do the work. 12.11 Full time employees with less than ninety (90) days service shall not be entitled to holiday pay. Thereafter, full time employees shall be entitled to holiday pay based on an eight (8) hour day.

Employees hired on or after September 29, 1980 j X shall be compensated at the employee’s regular straight time rate of time and one-half (li/2) their straight-time hourly rate for all work performed on Sundays and holidays under this contract. C. During the week in which one of the above holidays occur, full-time employees who work the scheduled workday before and the scheduled workday after the holiday shall receive eight (8) hours pay in addition to the hours worked. Any full-time employee who works part of the week and then is absent due to proven illness or any emergency beyond his control, will also receive the holiday pay. An employee on vacation or serving on jury duty during a holiday week will also receive the holiday pay. Overtime at the rate of time and one-half (11/2) will not be paid in holiday weeks until the time actually worked exceeds the normal workweek. During a holiday week, which full-time employees at their option may work thirty-two (32) hours and receive an additional eight (8) hours holiday pay. Overtime shall be over and above the full time pay as provided. B. It is further agreed that the work week during which a holiday occurs, paid for hours worked in accordance with this Agreement, shall be considered a four (4) day week consisting excess of thirty-two (32) straight hours in a holiday week if a full-time hours, for which employee notifies the employee shall store manager of the desire to be paid forty (40) hours’ pay if they qualify under Section 8-C. All time worked over scheduled only thirty-two (32) hours during said hours. C-l. Sunday and holiday week work shall be compensated for at the overtime rate of time and one- half ( i ) except that an employee may work forty (40) hours at straight time in addition to his or her regular five (5) day workweek. Sunday and holiday paywork will be offered on a rotating basis from a volunteer list of full-time and part-time employees on an equal basis who have the experience and ability to perform the work. If no volunteers are available to do the work, provided it is mutually agreed upon between Employer and employeeemployees will be assigned to work by inverse seniority. a. All part D. If the store is closed on Veterans Day, the holiday will be celebrated on the day the store is closed. If the store is open for business on Veterans Day, the employee will work such day, if scheduled and have another day off in such week. In such case where the store is open, full-time employees, upon completion of sixty (60) days but less than one (1) year of continuous service em­ ployees who qualify for holiday pay in accordance with the Employerprovisions of Article X “C” shall receive eight (8) hours straight-time pay in addition to pay for the hours worked. However, if a veteran desires Veterans Day as his holiday to participate in Veterans Day activity, the Employer will schedule him off that day. E. Part-time employees who have completed six (6) months of employment from date of hire or last date of re­ hire and who have worked their scheduled hours the week prior to the week in which any one of the holidays occur, shall be paid entitled to holiday pay which shall be computed on a pro-rata basis using the four (4) hours’ holi­ day pay at straight time hourly rate, provided one of the holidays listed in Paragraph A above falls on a day he or she would normally be scheduled preceding weeks to work. b. All part time employees with one (1) or more years of continuous service, regardless of whether they are normally scheduled to work on the day on which the holiday falls, shall receive holiday pay for four (4) determine their average hours. c.
