Nothing contained herein shall be construed as preventing the Employer from restructuring the normal workday or workweek as necessary to promote efficiency or improve services, or from establishing the work schedules of employees. All overtime shall have prior supervisory approval, except when it is necessary for a nurse to remain on duty to protect patient safety. Only hours actually worked are counted for the purpose of computing an employee's eligibility for overtime pay. There shall be no pyramiding of hours or pay. Section 15.4 The Board serves individuals 24 hours per day, 7 days per week. To meet this need for service to our individuals evening and weekend hours may be required of any bargaining unit employee. The Employer will establish the standard work day as beginning at 6:00 a.m. and ending at 5:59 a.m. and starting and ending times for each shift in each department. Supervisors will establish daily workschedules. Section 15.5 Absent an emergency situation, management will notify the Union in the event management intends to institute a long-term change in the present shift times for nurses. Following notification and upon request by the Union, management will meet with the Union to discuss the reason for the change and possible alternatives.

All employees covered under the terms of this Agreement shall sign in/clock in on or prior to their starting time. All employees will use the digital time clock system that the library utilizes. Employees clocking in for remote work, may do so from an IP address outside of the library. Employees reporting for work at a library location must clock in from an IP address at the library itself. Employees may be asked to also fill out and submit physical time sheets in addition to the digital timesheet system. Section 14.12. Section 19.4 Equal Opportunity of Overtime When overtime is required each qualified employee will have an equal opportunity of any bargaining unit overtime in each department, headquarters and specialty crews by seniority/rotation. If there is a lack of volunteers, then the job is assigned by reversed seniority to the least senior qualified employee. In an emergency this section is suspended. The Employer remedy for the first missed overtime opportunity will establish be that the standard next overtime opportunity will be offered to the missed qualified employee. This remedy will be repeated until the missed employee has been offered the opportunity to make up the same number of overtime hours missed. If the same supervisor is responsible for repeated mistakes in working the overtime call-outs, the union will be able to expand its remedy sought through the grievance procedure. Section 19.5 Call Back/Call-in Pay When an employee has been released from work day as beginning and is required to come back into work, they shall be paid for four (4) hours at 6:00 a.m. the overtime rate or for the actual hours worked at the overtime rate, whichever is greater. When an employee is required to report to work and ending at 5:59 a.m. is required to work into their regular shift, the employee will be paid in accordance with the overtime guidelines and WILL NOT receive Call Back/Call-in Pay. HOURS OF WORK & OVERTIME. Section 15.1 This Article is intended to define the normal hours of work per day or per week in effect 7.1 Overtime at the rate of time of execution of this Agreement. Section 15.3 Bargaining unit employees who are not exempt from the provisions of the Fair Labor Standards Act will be paid one and one-half times their normal (1½) the employee’s base hourly rate of pay for their classification of work shall be paid under the following conditions: 7.1.1 For all hours actually worked in excess of forty (40) hours per week. 7.1.2 Employees will not be sent home early on regular scheduled shifts, to avoid paying overtime. 7.1.3 Under no circumstances shall there be any pyramiding of overtime pay under this Agreement. 7.1.4 It is intended by the parties that Employees work week. All a reasonable amount of daily and/or weekend overtime when required by the Company. 7.1.5 No overtime shall have prior supervisory approvalbe paid unless authorized by the Employer. 7.2 The Employer shall distribute overtime by seniority as long as the employee is qualified to perform the overtime work. On-Call Duty 7.3.1 The Company will determine when on-call after-hours technicians are needed to support the business. The Company will post a bi-monthly (every 2 months) list, except when it which will allow employees to volunteer for after-hours on-call duty. The senior most qualified employee who volunteers will be offered the first opportunity to work said overtime. The Company shall continue to offer the overtime work by seniority until the seniority list is necessary for a nurse to remain on exhausted. At the point, the seniority list is exhausted and open weeks remain, the employer will assign on-call duty to protect patient safety. Only hours actually worked are counted in inverse seniority order for the purpose unfilled weeks. Employees will be permitted to work two (2) weeks of computing on-call duty per month for the period posted. 7.3.2 Employees performing after hour’s on-call duty will be paid an employee's eligibility additional one hundred seventy-five dollars ($175.00) for overtime paythat pay week for performing the duty. HOURS OF WORK & OVERTIME. Section 15.1 This Article 17.1 The current shift schedules shall be maintained. Any future changes and the reasons therefore shall be communicated to the Union in advance. 17.2 Effective October 1, 2010, qualified employees within each classification will be assigned to shifts on the basis of seniority and employee preference. Newly hired employees and employees changing classification will be assigned to shifts by the Employer. (a) The Company will endeavour to equitably distribute overtime among the senior employees who normally perform the work and are willing to perform the work. (b) Where an employee accepts additional hours prior to the commencement of his scheduled shift and fails to complete his regular shift on that day he will not be offered any such additional hours for ten (10) working days thereafter. 11.10 When the Company finds it necessary to go to a sec- ond shift operation they will first ask for volunteers. Should enough volunteers not be available, the Company will use re- verse seniority by the job to secure the required number of employees. When new employees have been trained the em- ployee who has been transferred to the second shift, will be returned to the day shift if he so requests. The training period shall not exceed the probationary period. Employees may ap- ply to be transferred from one shift to another. Such applica- tions shall be honoured before new employees are hired. 11.11 The Company agrees that anytime there is a short- age of hours in a plant, part-time employees and students in that plant shall always be laid off first. For the purpose of this Article only, a “plant” is defined as follows: 11.12 Plant employees working twelve (12) continuous hours or more shall receive two (2) times their normal hourly rate for all hours actually worked in excess of twelve (12) continuous hours. Drivers working thirteen (13) continuous hours or more shall receive two (2) times their hourly rate for all hours worked in excess of thirteen (13) continuous hours. 11.13 The Company will schedule the most senior employ- ees to start on the early or first shift if so desired; no senior employee will be required to start later because of only working eight (8) hours. 11.14 The Company will guarantee each employee thirty- six (36) hours of work each week subject to the following conditions: (a) Any hours of work offered and refused by an employee will be deducted from the guarantee (b) Time missed due to illness or layoff of one day or more will be deducted from the guarantee (c) An act of God which prevents the Company from op- erating such hours will be deducted from the guaran- tee (d) Statutory Holiday hours will be considered hours of work and will be deducted from the guarantee (a) The Chief Xxxxxxx will be provided with schedules of hours for each plant department setting forth the nor- mal times for work to begin and end on every day in the week for the department, or for groups or individu- als within the department. The timing and need for such possible change will be negotiated with the Negotiating Committee. 6.03 Overtime hours will be considered as any hours worked in excess of the normal hours per week forty (40) as expressed in Section 6.01, and all time worked in excess of the Employee's regularly assigned number of hours in any week, but is prevented from working his/her full working week by the intervention of a plant holiday, scheduled vacation, jury or subpoenaed witness duty, bereavement leave, approved union leave for union executive, or by the failure of the Company to provide him/her with work. (a) Overtime payment will be at one and one half (1 1/2) times the Employee's regular hourly rate for all overtime hours worked, except as provided for in (b) following. (b) Overtime payment will be at two (2) times the Employee's regular hourly rate for overtime hours worked between 11:00 pm Saturday and 11:00 pm Sunday.
