HOURS OF WORK & OVERTIME. 10.01 The regular work week for full-time employees shall normally consist of forty (40) hours consisting of five (5) days of eight (8) hours or four (4) days of ten (10) hours, from Sunday to Saturday. The maximum is five (5) hours for eight (8) hour shifts and three (3) hours for ten (10) hour shifts. This shall not trigger Extra Day overtime on any specific shift. The employer reserves the right to call Extra Day overtime on any specific shift. Employee will be assigned to functions based on overall seniority and qualification. The Company agrees that work will normally be performed by the bargaining unit employees, provided that such work can be performed at regular rates of pay. If work cannot be performed at the regular hourly rate, the Company reserves the right to have the work performed by employees outside of the bargaining unit. Notwithstanding the above, the Company also reserves the right to have work performed on an overtime basis. In the event that the Company elects to have work performed on an overtime basis, such overtime for full-full time employees shall be voluntary and may be offered as hereinafter provided.
(b) Overtime shall be on a voluntary basis.basis in the following order;

(c) Early Start Not withstanding paragraph 10.06 (a) overtime to be performed on a “run” is to be performed by the Driver who has been assigned to that “run”. Such overtime is not voluntary.

(e) For the purpose of paragraph 10.06 (b), an employee who is filling a temporary vacancy shall be deemed to be an employee who normally performs the work in advance of their regular start time on their specific shift. HOURS OF WORK & OVERTIME. 10.01 9.01 The regular work week shall commence at midnight Saturday-Sunday and all work performed in a shift or other similar work period (including any extension thereof) is deemed to have been performed in the same day in which the majority of hours are worked.
9.02 Time worked shall be calculated in units of fifteen (15) minutes and periods of work of less than fifteen (15) minutes per day shall be disregarded.
9.03 The basic work week for regular full-time employees shall normally consist of either five (5) eight (8) hour days or four (4) ten (10) hour shifts totalling forty (40) hours consisting in a week. Where
9.04 Overtime at the rate of five one and one-half (51.5) days will be paid for all hours worked in excess of an employee’s eight (8) or ten (10) hour day or on a scheduled day off. An employee who works on his second scheduled day off after having worked eight (8) or ten (10) hours on his first scheduled day off, shall be compensated at the rate of double time for hours worked on the second day.
9.05 Every employee shall be paid at the rate of time and one-half (1.5) times his hourly rate for all work performed by him and required by the Company on a day which is observed as a paid holiday under the provision of Article 10 hereof. In addition to the forgoing, each employee shall be entitled to take another day off with pay, in lieu of the holiday, at a time as mutually arranged with his Supervisor.
9.06 Where it is anticipated that any employee will perform additional work required by the Company for a period of one-half (1/2) hour or more immediately following his normal work period of eight (8) hours or four (4) days of ten (10) hours, from Sunday to Saturday. It is understood that as the Company retains the right to establish various shift configurations not specifically provided for hereincase may be, provided that such shifts are in accordance with applicable legislation. It is understood that the implementation of such shifts shall not occur without prior discussion with the Union. Further, nothing herein he shall be construed as granted a guarantee rest period of daily or weekly hours to be worked or paidfifteen (15) minutes, unless specifically provided forwith pay, before commencing such additional work.
(a) Starting and quitting times and the arrangements 9.07 Where any period of shifts shall be determined by the Company.
(b) The Company shall provide an employee with a minimum of additional work referred to in clause 9.06 hereof will continue for more than two (2) weeks noticeconsecutive hours, prior the employee shall, after having worked for two (2) hours, be given a break of one-half (1/2) hour, without pay, to moving enable him to have a meal. If he shall not have had at least twenty-four (24) hours' notice that such additional work would be required, the Company shall provide the meal, up to a value of $5.00, plus tax, without charge to the employee. If such additional work continues for more than two (2) consecutive hours following resumption of work after the meal break, the employee from shall be granted an additional rest period of fifteen (15) minutes, with pay.
9.08 Every employee will be allowed one (1) paid rest period of fifteen (15) minutes during each one-half (1/2) shift. Rest periods will be arranged as near the mid-point of each one-half (1/2) shift to anotheras possible. Every employee will be allowed a one-half (1/2) hour unpaid lunch period during his shift.
(i. e. days to nights; days to afternoons etc.) or when 9.09 Where an employee has left the Company's Plant on completion of his day's work and is moving then called by the Company and requested to another location return to work at a time before the commencement of his next schedule day's work, such request shall constitute a "call- out.” An employee reporting for work on a permanent basis"call-out" shall be entitled to be paid for work performed by him outside his scheduled working hours at the rate of one and one-half (1½) times his hourly rate or four (4) hours' work at his hourly rate, whichever is greater.

10.03 9.10 An employee who is scheduled to work, and who reports for work as at his scheduled time, not having been previously notified to the contrary and who completes his scheduled shift, shall be guaranteed his scheduled hours of work for that day or pay, at his regular rate of pay, in lieu of work. This provision shall not apply in the event of an act of God in which case the employee shall be guaranteed four (4) hours work or pay in lieu of work.

If an employee is absent from work with approval on a Friday, it will be presumed that he is required will be available for work on the following Monday, unless he advises the Company to workthe contrary. Therefore, should such an employee be unable to report by Monday, he must notify the Company to that effect prior to his scheduled starting time.

HOURS OF WORK & OVERTIME. 10.01
17.01 It is understood and agreed that the Company has the right to change the work schedules or the starting and quitting times to suit the varying conditions of the business. The regular Company will meet with the Union prior to implementing any change(s) for the purposes of discussing the change(s). Current arrangements shall not be construed as a guarantee of the hours nor days of work per week nor as a guarantee of working schedules. Any hours of work stated are for the purposes of calculating overtime and deductions.
17.02 Where operations are not based upon weekend shifts (e.g.. 12 hour shifts), the normal work week for full-time employees shall normally consist be made up of five (5) days, consisting of forty (40) hours consisting per week, excluding the one-half (1/2) hour unpaid lunch period. Those on a three (3) shift basis shall have a normal work week made up of five (5) days days, consisting of eight forty (8) 40) hours or four per week, including a thirty (430) days of minute paid lunch period.
17.03 Employees shall be entitled to one (1), ten (10) hoursminute rest period during each one-half (1/2) shift.
17.04 In the accommodation of lunch periods and rest periods for those designated positions associated with certain machinery or functions, from Sunday to Saturdayit is understood that such will not be left unattended and an employee(s) must remain at their position until they are relieved by a qualified replacement. Similarly, at the completion of a shift, an employee shall remain at their workstation until relieved by their replacement on the following shift or as arranged by the supervisor. If the employee is not relieved at the proper starting time of the following shift, they shall notify the shift supervisor. It is understood that employees reporting for their shift shall be at their machine or job location promptly at the beginning of the shift.
17.05 The Company retains the right to establish various shift configurations not specifically provided will pay time and one-half (1 ½) an employee's regular base hourly rate of pay for herein, provided that such shifts are all hours worked in accordance with applicable legislationexcess of an employee’s regular daily scheduled hours (i.e. 8 hours). It is understood that this provision does not apply to those working under Appendix ‘B’ (12 Hour Weekend Shifts). It is recognized that such overtime payments do not apply where the implementation work on the preceding or subsequent day are considered part of the regular starting or ending hours of an employee's shift (e.g. Sunday 11.00 PM to midnight). (Note: For certain jobs/positions, Sunday start-up hours occur before 11.00PM. In such shifts shall not occur without prior discussion with the Union. However, if an area shall be offered to employees in that area by overall bargaining unit seniority, employee (regardless of classificationhours worked) is mandated to work on a Saturday, within the specific shift where employee shall receive the manpower is required, to those who are then at work time and possess the necessary qualificationsone half pay for all hours worked on that Saturday.
(ii) In The Company will pay two times (2X) an employee's regular base hourly rate of pay for all hours worked on Sunday providing the event that there are not sufficient volunteersemployee has worked forty (40) regular hours in the week However, or if more employees are requiredan employee (regardless of hours worked) is mandated to work on a Sunday, the work employee shall receive the two (2X) times pay for all hours worked on a Sunday. It is understood that this provision does not apply to those working under Appendix ‘B’ (12 hour Weekend Shifts) or under such arrangements outlined in Article 17.
17.07 Overtime will then not be offered by bargaining unit seniority pyramided. An employee will not be entitled to overtime pay twice for the remaining same period of time worked.
17.08 Overtime is voluntary providing the Company has employees who are then at work and who possess the qualifications and ability available to perform the work.
(ca) Early Start Overtime This shall apply The Company will attempt to give an indication, where possible, when weekend work is required. In such situations, employees will indicate to their supervisor if they are asked to report to work interested in advance of their regular start time on their specific shift. The maximum is five (5) hours being considered for eight (8) hour shifts and three (3) hours for ten (10) hour shifts. This shall not trigger Extra Day overtime on any specific shift. The employer reserves the right to call Extra Day overtime on any specific shift. Employee will be assigned to functions based on overall seniority and qualification. They are considered to be in the General Warehouse classification. From that point on, Article 9.03/XXX Daily Upgrades appliessuch overtime.
