You are a Class Member and part of the Settlement if you purchased or leased in the United States or its territories, including Puerto Rico, a 2013-2016 model year Nissan Altima vehicle equipped with a CVT. Excluded from the Settlement Class are: (1) Nissan North America, Inc. That means that you fit the description of the class which the Court certified for this settlement. The Court decided that everyone who fits this description is a Class Member: All Maryland residents who applied for and obtained a RAL at any H&R Block office in Maryland from January 1, 1992 through December 31, 1996 and did not thereafter apply for and obtain a RAL subject to an arbitration provision, and all individuals who obtained a RAL from June 13, 1989 through December 31, 1996 through any “H&R Block” office in Alabama for which the Settling Defendants herein received a license fee payment or portion of the finance charge, and who did not previously request exclusion from their respective classes that were previously certified or timely request exclusion from this class. There are three other classes that are part of the overall Settlement. How do I know if I am part of the Settlement. You are a Settlement Class Member if you are an individual who purchased a concession at Climate Pledge Arena between February 27, 2023 and July 22, 2023 and were assessed a 3% fee. This 3% fee was not charged at all events held at Climate Pledge Arena during this time, nor was it charged on all concessions. You are not automatically a Class Member if you attended an event at Climate Pledge Arena during this time period and purchased concessions. If you purchased a concession at Climate Pledge Arena between February 27, 2023 and July 22, 2023, please refer to the attached Appendix, which contains a list of events where the 3% fee was charged. In general, the 3% fee was charged at most concerts, but it was not charged at Kraken games. Excluded from the Class are (i) Defendant and its officers and directors; (ii) all Settlement Class Members who timely and validly submit requests for exclusion from the Settlement Class; (iii) members of the judiciary to whom this case is assigned, their families, and members of their staff.
