How will Class Counsel be paid. If the Settlement is approved and becomes final, Class Counsel will ask the Court to award attorneys' fees and litigation costs in the amount of $150,000. Class Counsel will also request approval of an incentive award of $2,500 for the Class Representative. If approved, these amounts will be paid separately by GCPA and will not reduce the amount of total payments available to Settlement Class Members.
How will Class Counsel be paid. If the Court approves the Settlement Agreement at the Final Approval Hearing, then Class Counsel will ask the Court for an award of reasonable attorneys’ fees and costs in an amount not to exceed $356,250.
How will Class Counsel be paid. At the Fairness Hearing, further discussed in Section 8 of this Notice, Class Counsel will ask the Court to approve its application for an award of attorneys’ fees for filing the lawsuit, for all the work they have done representing the Class in reaching a settlement, and for any work that will be done to implement it. Class Counsel will ask the Court to award it attorney fees up to 25% of the total that SSA pays to the Class members. If the Court approves the award, SSA would reduce any money paid to a Class member by the percent set by the Court. Class Counsel has to file its application for an award of attorney fees at least 45 days before the “Fairness Hearing”. How will Class Counsel be paid. If the Court approves the Settlement, Class Counsel will apply to the Court for the payment of legal fees and disbursements by the Respondents in the amount of CAD $265,000, plus applicable taxes. Settlement Class Members will not be responsible for the payment of legal fees and disbursements of Class Counsel, and the payment of such fees and disbursements will not reduce any benefits to the Settlement Class Members.
