ILLNESS AND DISABILITY. 1. At the beginning of each school year, each administrator shall be credited with a fourteen (14) day sick leave allowance (effective July 1, 2015 twelve (12) day sick leave allowance) to be used for absences caused by illness or disability, or serious illness or quarantine in the family. The family will be defined as husband, wife, father, mother, son, daughter, sister, brother, grandparent, parents-in-law, sisters-in-law, brothers-in- law, sons-in-law, daughters-in-law, and grandchildren. The unused portion of such allowance shall accumulate from year to year up to an unlimited number. 2. Additional sick pay will be granted to administrators who exhaust their accumulated sick leave subject to the following conditions: a. That additional sick pay shall not extend beyond the current school year. 3. An administrator who is unable to work because of personal illness or disability and who has exhausted all sick leave available, shall be granted a leave of absence without pay for the duration of such illness or disability up to one (1) year, and the leave may be renewed each year upon written request by the administrator unless serious permanent disability shall have occurred. 4. Absence due to an on-the-job injury, but not involving personal gross negligence, will entitle the insured to supplemental compensation defined below: Supplemental compensation payable for absence necessitated by injury will be comprised of Worker’s Compensation in part, and payment of the differential by the Board to effect a combined cumulative total equal to the value of accumulated sick days. Only after this combined equivalent amount has been used up, will sick days be charged to the administrator. 5. An administrator who has been absent five (5) consecutive work days may be requested to present a doctor’s statement upon return to work. In case of prolonged illness (after ten (10) consecutive work days) the administrator must provide a report from a doctor. In addition, a pattern of absences may also require a doctor’s statement. 6. Administrators not reporting to work are to notify the Superintendent’s office by 8:00 a.m. the morning of the absence. 7. Family and Medical Leave Act will be in compliance with the Federal guidelines.

ILLNESS AND DISABILITY. 1A. A sick leave allowance is hereby provided for absence from work caused by illness or physical disability of the teacher. A teacher suffering a loss of pay as a result of having less accumulated sick leave than the length of his illness, will be reimbursed at the end of the school year for such loss as his sick leave allowance (effective July 1, 2015 twelve (12) day sick leave allowance) to be used for absences caused by illness or disability, or serious illness or quarantine in the family. The family will be defined as husband, wife, father, mother, son, daughter, sister, brother, grandparent, parents-in-law, sisters-in-law, brothers-in- law, sons-in-law, daughters-in-law, and grandchildren. The unused portion of such allowance shall accumulate from year to year up to an unlimited number. 2. That limitation that the right to such reimbursement terminates at the close of each school year. If a credit of at least twenty-first year teacher fails to earn the five (255) sick leave days had credited to him/her in the aforesaid contractual provision and uses the credited sick leave days before he/she has earned the same and does not continue with his/her employment in the District, said teacher shall be obligated to reimburse the school district for all or that portion of the used sick leave days that have not been accumulated earned. B. A teacher sustaining injury or occupational disease arising out of and in the course of any employment shall be continued on the payroll to the extent of his/her sick leave reserve; provided, that where he/she receives income under the Workmen's Compensation Act, such income shall be supplemented by the administrator Board of Education with an amount sufficient to maintain his regular salary or wage for as long as he/she has accumulated sick leave. Such leave accumulated shall diminish proportionately to the salary supplement provided by the Board. C. Each teacher shall be entitled to a sick leave accumulation of the unused yearly portion but not to exceed one hundred seventy-seven (177) accumulated sick days. D. Upon request, each teacher absent for five (5) consecutive working days agrees to present a certificate from his personal physician testifying to the satisfactory condition of his health. The Board may, at its expense, require an examination by an independent physician. E. The Board may request a teacher to submit to physical or mental examinations by appropriate specialists to determine whether involuntary sick leave is warranted. Such requested examinations will be at the beginning Board's expense. If the teacher desires, he may submit the request for study and recommendation by a four person committee, two members of which shall be appointed by the board and two by the Lake Xxxxxx-Xxxxxxx Education Association. The committee will review the problem and submit an advisory recommendation, but the ultimate decision is reserved to the Board. F. Teachers employed on a part-time basis or for part of the school year, and b. That year will only be granted a statement from a qualified physician which certifies the illness is submitted sick leave allowance proportionate to the Superintendent’s office, andtime employed. c. That additional sick pay shall not exceed one-half (1/2) of G. Teachers whose service to the amount that system has been accumulated at the beginning of the school year, and d. That additional sick pay terminated for any period beyond an approved leave shall not extend beyond the current school yearforfeit any accumulation under this article. 3. An administrator H. I. The teacher agrees to notify the Board's representative of his or her intention to be absent from school as early as possible, and not later than 6:30 a.m., if known. J. Any teacher who, by willful misrepresentation, violates or misuses this policy or misrepresents any statement or condition under said policy, shall forfeit any current leave or accumulations under any leave policy in effect in the system for a combined cumulative total equal period of twelve (12) calendar months, unless reinstated sooner by the Board. K. If the teaching staff is not required to work because of inclement weather the value of accumulated sick days. Only after this combined equivalent amount has been used up, will sick days bargaining unit member shall not be charged to the administratorfor that day. 5. An administrator who has been absent L. A teacher may use five (5) consecutive work of the eleven (11) sick days for illness of spouse, children and parents of employee or spouse and legal dependents of immediate household. The superintendent may grant additional days depending on the circumstances.* *The above leave would be limited to eleven (11) days per year, except in unusual circumstances, and would be chargeable to a teacher's accumulated sick leave. The superintendent, upon request, may require a statement from the attending physician to indicate the serious nature of the illness or injury. This also includes dental appointments for children which are of an emergency nature. N. If a teacher has accumulated the maximum number of sick days, any additional accrued unused sick days in that calendar year may be requested to present a doctor’s statement upon return to work. In case of prolonged illness (after ten (10) consecutive work days) sold back at the administrator must provide a report from a doctor. In addition, a pattern of absences may also require a doctor’s statement. 6. Administrators not reporting to work are to notify the Superintendent’s office by 8:00 a.m. the morning end of the absenceschool year for $10 per day. 7. A sick leave bank may be established by bargaining unit members from their own accumulation of unused sick days. The sick leave pool shall not exceed an accumulation of sixty- four (64) days plus any days which are repaid by members who have borrowed days. The pool shall be created by a one day per year contribution to the bank from each employee until the maximum deposit of sixty-four days is achieved. The bank will be administered by a committee comprised of the same three teachers and the same three board members or its designees each school year. No sick days will be loaned out unless all sick and personal days of the requesting employee are depleted. Application for bank days must be submitted in written form by the employee, the committee can then grant no more than ten (10) days at a time up to a maximum of 25 days per year per teacher. The sick bank committee may address repayment issues from time to time. If the total bank deposit falls twenty-four (24) days below the sixty-four (64) day maximum, one sick day shall be required of each member, each year, until the bank is restored to the sixty-four day limit. If less than one (1) yearday per member is required, ½ day shall be donated by each teacher. Employees returning will replenish the days used at the rate of every other sick day earned being repaid to the sick bank until 5 days are accumulated then all sick days go to the sick bank until it is repaid. Death or disability which results in the employee not being able to work in the district will result in the forgiveness of these days. The use of pool sick leave days shall be limited to major catastrophes and shall not be used for maternity leave or childcare purposes unless associated with a health care problem. Sick leave pool days cannot be used for retirement purposes. Annual reports on the status of this sick leave pool, including a number of days remaining, will be a mutual duty assigned to the Union and the Employer. The Sick Leave Bank Committee will meet at least once per year and minutes will be kept. It is mutually recognized that use of the sick leave bank prior to September 1, 1998 shall be governed by the language in the earlier contract and shall not be precedent setting. N. If a teacher has accumulated the maximum number of sick days, any additional accrued unused sick days in that calendar year may be renewed each year upon written request by sold back at the administrator unless serious permanent disability shall have occurred. 4. Additionally, and as an alternative, bargaining unit members shall be allowed to voluntarily donate up to two (2) unused personal illness days from their personal sick leave to another bargaining unit member when requested. E. First year teachers shall accrue sick leave at the rate of one day for each year upon written request month worked. F. Sick leave loans (as set forth in Article 4.2 D, above) shall be repaid by the administrator unless serious permanent disability teacher by either: 1) Deduction from the teacher’s next year’s allotment as provided in Article 4.2 A, above; 2) Repayment of the daily rate multiplied by the number of days through payroll deduction on a schedule to be mutually developed by the district and the teacher; or 3) A combination of these two methods as agreed upon by the district and teacher. The selection of method of repayment shall have occurredbe agreed upon by the teacher and district prior to finalizing approval of the loan. The Employer reserves the right to recoup any sick leave loans not taken care of within one year of issuance by deducting the balance owed from the teacher's salary in installments of two days per paycheck until the balance is satisfied. 4. Absence due to an on-the-job injuryG. Immunization for scarlet fever, but not involving personal gross negligencemeasles, will entitle the insured to supplemental compensation defined below: Supplemental compensation payable for absence necessitated by injury mumps, and chickenpox will be comprised of Worker’s Compensation in part, and payment of the differential provided by the Board Employer. In the event that a teacher who has taken advantage of this program contacts any of these diseases from classroom exposure, (s)he will receive pay for work days missed without loss of sick leave. A teacher who refuses or neglects to effect a combined cumulative total equal to be immunized will not be compensated other than by the value terms of accumulated sick days. Only after this combined equivalent amount has been used up, will sick days be charged to the administratorParagraph A above. 5. An administrator H. Any teacher retiring, resigning, laid off, or otherwise terminating employment with the district, other than termination for cause, who has been absent five (5) consecutive work days may be requested to present a doctor’s statement upon return to work. In case of prolonged illness (after not less than ten (10) consecutive work daysyears of service to the district shall receive one-third (1/3) the administrator must provide a report from a doctor. In addition, a pattern of absences may also require a doctor’s statement. 6. ILLNESS AND DISABILITY. 1. A. At the beginning of each school year, each administrator full-time teacher shall be credited with a fourteen ten (1410) day sick leave allowance (effective July 1, 2015 twelve (12) day sick leave allowance) to be used for absences caused by illness or disability, or serious illness or quarantine in the family. The family will be defined as husband, wife, father, mother, son, daughter, sister, brother, grandparent, parents-in-law, sisters-in-law, brothers-in- law, sons-in-law, daughters-in-law, and grandchildrenstaff absence days. The unused portion of such allowance shall accumulate from year to year up to an unlimited number. 2. Additional sick B. After one (1) year in the District additional staff absence pay will may be granted to administrators teachers who exhaust their accumulated sick staff absence leave subject to the following conditions: a. That a credit of at least twenty-five (25) sick leave days had been accumulated by the administrator at the beginning operating procedures of the school year, and b. That a statement from a qualified physician which certifies the illness is submitted to the Superintendent’s office, and c. That additional sick pay shall not exceed one-half (1/2) of the amount that has been accumulated at the beginning of the school year, and d. That additional sick pay shall not extend beyond the current school yearbank. 3. An administrator C. A teacher who is unable to work teach because of personal illness or disability and who has exhausted all sick leave staff absence available, shall be granted a leave of absence without pay for the duration of such illness or disability up to one (1) year, and the leave may will be renewed each year upon written request by the administrator teacher (accompanied by a doctor’s note) unless serious serious, permanent disability shall have occurred. A teacher who qualifies for LTD benefits shall have health insurance provided the first two (2) years of eligibility for LTD. 4. D. Staff who has have been absent five three (53) consecutive work days may be requested to present a doctor’s statement upon return to work. An employee, whether male or female, is entitled to twelve (12) workweeks of family leave during any twelve (12) month period. An employee is anyone who is employed by the employer on a continuous basis for the previous fifty-two (52) weeks for at least 1.250 hour of service during those fifty-two (52) weeks, excluding authorized leave or periods of time in which persons do not report to work but have a continuing employment relationship and do not collect unemployment benefits. b. The family leave may be taken: (1) because of the birth of a child and to care for a newborn child; (2) because of the placement of a child with the employee for adoption or xxxxxx care; (3) to care for a child or a spouse or a parent who has a serious health condition; or (4) because of the employee’s own serious health condition. If both parents of the child are employed by the district, they together are entitled to a total of twelve (12) weeks of leave, and leave may be granted to only one (1) parent at a time. c. Leave taken to care for a newborn or newly adopted child must be completed within twelve (12) months after the birth or adoption. Leave taken to care for a terminally child may be taken only once for any given child. The district may require confirmation by a health-care provider of the employee’s need for family leave.
